The DWI Drug Court program shall take into consideration the participants’ medical and mental health status and provide medication monitoring to the participant to ensure their needs are met. 2. The DWI Drug Court program shall review the medications to be monitored on a regular basis to ensure the latest and most up to date information is known for monitoring purposes. 3. Allowable prescription Drugs – Below is the list of allowable prescription drugs: a. Advil, Aleve, Aspirin, Ecotrin, Tylenol, Ibuprofen, Toradol, Sudafed, Clinoril, Feldene, Meclomen, Medipren, Motrin, Nalfon, Naprosen, Robitussin DM (5 cc every 4 hours for cough), Tessalon, Perles for cough. b. The following should only be used per doctor/team approval: i. Exceptions: Certain exceptions may be made for prescribed psychotropic medications used for therapeutic purposes and will be reviewed on a caseby-case basis. Any participant granted an exception will ensure the Drug Court Office has a copy of the treatment plan (see Procedure ECMC – 08, Treatment) and a copy of the prescription with the prescribing doctor’s signature. 2 Eddy County Magistrate DWI Drug Court Program Procedures Number: ECMC - 10 Name: Medication – Acceptable/Non-Acceptable List(s) Issued: October 10, 2011 q. “Legal Highs,” “Bath Salts,” “Spice,” etc.: Items including, but not limited to: “Spice,” and other synthetic cannaboids; “K2,” “2 CE Europa,” “Vanilla Sky,” “Purple Wave,” “Ivory Coast,” “Ivory Pure,” “Ivory Wave,” “Kratom,” “Krokodil,” et al; methyledadiozpryrovalerones (MDPV’s), or any product sold or marketed under false pretenses with the warning “not for human consumption,” are strictly prohibited and as of March 1, 2011 are considered a “banned” substance by the United States Government. i. If suspected of using the above mentioned substances participants will pay for drug testing devices/kits/laboratory work at their own expense to test for these substances. a. Medication Management/Monitoring Compliance: As a part of Case Management Services/Supervision provided to individuals in the program, the DWI Drug Court Coordinator or Supervision (Probation/Treatment) Officer may help with action plans for medication management/monitoring compliance, up to and including: b. The Coordinator/probation officer may check for medication compliance by having participants show pill bottles, watch medications being taken (at scheduled times) to ensure the participant is taking the prescribed, therapeutic dosages of medications prescribed to aid with substance abuse/chemical dependency/dual-diagnosis/mental health diagnosis’. c. These checks may be done at the DWI Drug Court Office, Probation Office, Treatment Provider Office or during the frequent/random home visits. 3
