With reference to the Government memo and to the Right to Information Act, 2005, I furnish herewith the
information relating to Prosecutions Department.
Prior to creation of the Directorate of Prosecution in the year 1986 the Prosecuting Officers in Andhra
region worked under the supervision of the District Collectors, whereas in Telengana region the Superintendents
of Police exercised such supervision. With a view to avoiding a dual system of supervision within the state of
A.P. the Government of Andhra Pradesh realized the need to streamline the Prosecuting system and introduced a
uniform pattern of working for prosecuting agency in the State under the supervision of Directorate of
Prosecutions. This action was taken in consonance to the recommendations of the 11th report of the Law
Commission of India headed by late Sri M.C. Setelwad, the National Police Commission and also K.
Ramachandra Reddy One-Man Police Commission of the State of Andhra Pradesh. The objective behind
establishing a Directorate of Prosecutions was to exercise close supervision and scrutiny of work relating to
various prosecuting agencies at Sessions and Assistant Sessions levels except at the High Court level.
The Directorate of Prosecutions in the State of Andhra Pradesh was created vide G.O.Ms.No:323 Home
(Courts-C) Department, dated:26-5-1986 wherein all the Prosecuting Officers were brought under the supervisory
control of the Director of Prosecutions. The Directorate is headed by a Director assisted by other subordinate
rank officials and ministerial staff. The Directorate is authorized to perform duties and exercise powers as given
hereunder:i)

The Director will be a Legal Advisor to the Director General and Inspector General of Police.
The Director will also be called upon to tender advice on matters relating to other departments like
Excise, Commercial Taxes etc.,
The Directorate will supervise the work and exercise control over all the Public Prosecutors in the
State except the Public Prosecutor in High Court.
The Directorate will advise the Government, where necessary, with regard to filing of Appeals and
Revisions in all criminal cases, and
The Directorate shall have power to scrutinize charge-sheets in cases where it is believed that
innocent persons have falsely been implicated and tender advice thereon to the concerned Public
Prosecutors.

Hitherto the service conditions of Assistant Public Proslecutors Grade-I and Police Prosecuting
Officers were governed by A.P. General Service Rules and Assistant Public Prosecutors Grade-II under the
control of the District Collectors and Police Prosecuting Officers and Assistant Police Proslelcuting Officders
under the control of Superintendent of Police by A.P. General Subordinate Service Rules. After establishment of
the Directorate Prosecutions all the services of the Prosecuting Officers in the State except of the Hon’ble High
Court of AP were placed under the control of the Director of Prosecutions and on the advent of the A.P. State
Prosecution Service Rules, 1992, issued in G.O.Ms.No:188, Home (Courts-C) Department, dated: 30-3-1992 the
services of all the Cadre Prosecuting Officers are uniformly governed by this G.O.
The obligated duties of the Prosecutors working in the Courts are to conduct prosecution of the Criminal
cases on behalf of the State filed in Criminal courts based on the investigation of the case by the Police and this
department is not directly linked to the needs of the common public and it is concerned with the parties to the
criminal cases that are pending in the Criminal Courts. The Senior Assistnat Public Prosecutors (Admn) in the
District head quarters are asigned with Drawing and Disbursing Officers and they maintain all the records relating
to budget expenditure etc., and annual inspections are being made yearly by the Joint Directors of Prosecutions
concerned and the Accountant General Office, Hyderabad. The other material available on record and the

All the Public Prosecutors, Addl. Public Prosecutor Gr-I, Additional Public Prosecutors Gr-II (including
Tenure Prosecutors) Senior Assistant Public Prosecutors and Assistant Public Prosecutors are informed that the
Right to Information Act 2005 has come into force w.e.f.
15-6-2005.
Under the said Act Public Authority has been defined in Section 2 (h) of the Act as follows:
2(h) “Public Authority” means any authority or body or institution of self-government established or constituted:
a)

by or under the Constitution;
by any other law made by Parliament;
by any other law made by State Legislature;
by notification issued or order made by the appropriate Government and includes any
i) body owned controlled or substantially financed;
ii) non-Government organization substantially financed, directly or indirectly by funds
provided by the appropriate Government.
As per the Act, each Public Authority has to fulfill certain obligations before expiry of 100/120 Days from
the commeencement of the Act ie., by 23-9-2005/12-10-2005.
Section 4(1) (a) of the Act casts an obligation on each public authority to maintain records. This section
reads as follows:
Sec. 4(1)(a) Every public authority shall – maintain all its records duly catalogued and indexed in a
manner and the form which facilitates the right to information under this Act and ensure that all records that are
appropriate to be computerised are, within a reasonable time and subject to availability of resources, computerised
and connected through a network all over the country on different systems so that access to such records is
facilitated;
Section 4 (1)(b) of the Act casts an obligation on each public authority to publish within expiry of 120
days from the commencement of the Act, manuals on the following seventeen items:
i)
the particulars of its organisation, functions and duties;
ii)
the powers and duties of its officers and employees;
iii)
the procedure followed in the decision making process, including channels of supervision and
accountability;
iv)
the norms set by it for the discharge of its functions;
v)
the rules, regulations, instructions, manuals and records, held by it or under its control or used by
its employees for discharging its functions;
vi)
a statement of the categories of documents that are held by it or under its control;

a statement of the boards, councils, committees and other bodies consisting of two or more persons
constituted as its part or for the purpose of its advice, and as to whether meetings of those boards,
councils, committees and other bodies are open to the public, or the minutes of such meetings are
accessible for public;
a directory of its officers and employees;
the monthly remuneration received by each of its officers and employees, including the system of
compensation as provided in its regulations;
the budget allocated to each of its agency, indicating the particulars of all plans, proposed
expenditures and reports on disbursements made;
the manner of execution of su
xiii)
bsidy programmes, including the amounts allocated and the details of beneficiaries of such
programmes;
xiv) particulars of recipients of concessions, permits or authorisations granted by it;
xv)
details in respect of the information, available to or held by it, reduced in an electronic form;
xvi) the particulars of facilities available to citizens for obtaining information, including the working
hours of a library or reading room, if maintained for public use;
xvii) the names, designations and other particulars of the Public Information Officers.
xviii) Such other information as may be prescribed and thereafter update these publications every year,
The Act also provided certain exemptions u/s 8 for which no information need not be
provided to the Public, which ready as follows:8. Exemption from disclosure of information – ( 1) Notwithstanding anything contained in this Act, there
shall be no obligation to give any citizen –
a) information, disclosure of which would prejudicially affect the sovereignty and integrity of India, the
security, strategic, scientific or economic interests of the State, relation with foreign State or lead to
incitement of an offence;
b) information which has been expressly forbidden to be published by any Court of law or tribunal or the
disclosure of which may constitute contempt of Court;
c) information, the disclosure of which would cause a breach of privilege of Parliament or the State
Legislature;
d) information including commercial confidence, trade secrets or intellectual property, the disclosure of
which would harm the competitive position of a third party, unless the competent authority is satisfied
that larger public interest warrants the disclosure of such information;
e) information available to a person in his fiduciary relationship, unless the competent authority is
satisfied that the larger public interest warrants the disclosure of such information;
f) information received in confidence from foreign Government;
g) information, the disclosure of which would endanger the life or physical safety of any person or
identify the source of information or assistance given in confidence for law enforcement or security
purposes;
h) information which would impede the process of investigation or apprehension or prosecution of
offenders;
i) cabinet papers including records of deliberations of the Council of Minister, Secretaries and other
Officers:

Provided that the decisions of Council of Ministers, the reasons thereof, and the material
on the basis of which the decisions were taken shall be made public after the decision has been taken, and the
matter is complete, or over:
Provided further that those matters which come under the exemptions specified in this section shall not be
disclosed;
j) information which relates to personal information the disclosure of which has no relationship to any
public activity or interest, or which would cause unwarranted invasion of the privacy of the individual
unless the Central Public Information Officer or the State Public Information Officer or the appellate
authority, as the case may be, is satisfied that the larger public interest justifies the disclosure of such
information:
Provided that the information which cannot be denied to the Parliament or a State
Legislature shall not be denied to any person.
2) Notwithstanding anything in the Official Secrets Act, 1923 (19 of 1923) nor any of the exemptions
permissible in accordance with sub-section (1), a public authority may allow access to information, if public
interest in disclosure outweights the harm to the protected interests.
3) Subject to the provisions of clauses (a), (c) and (i) of sub-section (1), any information relating to any
occurrence, event or matter which has taken place, occurred or happened twenty years before the date on which
any request is made under section 6 shall be provided to any person making a request under that section:
Provided that where any question arises as to the date from which the said period of twenty years has to be
computed, the decision of the Central Government shall be final, subject to the usual appeals provided for in this
Act.
Therefore, all the Sr.APPs(Admn) are requested to prepare the information under each of the above items
relevant to their District as enumerated under sections 4(1) (b) of the Act by 12-10-2005 ie., within 120 days of
the commencement of the Act, as required under the above Section of the Act and place it in the conspicuous
place in his office accessible to the public and also furnish the information to the public whenever requisitioned
except of the information under the exemptions u/s 8 of the Act.
Notification designating State Public Information Officer, State Asst. Public Information Officers and
Appellate Authority is enclosed herewith for information. All the Sr.APPs(Admn) are requested to implement
these instructions scrupulsouly.
