The timely receipt of recommendation at this end would enable its consideration by the Competent Authority, the Director-General, CSIR. 3. If the recommendation of the Review Committee is received belatedly or at the eleventh hour in CSIR Hq., the onus for the resultant delay and elapse of the last date shall rest with the concerned Lab./Instt. The Director in his capacity as the Disciplinary Authority and the COA/AO in his capacity as the Vigilance Officer of the Lab./Instt. are, therefore, requested to ensure that recommendations are sent to CSIR by the stipulated time. No. 22011/2/78-Estt (A) dated 16.2.1979) and to say that in terms of the provisions of these office Memoranda, a Government servant, on whom a minor penalty of withholding of increment etc. has been imposed should be considered for promotion by the Departmental Promotion Committee which meets after the imposition of the said penalty and after due consideration of full facts leading to imposition of the penalty, if he is still considered fit for promotion, the promotion may be given effect after the expiry of the currency of the penalty. It has, however, been separately clarified vide Office Memorandum No. 22011/2/92-Estt (D) dated 30th November, 1995 that in such cases, the seniority would be fixed according to the position of the officer in the panel on the basis of which he is promoted on expiry of the period of currency of the penalty. 2. Doubts have been expressed regarding the pay fixation and date of commencement of the eligibility service in such cases. It is clarified that since the promotion is to take effect only from a date subsequent to the expiry of the currency of the penalty, the officer would be entitled to pay fixation in the promotional grade with effect from the date of actual promotion only. Even if a person junior to him in the panel is promoted earlier, it will have no bearing on the pay to be allowed on promotion to the officer on whom a penalty was imposed, and there shall be no stepping up of his pay. 3. Similarly, as the officer undergoing penalty is not to be promoted during the currency of the penalty, the eligibility service in the promotional grade for further promotion shall commence only from the date of actual promotion and in no case, it may be related, even notionally, to the date of promotion of the junior in the panel. Further, during the CVO's Conference convened by the Commission in Sept. 1997, the Central Vigilance Commissioner had constituted a Committee of CVOs to go into the system of contracts prevalent in PSUs and to suggest, wherever required, methods of streamlining the contracting provisions. The Committee after going through the contract system of various organisations had made recommendations on consultants as under:Consultants - A firm which has been engaged by the PSU to provide goods or works for a project and any of its affiliates will be disqualified from providing consulting services for the same project. Conversely, a firm hired to provide consulting services for the preparation or implementation of a project, and any of its affiliates, will be disqualified from subsequently providing goods or works or services related to the initial assignment for the same project. Consultants or any of their affiliates will not be hired for any assignment, which by its nature, may be in conflict with another assignment of the consultants. 3. It has come to the notice of the Commission that in a tendering process of a PSU, the consultant was also permitted to quote for work for which they had themselves estimated the rates and the consultant quoted 20% above their own estimated rates as against the awarded rates which were 20% below the estimated cost. Such overdependence on the consultant can lead to wasteful and infructuous expenditure which the organisation regrets in the long run. Meticulous and intelligent examination of the consultant's proposal is therefore essential for successful and viable completion of the project. 4. The Commission reiterates the recommendations made by the Committee that the consultants/firm hired to provide consulting services for the preparation or implementation of a project, and any of its affiliates, will be disqualified from subsequently providing goods or works or services related to the initial assignment for the same project. The Commission has observed that in a large number of Government organisations and PSUs, payments to contractors/suppliers are inordinately delayed. This makes the system vulnerable to corruption, in addition to increasing the cost of procurement by the Government agencies. 2. The Commission has therefore directed that all the CVOs should undertake a review of bills received during the last six months. The review is meant to primarily determine the time taken in clearing the bills. Necessary help from the concerned Finance/Administration departments may be taken wherever required. Wherever the systems have not yet been computerised there may be practical difficulties in conducting such a review for all the bills. The organisations may fix a cut off limit for review. It is suggested that the cut off limit for bills can be Rs. 1 lakh i.e. time taken for payment of all bills above this amount should be seen. In smaller organisations the cut off limit can be lower depending on feasibility and convenience. 3. The CVOs should also review whether payments are being made on ``first-come-firstserve'' basis or not. 4. The Central Vigilance Commission had issued a directive vide order No. 98/ORD/1 dt. 18.12.03 on the use of website for publicizing open tenders pertaining to the procurement and / or auction / sale of goods and services. The directions included making the complete bid documents (alongwith drawings etc.) available on the web for the prospective bidders to download and use for tender participation. Certain apprehensions have been received in the Commission regarding providing open web publicity to classified / secret documents. These classified / secret documents may include (i) Overall layouts of strategic installations like nuclear / atomic energy installations, refineries, power plants, research and defence installations etc. (ii) Process schemes or process flow diagrams (e.g. for a refinery) which require prior approval of the process licensor before they are provided to the individual bidder. (iii) Technology/design details which may be proprietary to a particular firm and require specific approval of the technology provider prior to making them available to the bidders. 2. The Commission has considered the representations and is of the view that for such open tenders which consist of documents of classified / secret nature, the organisations may go in for pre-qualification of the bidders, in the first stage of the tender. Once the bidders are prequalified, the complete tenders including the classified / secret documents which form a part of the tender may be made available to them for submitting their techno-commercial and price bids. The process of pre-qualification will involve publicizing the Notice Inviting Tenders, which could include the particulars of the tender alongwith the complete pre-qualification requirements. This Notice Inviting Tender would follow all the procedures of publicity that are normally followed for open tenders including publicity on the website. Once the suitability of the bidders has been assessed through the responses received against the pre-qualification notice, complete tenders will be issued to the pre-qualified bidders. The Organisations may adopt / follow their own procedures of maintaining secrecy of the classified / secret documents which form a part of these tenders. Thus, only the select group of qualified bidders would be in possession of the classified / secret documentation. It may however be ensured that: (i) Such procedure is followed only for the tenders which contain classified / secret documentation, after obtaining the approval of the competent authority for this purpose. (ii) The NIT (having pre-qualification conditions) conforms to all extant instructions / guidelines for ensuring a transparent tendering. (iii) Adequate opportunity and time is given to the pre-qualified bidders to bid for the work. Once the bidders have been pre-qualified, no further rejection takes place on the grounds of not meeting the pre-qualification criteria, in the later stages of the tender. 3. The post pre-qualification process of the tender may involve separate technical and financial bids. The pre-qualified bidders may be issued tenders directly or through web. In order to limit the access to the detailed tender documents on the website at this stage, a password access can be resorted to. Organisations who need to put the classified / secert documents in their procurement / work tenders must put defined tendering procedures in place for such tenders in consultation with the CVO of the Organisation, prior to operating such pre-qualification procedure for tenders containing classified / secret documents. Para 31 of Chapter XIII, Vigilance Manual Part-I provides that business dealings with the firms/contractors may be banned wherever necessary. It was also suggested that for banning of the business with such firms/contractors or for withdrawal of banning orders, advice of the Central Vigilance Commission need not be sought. 2. It is however observed by the Commission that some of the departments/organizations cite the Commission as the authority behind the decision in their orders while banning of the firms/contractors. This is not appropriate. The Commission once again reiterates its instructions that, banning of business is an administrative matter to be decided by the management of the organisation and the Central Vigilance Commission does not give its advice in such matters. This may please be noted for strict compliance. The Commission has observed that some of the Govt. Departments were not following the prescribed guidelines as regards action taken on Commission's Ist/IInd stage advices. It is also seen that some of the departments are closing the complaints on their own which were forwarded by the Commission for investigation and report. 2. Para 22 of Chapter X of Vigilance Manual provides that all cases pertaining to Gazetted Officers (may be read as Group A Officers after passing of CVC Act-2003), in respect of whom the Central Vigilance Commission is required to be consulted, will be referred to the Commission for advice (first/second stage advice). The major penalty cases pertaining to such officers envisage consultation with the Commission at two stages. The first stage of consultation arises while initiating disciplinary proceedings, while second stage consultation is required before a final decision is taken at the conclusion of the proceedings. It follows that the CVC should also be consulted in cases where the disciplinary authority have initiated action for major/minor penalty proceedings and propose to close the case on receipt of Statement of defence. 3. As regards the complaints, para 4.1 of Chapter II of CVC Manual envisages that the complaints forwarded for inquiry to the administrative Ministries/Departments, the CVO concerned will make an inquiry or have an inquiry made into the complaints to verify the allegations and will submit his report together with the relevant records to the Central Vigilance Commission. The reports of investigation should normally be sent to the Commission within three months from the date of receipt of the reference from the Commission. In cases where the CVO, need more time, an interim reply should be sent to the Commission. It is reiterated that no complaint is to be closed by the department on its own without consulting the Commission, in case the same has been forwarded by the Commission for a report. The above may be noted for strict compliance by the Ministries/Departments. A recent reference from the Union Public Service Commission, however, reveals that in cases referred to the Commission for advice, the Commission is forced to advise the penalty of Censure even when the proven misconduct warrants a stiffer/minor penalty. These are cases where the officers are on the verge of retirement and imposition of any minor penalty other than `Censure' would adversely affect the pension of the officers concerned. As has been pointed out from time to time, all possible steps should be taken to ensure that disciplinary proceedings are brought to finality without any delay in public interest as well as in the interest of the concerned Government servants. Special care may be taken about cases against officers who are on the verge of retirement so that the situation of the types referred to by the UPSC do not occur. 2. Another observation made by the UPSC is in regard to furnishing of a `Charter of Duties' of the charged officer to the Inquiry Officer as well as to the UPSC so that the alleged misconduct on the part of the charged officer can be fairly assessed. It is requested that the above point may be kept in mind while issuing chargesheet and it may be ensured that the Charter of Duties of delinquent officer may be made a part of the listed documents so as to enable the delinquent officer also to make his defence taking into account the Charter of Duties as assigned to him. The undersigned is directed to convey the sanction of the President to the grant of NonProductivity Linked Bonus (Ad-hoc Bonus) equivalent to 30 days emoluments for the accounting year 2004-2005 to the Central Government employees in Group C and D and all non-gazetted employees in Group B, who are not covered by any Productivity Linked Bonus Scheme. The calculation ceiling of Rs. 2500/- will remain unchanged. The payment will also be admissible to the Central Police and Para-military Personnel and personnel of Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme. 2. The benefit will be admissible subject to the following terms and conditions:(i) Only those employees who were in service on 31.3.2005 and have rendered at least six months of continuous service during the year 2004-2005 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible employees for period of continuous service during the year from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded to the nearest number of months). (ii) The quantum of Non-PLB (ad-hoc bonus) will be worked out on the basis of average emoluments/calculation ceiling whichever is lower. To calculate Non-PLB (Ad-hoc bonus) for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will thereafter be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of Rs. 2500 (where actual average emoluments exceed Rs. 2500), Non-PLB (Ad-hoc bonus) for thirty days would work out to Rs. 2500 30/30.4 = Rs. 2467.10 (rounded off to Rs. 2467/-). (iii) The casual labour who have worked in officers following 6 day week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 day week), will be eligible for this Non-PLB (Ad-hoc Bonus) payment. The amount of non-PLB (ad-hoc bonus) payable will be (Rs. 1200 30/30.4 i.e. Rs. 1184.21 (rounded off to Rs. 1184/-). In cases where the actual emoluments fall below Rs. 1200/- p.m., the amount will be calculated on actual monthly emoluments. II dated 9/6/98, DG, CSIR, in exercise of the powers under Rule 1.3 of the CSIR (Residence Allotment) Rules, 1997 has been pleased to approve modification of Rule 11.2 to permit retention of Council accommodation for one more year on payment of normal licence fee. The family of the deceased allottee shall be required to apply for such retention and the licence fee shall be payable in advance. The extended period of retention will, however, not be permissible in cases where the deceased employee or his/her dependants own a house at the place of posting. Sir, I am directed to invite kind attention to Rule 11.8 of the CSIR (Residence Allotment) Rules, 1997 according to which when an employee transferred to a Laboratory/Centre situated in NorthEastern Region desires to keep his family at the last station of his posting and applies within two months of such transfer for retention of the accommodation in his occupation, he may be allowed to retain the same provided the accommodation is below his entitlement and if he is in occupation of entitled type of accommodation, he will be allowed one type below and shall be charged licence fee at the rate of one and half times the normal licence fee for the period beyond the permissible period of retention of accommodation. Adopting partially the provisions of Govt. of India, Ministry of Urban Affairs and Employment, Directorate of Estates OM No. 12035/31/96-Pol. Sir, I am directed to invite kind attention to Rule 7.3 of the CSIR (Residence Allotment) Rules, 1997 according to which if an employee retains the Council Accommodation in spite of his case being covered under sub rules (a), (b) and (c) of Rule 7.2, he shall be liable to pay licence fee for the allotted accommodation as per rates mentioned in Rule 7.5. Thus, the provisions of HBA rules under Condition No. 2 of the CSIR circular No. 16 (63) Misc/91RS/E. II (U-3) dated 10/4/92, saying that a Council employee is liable to pay double the rate of interest on the amount of HBA or licence fee at prevalent market rate in case the employee does not vacate the Council/Govt. accommodation if the house was constructed at the station of his posting are not in consonance with the provisions of Rule 7.5 of the CSIR (Residence Allotment) Rules. The matter was placed before the Governing Body at its 147th meeting held on 9/12/99. The Governing Body has approved incorporation of a new Rule 7.6 (A) in the CSIR (Residence Allotment) Rules 1997 as follows: ``The condition No. 2 of the CSIR Circular No. 16(63) Misc/91RS/E. II (U-3) dated 10/4/92 shall not be applicable to the employees whose cases are covered under Rules 7.3 & 7.6 of these rules''. The effect of the amendment would be that the employees who are allotted or permitted to retain accommodation as per provisions of Rule 7.3 shall be charged licence fee as per Rule 7.5 for the period of retention. The amended provision shall come into force with retrospective effect from 6/5/98 when the CSIR (Residence Allotment) Rules 1997 came into force. The provisions contained in para 2 of CSIR Circular No. 16 (63) / Misc / 91RS / E-II (U-3) dated 10/4/92 shall stand modified to the extent indicated in this circular. Sir, I am directed to state that as per Rules 7.2 (b) of CSIR (Residence Allotment) Rules 1997, when an employee or his spouse, who has been allotted Council Accommodation constructs or purchases or acquires without taking HBA from Council or inherits a residence at the place of his posting within the Municipal Limits or within a radius of 8 kms of Lab./Instt., whichever is more, he shall have to vacate the residence within two months of completion of such construction or purchase or acquisition or inheritance, as the case may be. Rule 7.2 (d) ibid stipulates that notwithstanding the provisions under Rule 7.1 and 7.2 an employee shall become eligible for Council accommodation on payment of normal licence fee, if the house owned by him or his spouse jointly or severally is transferred by way of sale to any person other than close relations. Clarifications have been sought by some of the Labs./Instts. as to whether acquisition of any property by executing Irrevocable General Power of Attorney, `Will', `Agreement to sale' and `Receipt' etc. towards consideration will make an employee ineligible for council accommodation under Section 7.2 (b) or vice-versa under Section 7.2 (b) an employee will become eligible for Council accommodation if the house owned by him or his spouse severally or jointly is transferred to any person other than close relation by the above mode i.e. by executing irrevocable General Power of Attorney, `Will, Agreement to sale and Receipt' towards consideration. The matter has been examined in consultation with Legal Adviser, and with the approval of Director General, C.S.I.R., the following amendments have been made in Rule 7.2(b) and 7.2 (d) of C.S.I.R. (Residence Rule 1997). Contd. Coord.I/2005 New Delhi: the 29th September, 2005 OFFICE MEMORANDUM Sub: Grant of Non-Productivity Linked Bonus (Ad-hoc bonus) to the Central Government Employees for the year 2004-2005. The undersigned is directed to convey the sanction of the President to the grant of NonProductivity Linked Bonus (Ad-hoc Bonus) equivalent to 30 days emoluments for the accounting year 2004-2005 to the Central Government employees in Group C and D and all non-gazetted employees in Group B, who are not covered by any Productivity Linked Bonus Scheme. The calculation ceiling of Rs. 2500/- will remain unchanged. The payment will also be admissible to the Central Police and Para-military Personnel and personnel of Armed Forces. The orders will be deemed to be extended to the employees of Union Territory Administration which follow the Central Government pattern of emoluments and are not covered by any other bonus or ex-gratia scheme. 2. The benefit will be admissible subject to the following terms and conditions:(i) Only those employees who were in service on 31.3.2005 and have rendered at least six months of continuous service during the year 2004-2005 will be eligible for payment under these orders. Pro-rata payment will be admissible to the eligible employees for period of continuous service during the year from six months to a full year, the eligibility period being taken in terms of number of months of service (rounded to the nearest number of months). (ii) The quantum of Non-PLB (ad-hoc bonus) will be worked out on the basis of average emoluments/calculation ceiling whichever is lower. To calculate Non-PLB (Ad-hoc bonus) for one day, the average emoluments in a year will be divided by 30.4 (average number of days in a month). This will thereafter be multiplied by the number of days of bonus granted. To illustrate, taking the calculation ceiling of Rs. 2500 (where actual average emoluments exceed Rs. 2500), Non-PLB (Ad-hoc bonus) for thirty days would work out to Rs. 2500 30/30.4 = Rs. 2467.10 (rounded off to Rs. 2467/-). (iii) The casual labour who have worked in offices following 6 day week for at least 240 days for each year for 3 years or more (206 days in each year for 3 years or more in the case of offices observing 5 day week), will be eligible for this Non-PLB (Ad-hoc Bonus) payment. The amount of non-PLB (ad-hoc bonus) payable will be (Rs. 1200 30/30.4 i.e. Rs. 1184.21 (rounded off to Rs. 1184/-). In cases where the actual emoluments fall below Rs. 1200/- p.m., the amount will be calculated on actual monthly emoluments. (iv) All payments under these orders will be rounded off to the nearest rupee. (v) The clarificatory orders issued vide this Ministry's OM No. F. 14 (10)-E. The payment under these orders will be chargeable to the sub-head `Salaries' in the relevant demand for grant of the organisation concerned. 4. Sub: Filing of Returns in respect of Vigilance/Disciplinary Cases Sir, While going through the monthly, fortnightly, quarterly and annual returns submitted by the Labs./Instts., it has been observed that the information on the subject given in various returns varies, creating doubts over its authenticity. The following may be kept in view while compiling information for the returns: 1. Use the prescribed proforma only rather than devising a new one or abridging the available one. 2. Data provided should be accurate. 3. The closing balance in Monthly Reports of last month should tally with the opening balance of the current month. 4. The column `Total number of pending cases' is meant for total number of cases which are pending on the last day of a given month. Any case which has been disposed off during a given month should not be reflected under this column. The details of such disposed off cases should be provided under remarks column/foot note. 5. The number shown in column 7 ``Number of cases pending for more than one year'' of Proforma 1: ``Monthly report on the status of disciplinary cases for the month of ....'', is required to be explanined in Proforma 2: ``Monthly report on the status of disciplinary cases pending for more than one year for the month of .....''. 6. Serial no. 1. ``Complaints'' under Part A of ``Monthly Report of the CVO'' is a separate category and action taken on such complaints should be reflected only under column 8 (a) ``Investigation Reports ..... etc.'' and (b) ``Rank-wise details ..... above'' appropriately. Quite often, this information is being given under S.No. 3 (a) ``Under the CVC Jurisdiction'' or (b) ``Others'', which is not correct. 7. It has also been noticed that some Labs./Instts. are sending returns/reports quite late. This delays submission of returns to CVC/DOPT/PMO. It is, therefore, necessary that all the returns/reports are sent well in time by the Vigilance Officers. In view of the above, vigilance Officers of the Labs./Instts. are urged upon to ensure personally, that returns/reports are factually correct and the same are sent to CSIR HQs. well in time.
