“Chevrolet Cruze Shootout” Contest General Motors of Canada Limited OFFICIAL RULES AND REGULATIONS This contest is held by General Motors of Canada Limited (“GMCL”). It runs from October 29th, 2010 at 12:01 a.m. (ET) to February 27, 2011 at 9:59 a.m. (ET) (the “Contest Period”). Contest Rules & Regulations ELIGIBILITY Residents of Ontario who have reached the age of majority and who possess a valid Ontario driver’s license at the time of entry may enter this Contest. Employees of, immediate family members of, or those residing with an employee of GMCL, Oshawa Generals Hockey Club (“Oshawa Generals”), Global Spectrum Facility Management (“Global Spectrum”), The City of Oshawa (“City of Oshawa”), the Canadian Hockey League (“CHL”), current and former players, their agents and representatives, their parents, affiliates, subsidiaries and dealers, advertising and promotional agencies, sponsors, suppliers of prizes, materials or services related to this Contest, including the independent judging organization are not eligible to enter this Contest. “Immediate family” is defined as parents, siblings, children, partner or spouse. In order to participate in the Grand Prize Event (as such terms are described below), each of the Finalists who will be shooting a puck must additionally be willing and physically able to participate in such event and must be neither current nor former professional, semiprofessional or Canadian Major Junior hockey players, nor collegiate hockey players at any level (freshman, junior varsity, or varsity for men or women) in the past (5) year period immediately preceding February 28th, 2011. 1. TO ENTER 2. No purchase necessary to enter. Limit of one (1) entry per person during the Contest Period, regardless of the mode of entry. There are two (2) ways of entering this contest: (a) Online. By logging on to www.oshawagenerals.com during the Contest Period and clicking on the “Chevrolet Cruze Shootout” icon. You complete all required fields on the “Chevrolet Cruze Shootout” entry form and click on “submit” and you will automatically be entered into the Contest. Online entries must be received by 10:00 a.m. (ET) the day prior to the Oshawa Generals’ home game in order to be eligible for the next Team home game draw and all subsequent draws. (b) By ballot. To enter, fully complete the paper entry form which can be found inside General Motors Centre on the Concourse Level, 99 Athol St. East Oshawa, ON L1H 1J8 and deposit it in any of the ballot boxes there during each Oshawa Generals Team (“Team”) home game Entry Period. A Team home game “Entry Period” begins one (1) hour prior to the start of each Team home game and will close upon the completion of each Team home game during the Contest Period. If it is discovered that you attempted to enter more than once by any method, all your entries will be void. PRIZES 3. Finalist Prizes: There are two (2) Finalist Prizes available to be won. Each Finalist Prize consists of two (2) tickets to the Team game at General Motors Centre on March 20th, 2011 at 6:05 p.m. ET at the General Motors Centre, 99 Athol St. East Oshawa, ON L1H 1J8. Approximate retail value of each Finalist Prize is $50 CDN. All incremental costs in using or claiming a Finalist Prize not outlined in this prize description are the sole responsibility of each Finalist Prize winner and his/her guest, including but not limited to: transportation, parking, lodging, gasoline, meals, beverages, gratuities, entertainment, excursions, merchandise, souvenirs, local and long distance telephone calls, and all personal expenses of any kind or nature. All prizes must be accepted as awarded; with no cash substitutes and are not transferable. Finalists must agree to attend the Team home game on March 20th, 2011 and participate in the Grand Prize Event Shoot-Out Event in order to be eligible for the Grand Prize. Grand Prize: There is one Grand Prize available to be won consisting of one (1) 2011 Chevrolet Cruze 1LT, approximate retail value/MSRP: $20,945. The Grand Prize includes destination/freight charges. Colour, accessories, and other specifics of the prize will be at GMCL’s sole discretion. Manufacturer’s warranty applies to the Grand Prize. Upon notification winner will personally take delivery of the vehicle from a GMCL dealership within Canada reasonably close to the winner's home as designated by GMCL within three (3) months of being declared the winner. Winner must present adequate personal identification to claim the Grand Prize. The Grand Prize vehicle will not be released unless winner first shows proof of having a valid Ontario driver’s license in the province in which he/she resides and satisfactory insurance. Winner is solely responsible for all taxes and expenses which are not included in the prize description above, including but not limited to: registration and license fees, insurance, additional accessories and all other costs incurred in claiming, registering or using the Grand Prize. Winner is responsible for all costs associated with any upgrade or option packages winner may request and which GMCL, in its sole discretion, is willing to provide or has provided respecting any vehicle. GMCL, at its discretion, may substitute a model year 2011 vehicle of the same or like model and style in the event of lack of vehicle availability due to limited production or any other reason. Prize Draws: 4. QUALIFIERS There will be two (2) Qualifiers chosen for each Team home game beginning on October 29th, 2010, by the contest administrator, during the Contest Period. There will be two (2) random draws to declare each Qualifier as follows: (a) Online Qualifier Draws. The day each Team home game at 10:00 a.m. [ET], one (1) name will be randomly drawn from all eligible online entries that have been received up until that point. The first name drawn will be declared as the Online Qualifier to represent that day’s home Team game. Odds of being declared an Online Qualifier depends on the total number of online entries received. (b) On-site (Ballot entry) Qualifier Draw. Ballot entry period will begin one (1) hour prior to each Team home game and will close at completion of each Team home game. Immediately after the completion of the Team home game, one name will be randomly drawn and declared as an onsite Qualifier to represent that day’s home game. Odds of being declared an on-site Qualifier depends on the total number of on-site ballot entries received. 5. FINALISTS: There will be two (2) random draws to award each Finalist Prize as follows: Finalist Draw. Two (2) random draws will be held at 10:00 a.m. on or after February 28th, 2011 (ET) in Toronto, Ontario by the independent contest administrator from all valid online and on-site Qualifiers. One (1) Finalist will be drawn from the online Qualifiers and one (1) Finalist will be drawn from the on-site Qualifiers. The odds of being selected as a potential Finalist prize winner and to also be eligible to participate in the Grand Prize shoot-out game at centre ice on March 20th, 2011, is 1 in 24. Grand Prize Shoot-out Event. Each Finalist will be given one (1) opportunity to shoot twenty (20) pucks in twenty-four (24) seconds from the centre Red Line into the designated empty Regulation CHL Hockey Net. The distance from the Centre Red Line to the Goal Line is 89 feet. Each Finalist will shoot their respective twenty (20) pucks individually and in the following order: Online Finalist, on-site Finalist. There are forty (40) pucks in total to be shot. The Finalist with the most successful goals in twenty-four (24) seconds will be deemed the Grand Prize Winner. In the event of a tie the Finalist with the most successful goals in the shortest time period will be deemed the Grand Prize Winner. All or a portion of the Finalist’s back foot must be behind the plane forming the front edge of the Blue Line until after the puck is shot towards the net. A shot will be deemed to be successful if the puck travels from the hockey stick to any point within the Regulation Hockey Net (the “Net”) that completely crosses the goal line without stopping, regardless of whether it hits or is hit by another object (e.g. goal post) while in motion. If a shot stops moving before completely passing across the goal line, then that shot will be deemed unsuccessful, even if it is subsequently propelled into the Net by another puck. Successful goals that subsequently bounce out of the Net for any reason will remain successful but will not be counted twice if propelled back into the Net by another puck. All pucks will remain where they stop until the final puck has stopped moving. Any pucks still in motion towards the Net but which have not completely passes across the goal line, when the twenty-four (24) second time period expires will be deemed to be unsuccessful shots. The Contest Administrator, in its sole and absolute discretion will determine the placement of the Finalist shooters, the placement of the pucks, timing of the shots and any and all other details involved in the Shootout Event. The decisions of the Contest Administrator are final in all matters as they relate to this Contest. No practice, warm up, qualifying or trial shots will be permitted at General Motors Centre on the day of the Grand Prize Shoot-Out Event. The shoot-out game will not be considered practice, warm up, qualifying or trial shots. The hockey pucks will be approved regulation pucks provided by the Oshawa Generals Hockey Club. Finalists must wear ice cleats and a helmet (provided by Contest Administrator) and use a regulation hockey stick (as provided by Contest Administrator) to participate and must attempt the shots with no third party assistance, equipment or machinery of any kind, other than as provided by the Contest Administrator. The Net will be used as installed at General Motors Centre. GENERAL CONDITIONS 6. To be declared a Finalist and/or a Grand Prize winner and claim a Finalist Prize and/or the Grand Prize, a potential winner must: a) Be reached by the independent judging organization at the phone number listed on the entrant’s entry form within 48 hours of the random draw. b) Correctly answer, a time-limited, mathematical skill-testing question that will be asked by the independent judging organization over the telephone without help of any nature. c) Be eligible according to the contest rules and sign a Declaration and Release form that will be sent by mail, fax or e-mail and return it, duly completed to the contest organizers within seven (7) days of its receipt. The Declaration and Release requires potential Finalists and their guests (and/or parent/legal guardians if a minor) to confirm, except where prohibited by law, acceptance of the prize as awarded, eligibility to participate in this contest and compliance with these rules and to release: (i) GMCL its parent, affiliates, subsidiaries, divisions, dealers, its advertising and promotional agencies, sponsors, suppliers of prizes, materials or services related to this contest, and the independent contest organization, and all of their respective employees, directors, officers, shareholders, agents successors and assigns; and (ii) Oshawa Generals Hockey Club (“Oshawa Generals”), Global Spectrum (“Global Spectrum”), The City of Oshawa (“City of Oshawa”), the Canadian Hockey League (“CHL”), and current and former players, and each of their respective affiliates, parents, and related entities, as well as the owners, governors, officers, directors, partners, partnerships, principals, employees, agents, representatives, volunteers, sponsors, promoters, and advertisers of all the foregoing; from any liability and damages which could arise out of or are in any way related to the contest and from the awarding, receipt, possession and/or use or misuse of any prize and any travel related thereto. In the event that a Finalist should win the Grand Prize, an additional Grand Prize Declaration & Release form will is required. 7. Failure to comply with any of the above conditions or otherwise with the rules, will result in the disqualification of the selected Finalist. In this event, a new random draw from the valid entries received would be performed to award the Finalist prize and the entrant selected must be able to be reached by phone or by mail within 48 hours of the new draw, failing which another draw will be held within a subsequent equal timeframe (time permitting) up until such a time as two (2) Finalist winners would be declared. If, as a result of an error relating to the entry process, drawing or any other aspect of the contest, there are more potential winners of prizes than contemplated in the contest rules, the Contest Administrators will perform a random draw amongst all eligible prize claimants after the contest closing date to award the prize 8. Upon receipt of the Declaration and Release form, the contest organizers will notify the prize winners of the manner in which they will have to take possession of their prizes. GMCL reserves the right to determine how the presentation of the Finalist and Grand Prizes will occur and this may be either a media event, by mail, or in person. 9. By entering this contest, each Finalist and the Grand Prize winner authorize the contest organizers and their representatives to use in any related publicity, if required, his/her name, photograph, image, television appearance, any statements he/she may make regarding the prize, place of residence and/or voice for advertising purposes worldwide in perpetuity and in any form of media including television broadcast of the Shoot-Out Event and the Internet, without any form of compensation or further notice. 10. All entries become the property of GMCL and will not be returned to entrants at any time. No communication or correspondence will be exchanged with entrants, except with the entrants selected to win the Finalist and Grand Prizes. 11. In the event that, for reasons beyond their control and not related to the winner, the contest organizers were unable to award a prize as described in these rules, they will substitute a prize of similar nature and equal or greater value or, at their sole discretion, the cash value of the prize. 12. The contest is void where prohibited by law and is subject to all applicable Federal, Provincial and Municipal laws and regulations. Any dispute arising hereunder shall be adjudicated in the applicable court in Toronto, Ontario. 13. Entries are subject to verification by the contest organizers. GMCL, its advertising and promotional agencies, their employees, agents and representatives may not be held liable for, (i) late, lost, delayed, not received, damaged, misdirected, incomplete, stolen, fraudulent, or illegible entries (all of which entries shall be automatically void and not eligible for a prize); (ii) failure to receive entries due to transmission failures, busy signals, traffic congestion on the internet or at any website or technical failures of any kind, including, without limitation, malfunctioning of any network, servers, access providers, hardware or software, whether originating with sender or recipient, or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participation or downloading any materials in this contest and breaches of privacy due to interference by third party computer “hackers”. GMCL (or the independent contest judging organization) reserves the right to void any entry and/or cancel or modify the contest in whole or in part (without notice to entrants individually) if, in its sole discretion, it determines that for any reason (such as tampering or infection by computer virus or any other cause beyond its control) the contest is not capable of running as originally planned, or if fraud, technical failures, human, printing or distribution errors, or any other causes or occurrences have compromised the administration, safety, fairness or integrity of the contest. Any person entering this contest or trying to do so by any means which go against the intention of these Rules and which would be unfair to the other participants (including, without limitation, computer hacking, fraudulent use of one or several access codes or obtaining such access codes through fraudulent means, etc.) will be automatically disqualified and GMCL reserves the right to seek remedies and damages to the fullest extent permitted by law - including criminal prosecution. 14. By entering this contest, entrants accept and agree to be bound by these rules and the decisions of contest sponsor, GMCL and the independent judging organization, which are final, binding and conclusive on all matters relative to this contest.
