The unit aims to develop an understanding of the legal and administrative framework governing the
regulation of competition and consumer protection, including the operations of the Regulator. The unit
also aims to develop an understanding of industrial property law (patents, copyright, designs and trade
marks), particularly an ability to recognise and make the choices that confront commercial entities when
implementing an effective industrial property policy. Finally, the unit aims to develop an understanding of
the manner in which domestic regulation forms part of international regulation.

Workload requirements
Minimum total expected workload to achieve the learning outcomes for this unit is 144 hours per
semester typically comprising a mixture of scheduled learning activities and independent study.
Independent study may include associated readings, assessment and preparation for scheduled
activities. The unit requires on average three/four hours of scheduled activities per week. Scheduled
activities may include a combination of teacher directed learning, peer directed learning and online
engagement.

Unit Schedule
Second marking
Where an assessment task is given a fail grade by an examiner, that piece of work will be marked again
by a second examiner who will independently evaluate the work, and consult with the first marker. No
student will be awarded a fail grade for an assessment task or unit without a second examiner confirming
the result.
Note: Exceptions to this are individual pieces of assessment contributing 10% or less of the final mark,
unless the total of such pieces exceeds 30% of the final mark.
Return of final marks
Faculty policy states that 'the final mark that a student receives for a unit will be determined by the Board
of Examiners on the recommendation of the Chief Examiner taking into account all aspects of
assessment'.
The final mark for this unit will be released by the Board of Examiners on the date nominated in the
Faculty Calendar. Student results will be accessible through the my.monash portal.

Details of task:
BTF5150 students have a seminar presentation which is a group exercise. Each group will
comprise approximately 2 or 3 students. Each group is required to prepare and present a
seminar presentation on a topic of current interest in marketing law; for example a recent
case or change in legislation or other issue.
An outline of the presentation must be made available to the lecturer (by email
attachment) at least a day before the class is due. A written version of the presentation, of
about 1,000 words, must be submitted to the lecturer for assessment one week after the
presentation. This written version will incorporate the issues discussed in class as well as
further points made in class or in reference materials suggested by the lecturer.
The presentation will be graded according to the quality of the verbal presentation as well
as written paper in equal proportions. Each member of a group will receive the same mark
for their group’s seminar presentation provided each member of the group has made an
equal contribution to the group’s seminar presentation.

While it will be presumed that each member of a group has contributed equally to the
group’s seminar presentation, the group may determine how the work is allocated within
their group. Groups are encouraged to allow all members to contribute to the verbal
presentation. Each member of a group must email the lecturer and quantify the
contribution made by the other members of the group to the seminar presentation.

Details of task:
The research assignment is designed to test students’ ability to undertake independent
research on a self-selected contemporary legal topic.
The research assignment is an individual exercise. The research assignment is an essay
of about 2000 words words on a self-selected, contemporary commercial legal topic.
While the research assignment may relate to the unit topics, students are not restricted to
these topics, and are encouraged to research aspects of intellectual property law relevant
to their own interests and experience. Except with the prior approval of the lecturer,

students in BTX5020 are not permitted to cover the same material in their assignment as
they covered in their class presentation.
Prior to commencing work on the research essay, each student is to submit a short
synopsis or abstract (approx. 50-100 words) of their research assignment to the lecturer
for approval. This is compulsory. The research assignment must contain a
bibliography.
