The sponsor(s) shall indemnify, defend and hold harmless the City, its agents and employees from and against any and all claims, demands expenses, costs and liabilities of any kind or nature, directly or indirectly caused by, arising out of, or related to the intentional, negligent or reckless acts or omissions of the sponsor(s), its agents, employees, sub‐contractors, guests and event participants. INSURANCE During the performance of the Service described herein, the sponsor(s) shall maintain Commercial General Liability to protect the sponsor(s) and the City against any and all injuries to third parties, including personal injury and property, and special and consequential damages, resulting from any action, omission or operation by the sponsor(s) or in connection with the services described herein. This insurance shall provide bodily injury and property damage limits of not less than $1,000,000 for each occurrence, respectively. The minimum liability coverage required may be increased depending on the nature of the services provided. The sponsor(s) shall provide with this application an original, signed Certificate of Insurance evidencing the Revised on 20Jan2011/jwl General Liability Insurance and, in that certificate of insurance, shall name the City as an additional insured and state that the coverage is primary to any other coverage the City may possess. Failure to deliver a valid certificate of insurance or cancellation of the insurance prior to the event will result in this permit being denied or immediately revoked. NOTES: 1‐ Do not announce, advertise, or promote your event until you have a signed permit. 2‐ The Winston‐Salem Police Department shall determine the number of officers needed to appropriately control traffic, provide for security for your event, and the time such services shall commence and end. 3 ‐ When permitted, the permit is for public rights‐of‐way only. No. 4737, adopted Oct. 24, 2005. (Supplement No. 33) Sec. 38-5. Parades. (a) Any parade upon the public ways used primarily for vehicular parking or moving traffic is hereby prohibited unless conducted in accordance with the provisions of this section. For purposes of this section, a parade is any parade, march, procession, walk, run, or moving congregation or ceremony. (b) No such parade shall be held or conducted unless permission shall first have been given in writing by the chief of police or designee, and all persons participating in any parade without such permit shall be guilty of a violation of this section. (c) A written application shall be made to the chief of police or designee by persons or organizations desiring to hold such parade setting forth the object, time, place and route of the parade. Such application shall be made at least 96 hours before holding the parade. A response to the application shall be provided by the police chief or designee within 48 hours. The denial of a permit including the designation of an alternative time or route may be appealed to the city manager within 48 hours of notification of the denial. The appeal must be filed with the city secretary's office within the aforementioned time. A hearing before the city manager or his designee shall be scheduled within 48 hours after receipt of the appeal. Within 48 hours after the hearing, the city manager or his designee shall notify the applicant of his decision in writing. (d) The chief of police shall have authority to designate the time and route of the parade and the portion of the streets or other public places to be used, in such a way as to avoid the obstruction or impediment of public travel or public business. (e) No such permit shall be given for any parade for any unlawful purpose, or for the purpose of petitioning the city council or any officials of the city to do any illegal act. (f) It shall be unlawful for any person to conduct or participate in any parade for any purpose other than the purpose set out in the application. (g) It shall be unlawful for any person to conduct or participate in any parade or unreasonably hamper, obstruct or interfere with any parade so as to create a public nuisance, endanger the public peace, or constitute a substantial hazard to public safety. (h) All spectators, participants and persons associated or affiliated with a parade must comply with G.S. 14-277.2. (i) Signs or posters carried by participants shall be made of cardboard no thicker than one-fourth inch. Supports for such signs or posters shall be made of a nonmetallic material no wider than 3 1/2 inches and no thicker than three-fourths inch. (j) Any parade, sponsored by a nonprofit organization, during which streets are closed to vehicular traffic, shall also obtain the exhibition show permit required in section 74284. (k) The chief of police or designee may revoke a parade permit immediately upon violation of the conditions or standards set forth in this section. (l) Except as provided in subsection (e) herein, the granting, denial, or revocation of an application shall not be based upon the content or the purpose for the parade. (m) If any subsection, sentence, clause or phrases of this section is for any reason held invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this section.
