“Best of Mid-Valley” OFFICIAL RULES 1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. SUBJECT TO APPLICABLE FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS. VOID WHERE PROHIBITED. 2. Eligibility. The “Best of the Mid-Valley” (the “Contest”) is open to Oregon residents who are 18 years and older at the time of entry. Employees and contractors of Statesman Journal Media (“Sponsor”), Gannett Co., Inc., and each of their respective affiliated companies, subsidiaries, advertising or promotional agencies, and other agents, and the immediate family members of, and any persons domiciled with such employees or contractors, are not eligible to enter or to win. 3. How to Nominate and Vote. The Contest begins at 8:00 a.m. (P.T.) March 5, 2012 and ends at 5 p.m. (P.T.) April 8, 2012 (the “Contest Period”). Nominations will be accepted beginning at 8:00 a.m. (P.T.) Monday March 5, 2012 and ending at 12:00 p.m. (P.T.) Monday March 12, 2012 (The “Nomination Period”). During the Nomination Period enter online by visiting statesmanjournal.com/bestof or facebook.com/statesmanjournal.com, select one of seven topic areas (1) Food & Drink; (2) Entertainment; (3) Recreation & Fitness; (4) Personal Services; (5) Professional Services; (6) Shopping; (7) Local Schools) and completing the survey in each area by entering a name in a text entry field and selecting a city from a dropdown field. You are not required to nominate in all categories. You may return any time before noon Monday, March 12 to add nominations to unfilled categories. Only one survey in each topic area will be accepted from a single computer. Click the submit button to enter your nominees when finished. You may nominate a single business in more than one category. Businesses with multiple locations will appear as a single nomination. Only organizations and activities that are currently operating in Marion and Polk counties will be eligible for nomination. The regular online voting period begins 8:00 a.m. Sunday, March 18 and ends at 5:00 p.m. Sunday, April 8, 2012. For those who like the Statesman Journal’s Facebook page, the online voting period beings 8 a.m. Thursday, March 15 and ends 5:00 p.m. Sunday, April 8, 2012. Visit StatesmanJournal.com/facebook and select “like”. During the Voting Period enter online by visiting statesmanjournal.com/bestof, select your favorite nominees from the drop-down menu listed. You are not required to vote in all categories. You are permitted to vote once in each category per day. Sponsor will not be responsible for incomplete, lost, late, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. 4. Winner Selection. The business with the highest vote total from each category will win the “Gold” award. The business with the second highest vote total from each category will win the “Silver” award. The business with the third highest vote total from each category will win the “Bronze” award. The business can win for more than one category. 5. Prizes and Odds. All “Gold” “Silver” and “Bronze” businesses will be awarded a winner certificate and will be listed under the category for which it won in the Winners Announcement section. In the event of a tie in any category, more than one winner may be awarded. Odds depend upon total votes received. 6. Winner Notification and Acceptance. Owner of the winning business will be notified by email, phone, and/or in person by a Statesman Journal Media representative. Winners may waive their right to receive prizes. Prizes are non-assignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners may be required to complete an affidavit of eligibility/liability and publicity release which must be returned as directed by Sponsor. Failure to complete, sign and return the affidavit, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor. 7. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this contest as solely determined by Sponsor. In the event the contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the contest. Should the contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date. Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest. In the event of a dispute, all online entries and/or votes will be deemed to have been submitted by the owner of the Facebook or ISP account from which they were sent. For these purposes a Facebook or ISP account holder shall mean the natural person assigned to such account by the Internet access provider, online service provider or other organization responsible for assigning Facebook or ISP addresses for the domain associated with such account. All entries must comply with Facebook’s Data Use Policy http://www.facebook.com/about/privacy or will be disqualified. Facebook is not a sponsor of the Contest, and expressly disclaims any and all liability in connection with the Contest. All entries that do not comply with Facebook’s guidelines will be disqualified. By participating you release Facebook from any liability in connection with this Contest. 8. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. 9. Sponsor The Best of the Mid-Valley is sponsored by Statesman Journal Media. The decisions of Sponsor regarding the selection of winners and all other aspects of the contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the contest.
