On motion of Mr. Roberts, seconded by Mr. Lagasse, the following resolution was
offered:
RESOLUTION NO. 122659
A resolution opposing Senate Bill 581, 467, and 667 as the
bills would interfere with the Parish’s home rule charter
authority to self-govern and with current lawsuits and
contracts. Specifically, the bills may affect Jefferson Parish’s
ability to pursue remedies against oil and gas companies
who have destroyed or will destroy our marshes and coastal
resources. (Parishwide)
WHEREAS, SB 581 provides for procedures relative to remediation of oilfield
sites and exploration and production sites; and
WHEREAS, SB 667 also provides for procedures relative to remediation of
oilfield sites and exploration and production sites; and
WHEREAS, SB 467 requires the court to stay proceedings under certain
conditions in a lawsuit involving the remediation of oilfield sites and exploration and
production sites; and
WHEREAS, bills would interfere with the Parish’s home rule charter authority to
self-govern and with current lawsuits and contracts; and
WHEREAS, these bills would affect the Parish’s ability to enter into contracts and
institute lawsuits ability to pursue remedies against oil and gas companies who have
destroyed or will destroy our marshes and coastal resources; and
WHEREAS, the Jefferson Parish Council, acting as the governing authority of the
Parish of Jefferson desires to oppose Senate Bill 581, 467, and 667 as the Council
believes it to be in the best interest of the people of Jefferson Parish.
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council of
Jefferson Parish, Louisiana, acting as governing authority of said Parish:
SECTION 1. That the Jefferson Parish Council opposes Senate Bill 581, 467,
and 667 as the bills would interfere with the Parish’s home rule charter authority to selfgovern and with current lawsuits and contracts. Additionally, the Parish Council opposes
the bills as they may affect Jefferson Parish’s ability to pursue remedies against oil and
gas companies who have destroyed or will destroy our marshes and coastal resources.
SECTION 2. That the Chairman of the Jefferson Parish Council or in his
absence the Vice-Chairman, be and is hereby authorized to sign and approve any and
all documents necessary to give full force and effect to this resolution.
The foregoing resolution having been submitted to a vote, the vote thereon was
as follows:

NAYS: None
ABSENT: None
The resolution was declared to be adopted on this the 9th day of April, 2014.
