The LAB, Foley Street, Dublin 1 1 Units 3 & 4, Foley Street Terms and Conditions Booking Agreement Conditions All applications for use will be regarded as provisional until confirmed in writing by the Arts Office. The person who signs the booking Agreement shall be considered the Hirer and point of contact for the booking. Where bookings are made on behalf of an organisation, that organisation shall be considered the Hirer The person or organisation, named as the Hirer is responsible for ensuring that all payments are made in full and on time. Dublin City Council will not engage in third party negotiations for payments under any circumstances. The term Hirer refers to the individual making the booking and they will be responsible for ensuring all the conditions are complied with. Written confirmation using this form will be taken as acceptance of these terms and conditions. Rate/Deposit /Cancellations A standard rate of 300 euro rent, per month, will be applied to all applicants (unless otherwise stated) Deposit of one month is payable in advance. Rent is charged per calendar month and not part thereof (unless otherwise stated) Rent includes utilities – fair usage policy applies. On receipt of the booking the full amount of the rent will become due unless otherwise agreed by the Arts Office. A minimum of one month’s notice by either party must be given for all cancellations. Cancellations must be made in writing or email and will be effective on the date received by Dublin City Council. On receipt of the form you will receive a confirmation reference in writing from Dublin City Council. Dublin City Council reserves the right to change the booking conditions/Booking Agreement at anytime. A review of the booking/Booking Agreement conditions and charges will be undertaken every 6 months. Conditions Car parking is not provided however on street parking is available. Units 3 & 4 may not be used for any illegal or immoral purpose. Permission to bring any equipment/ temporary installations into Units 3 & 4 must be obtained in advance. Dublin City Council reserves the right to refuse access for any non approved equipment/temporary installations and to remove any such equipment/temporary installation from the site and recharge these costs to the Hirer. The Hirer is responsible for all the equipment, howsoever sourced, and any equipment, or other items brought into the units by the Hirer, are stored at the Hirer’s risk. Dublin City Council does not accept responsibility for the property of the Hirer or guests. Units 3 & 4 are for the sole use of the Hirer and the artist/s named in the application and no other persons. No changes may be made to the fabric of the building without prior agreement by Dublin City Council. However normal activity, provided that prior notice is given, as might be occasioned in the installation of an exhibition is acceptable. Commercial photography and all filming and documentaries are by permission only. Commercial Filming includes the standard interpretation of all filming for sale or profit. All personal property & equipment must be removed from the premises by the end of the hire period. Penalties will be incurred if this is not adhered to. Damage incurred by the Hirer or by work undertaken on behalf of the Hirer, is the Hirer’s responsibility. DCC are responsible for general maintenance issues only. The Hirer shall not do, or allow to be done, any act which is likely to become a nuisance, danger or annoyance to other occupiers of the same building, or to adjoining occupiers. The Hirer shall ensure the premises are used as agreed at time of the issue of the rental agreement, and not for any other purpose. The Hirer is to keep the Unit in good condition & repair for the term of tenancy. The Hirer will allow the arts office, the council or a nominee of the arts officer, access to Units 3 & 4, at all reasonable times for all proper purposes of the council. Dublin City Council reserves the right of free and uninterrupted passage for utilities through the pipes and wires which are now or at any time be in/or passing through the said premises. The Hirer will allow reasonable access with the purpose of inspecting, repairing, replacing or altering such pipes and wires. The Hirer will not make any structural changes or material alteration or addition of any kind to the allocated Unit. The Hirer will not erect signs on the exterior of the Unit or in the overall complex. Vinyl lettering and other information, on the glass/window is acceptable, and may be regarded as part of the installation of an exhibition. Limited amounts of waste materials may be deposited safely in the bin store at back of The LAB. Normal recycling procedure must be undertaken including the deposit of recyclable materials at a suitable recycling centre. Only non recyclable goods can be placed in the waste bins. Any additional large waste must be removed by Hirer. 2 The Hirer shall be the person who shall be the key holder for Units 3 & 4. The keys are not to be copied or handed to any other person without the written consent of the Dublin City Council. Dublin City Council does not supply consumable goods or any other services of any description for the Unit. Safety Security & Maintenance The Hirer will indemnify Dublin City Council against all potential losses and be responsible for all cost incurred in the use of the unit. The Hirer must supply copies of suitable insurance or public liability before taking up occupancy specifically: Public Liability Insurance 6,500,000.00 euros and Employers Liability Insurance of not less than 12,700,000.00 euros and these policies shall indemnify the Council to the limits of the insurance policies. The interest of Dublin City Council should be also noted on the policies and copies of these must be provided prior to occupation. The Hirer is responsible for ensuring that they are aware of, and have complied with, all current Health and Safety legislation in all other matters. The Hirer is responsible for the Health and Safety of all individuals groups or tenants throughout the duration of the Hirer period, and for ensuring that everyone visiting or using the unit complies with all relevant legislation. Smoking is completely prohibited in all parts of Units 3 & 4. In regard to day to day use of the Units the Hirer should comply with the guidance, instructions and requests of Dublin City Council staff and its agents. The Hirer is responsible for securing and locking the units and enabling the intruder Alarm and returning the keys to Reception at the Lab, on departure from the unit each day and for any other departure regardless of duration. Unless otherwise agreed. All maintenance issues must be reported to the Arts Office on 01 222 5545 for action. The Hirer should not undertake any maintenance unless otherwise agreed. Maintenance issue, unless of an emergency nature, should be reported ASAP or on the following day during work hours. In an emergency the Hirer may call on a certified professional to undertake work; however Dublin City Council reserves the right not to pay any charges that exceed normal rates. Departure Prior to departure the Hirer will be required to ensure that Units 3 & 4, have been cleaned throughout, including all equipment, surfaces and that the building must be returned to its original state at the time of occupation etc. The Hirer will also be required to undertake a handover inspection with a representative of Dublin City Council, Arts Office. Any remedial actions required by the Arts Office in regard to the cleaning of the unit will be charged to the Hirer. The Arts Office will make the final call in regard to the satisfactory condition of Units 3 & 4 at hand over. This Agreement may be subject to changes as deemed appropriate by DCC Arts Office. 3
