The Honorable Mayor Dixon Q. Yasay is hereby authorized to enter into a
contract with Mr. Rudy Carlo M. Mediana of RG&K Construction and
General Merchandise for the Road Concreting for the Taboc-Malanang
Road in the amount of One Million Nine Hundred Ninety Seven Thousand
Nine Hundred Ninety Nine Pesos and Ninety Nine Centavos
(P1,997,999.99).

WHEREAS, before this Body is a request for temporary closure of a portion of road to ten
wheelers truck passing thru in Barangay Malanang and Barangay Taboc ;
WHEREAS, the above described road is a Municipal road wherein the Local Government
of Opol has the jurisdiction and control;
WHEREAS, the Local Government Code has given authority to the Local Government Unit
to permanently or temporarily close or open any road, alley, park or square within its jurisdiction
during actual emergency, fiestas celebration, public rallies, agricultural and industrial fairs and
other grounds as provided therein;
WHEREFORE, on motion presented by Kag. Oscar O. Romero and seconded by Kag.

Section 1.
Ten-Wheeler Trucks are hereby restricted from passing through a portion of
road currently undertaking concreting in Barangay Malanang and Barangay
Taboc for the period from April 19, 2010 to June 1, 2010.

WHEREAS, the Municipal Engineer of Opol is undergoing a contrstuction on the drainage
canal at the barangay road of Zone 1 Igpit, Opol, Misamis Oriental;
WHEREAS, the Municipal Engineering Office had verbally requested the Chairman of the
Committee on Infrastructure for the temporary closure of a portion of barangay road at Zone 1
Igpit, Opol to facilitate drainage construction;
WHEREAS, the Local Government Code has given authority to the Local Government Unit
to permanently or temporarily close or open any road, alley, park or square within its jurisdiction
during actual emergency, fiesta celebration, public rallies, agricultural and industrial fairs and

WHEREAS, the bridge along the old National Highway in Barangay Taboc is undertaking
repairs which is making the road not suitable for vehicular traffic;
WHEREAS, Section 21 (a) of R.A. 7160 otherwise known as the Local Government Code
of 1991 provides that a local government unit may, pursuant to an ordinance, permanently or
temporarily close of open any local road, alley, park of square falling within its jurisdiction;
WHEREAS, Section 447 (a) (5) (v) of the same Code gives power to the Sangguniang
Bayan to regulate the use of streets, avenues, alleys, sidewalks, bridges, parks and other public
places x x x;
WHEREFORE, upon the motion presented by Kag. Oscar O. Romero and seconded by

Resolution No. 2010 – 182
A RESOLUTION ENACTING ORDINANCE NO. 2010 - 12
WHEREAS, Section 11, Article XIII of the 1987 Constitution, declares that the State shall
adopt an integrated and comprehensive approach to health development which shall endeavor to
make essential goods, health and other social services available to all the people at affordable
cost. There shall be priority for the needs of the underprivilege, sick, elderly, disabled, women and
children. The State shall endeavor to provide free medical care to paupers;
WHEREAS, Republic Act 7277, otherwise known as the Magna Carta for Persons with
disabilities, expressly provides that persons with disabilities shall be given rehabilitation,
opportunities for self development and self-reliance to prepare them for full integration into the
mainstream society;
WHEREAS, Republic Act No. 8425, otherwise known as the Social Reform Act provides for
the poverty alleviation of the basic sectors, including persons with disabilities;
WHEREAS, the BIWAKO Millennium Framework which promotes aright-based, Barrier free
and inclusive society for persons with disabilities is supported by Proclamation No. 240 “Declaring
the period 2003-2012 as the Philippine Decade of Persons with Disabilities;
WHEREAS, Republic Act 7160 known as the Local Government Code of 1991 mandates the
devolution of the services of the Local government Unit;
WHEREAS, there is a need at the community level for an effective approach in providing
comprehensive rehabilitation services and in promoting the rights and empowerment of persons
with disabilities;
WHEREAS, the Community Based Rehabilitation approach has been successfully
demonstrated as an appropriate way of providing comprehensive rehabilitation services to person
with disabilities nationwide;
WHEREAS, Executive Order No. 437 dated June 21, 2005 issued by then President Gloria
Macapagal-Arroyo, explicitly encourages all LGUs to:
a.
Adopt the Community Based Rehabilitation (CBR) strategy in delivering services to
their constituents with disabilities and to allocate funds to support the program;

MUNICIPALITY OF OPOL, MISAMIS ORIENTAL AS A STRATEGY FOR THE FULL
INCLUSION OF PERSONS WITH DISABILITIES IN ALL COMMUNITY ACTIVITIES AND
ALLOCATING FUNDS TO SUPPORT THEREOF
BE IT ORDAINED by the Sangguniang Bayan of Opol, that:
Section 1. The Local Government of Opol, Misamis Oriental shall adopt a Community
Based Rehabilitation as a strategy for the full inclusion of Persons with
Disabilities in all Community Activities.
Section 2. The suggested guidelines for the adoption of the Executive Order No. 437 shall
also be adopted.
Section 3. Effectivity. Upon approval of the Local Chief Executive.

AN ORDINANCE SUPPORTING THE SITE DEVELOPMENT AND
IMPLEMENTATION OF THE OPOL TEENS HEALTH QUARTERS (THQ), A SOCIAL
FRANCHISE MODEL DEVELOPED BY THE FOUNDATION FOR ADOLESCENT
DEVELOPMENT, INC. (FAD, INC.) WITH FUNDING SUPPORT FROM THE OFFICE
OF CONGRESSMAN YEVGENY EMANO, DOH & POPCOM REGION 10, GERMAN
EMBASSY AND LOCAL GOVERNMENT UNIT OF OPOL, MISAMIS ORIENTAL.
WHEREAS, the Philippines under the 1987 constitution stresses that one of the commitments
of the State is the strengthening of the family as a basic social institution and by virtue of this, the
Philippines entered into and made commitments under the Declarations of the 1994 International
Conference on Population and Development (ICPD) and the Fourth World Conference on Women
in 1995 where it recognizes the importance of addressing the sexuality and fertility issues of both
men and women of reproductive age and the need to give emphasis on population welfare;
WHEREAS, the National Government through Executive order No. 307 acknowledges the
need for the “Full support and active involvement of the local government units (LGUs) to
implement the Philippine Family Planning Program Nationwide” and enjoins LGU through DILG
Memorandum Circular No. 88-47 to “organize/establish functional local population development

committees” and “to mobilize the private sector and other non-government organizations to
actively participate in the local population welfare programs” toward this end;
WHEREAS, Her Excellency, President Gloria Macapagal-Arroyo made a public
announcement that her administration’s population and family planning policy would be consistent
with the four (4) basic principles, namely: (i) responsible parenthood, (ii) respect for life, (iii) birth
spacing, and (iv) informed choice;
WHEREAS, the UN Millennium Development Goals includes: Goal No. 3 Promote Gender
Equality and Empower Women: Goal No. 6 Combat HIV/AIDS, malaria and other diseases;
WHEREAS, in the recently held International Conference on Reproductive Health
Management (ICRHM), emphasis was given on the importance of Adolescent Sexuality and
Reproductive Health:
WHEREAS, A declaration crafted by the youth delegates during the ICRHM was presented
to Senator Rodolfo Biazon as Co-Chairperson of the Philippine Legislative Committee on
Population Development (PLCPD) in the Senate.
WHEREAS, in the ICRHM youth declaration, the youth delegates are demanding that the
National Government, Legislators, Local Government Units respect their right to access
information about their Reproductive Health Rights; Facilities and services dedicated to young
adolescents be made available and accessible.
WHEREAS, according to the Young Adult Fertility and Sexuality Study (YAFS), 1/5 or
16.5 million Filipinos belong to 15-24 years old age group or adolescents; 30% of all births belong
to age 15-24; 25% are already mothers at age 20; 16% of 400,000 induced abortion per year are by
teeners; 62% of reported STs belong to ages 15-24; 62% of newly reported HIV-AIDS infections
belongs to 15-24 years old.
WHEREAS, according to the National Youth Commission Ten Million Filipinos
(10,000,000) are engaged in drugs and seventy percent (70%) are within the age group of 15-24;
WHEREAS, the Foundation for Adolescent Development, Inc. (FAD, Inc.), a private, nonprofit, non-government organization, duly organized and existing under the virtue of the laws of
the Philippines, with principal office address at 1066 Remedios corner San Bartolome Sts. Malate,
Manila, has embarked on a project dubbed as “teens Healthquarters (THQ) Social Franchise Model
Project”
WHEREAS, FAD Inc. developed the THQ Social Franchise Model in the last (8) eight
years with eleven (10) franchises located in Baguio City (Baguio Center for Young Adults),
Dasmariñas, Cavite (De LaSalle), Marikina City (LGU), Tarlac City (LGU), Sagada, Mountain
Province (LGU), Municipalities of Carmen, Talibon & Ubay, Bohol (LGU)
WHEREAS, Teens Healthquarters (THQ) aims to provide “a center that makes accessible
to young people (13-24) information-education, values clarification and behavior modeling as well
as select medical services relevant to sexuality, reproductive health and development needs,
managed by youth friendly, competent professionals and volunteers”.
WHEREAS, THQ will also provide counseling and referral network.
WHEREAS, The Municipal Government of Opol through its Local Chief Executive- Hon.
Dexter B. Yasay, Congressman – Hon. Yevgeny Emano, DOH-POPCOM Region 10, German

Embassy, City Councilors and Municipal Health Office in partnership with FAD, intends to
provide a THQ for the youth of Opol;
WHEREAS, the THQ Transfer of Technology will include the materials on Franchisee
Operation and Training, Educational and Promotional Materials, Transfer of Technology Training,
Initial Marketing and Branding Assistance, Monitoring the Maintenance of Standard Operations
and Access to future materials that will be develop by the foundation, Endorsement to FAD
Referral Partners and Donors and Access to skills enhancement trainings as made available to
FAD;
WHEREAS, the Municipal Government shall provide the License fee, site and its
improvement, equipment for medical, dental and educational service, Personnel, Expenses of Opol
THQ personnel during the THQ transfer of Technology Training, Monthly Operating expenses,
and Membership Fee;
WHEREAS, the THQ License Agreement between the Municipal Government and FAD,
Inc. will be for a period of two (2) years, during which FAD, Inc. will continuously provide
technical assistance;
WHEREAS, the Municipal Government and FAD, Inc. will have to agree after the initial
two years if they are to continue with the relationship;
WHEREAS, Opol is one of the fastest growing Municipal in Misamis Oriental. Thus, the
exigency for a project that will address the Adolescent Sexuality and Reproductive Health needs of
the youth of Opol that will focus on education through values formation with special focus on
preventive education, availability of youth friendly medical services both general and reproductive
health, counseling and referral network;
NOW, THEREFORE, be it ORDAINED by the Municipal Council of Opol, in session
duly assembled, the following:

SECTION 2. OPERATION – the project will be under the supervision of the Municipal

SECTION 3. EQUIPMENTS- The needed equipments will be sourced from the DOH
Region 10, PDAF of Congressman Yevgeny Emano and the Local Government of Opol;
SECTION 4. PERSONNEL- Personnel will be assigned by the Office of the Mayor

SECTION 5. SITE AND SITE RENOVATION- A dedicated site will be provided by the
Local Government and shall be renovated in accordance with the THQ standards.
SECTION 6. OPERATIONAL BUDGET- The amount of P100,000.00 from MHO for
the year 2011 and every year thereafter is hereby appropriated for the implementation of Opol
Teens Healthquarters;
SECTION 7. EFFECTIVITY- This ordinance shall take effect immediately upon its
approval.

WHEREAS, the LGU of Opol, Misamis Oriental has established the Opol Community
College to bring tertiary education closer to the community;
WHEREAS, the OCC has shared buildings and facilities with the Opol National Secondary
Technical School in Taboc, this Municipality;
WHEREAS, there is a need for the OCC to have a separate campus;
WHEREFORE on motion presented by Kag. Oscar O. Romero and severally seconded; it
was
RESOLVED AS THE BODY HEREBY RESOLVES to enact Ordinance no. 2010 - 15

AN ORDINANCE DECLARING 3,116 SQ.M. PART AND PARCEL OF LOT KNOWN AS OPOL
PUBLIC PLAZA WITH LOT # 5037 LOCATED AT BARANGAY POBLACION, MUNICIPALITY
OF OPOL AS THE SITE OF OPOL COMMUNITY COLEGE.
BE IT ORDAINED by the Sangguniang Bayan of Opol, that :
Section 01. An area of 3,116 sq.m. and bounded by the perimeter Municipal Road of this
municipality is hereby declared as educational developmental area.
Section 02. The Public Plaza owned by Municipal Government of OPOL under TD
#0815000100414 with an area of 9,983 sq.m.
Section 03. This Educational Developmental Area is the most conducive to learning, bounded in
the NORTH by Municipal Road known as P. Maape St. and in the EAST by another Municipal
Road known as C. Salva St. and on the SOUTH by Municipal Road S. Vacalares St. and on the
WEST by M. Salva St.
Section 04. Prohibited and Punishable Acts
The following acts are considered violation of this ordinance:

Section 05. Any violation of this Ordinance shall be penalized and shall be fined an amount of
more than Php 2,500.00 or imprisonment of not less than 30 days but not to exceed 6 months or
both at the discretion of the court.
