Canadian Supreme Court Bias I
This study examines the distribution of cases that come before the Supreme Court of Canada, and their
outcomes. Distinctions based on issue, sex, and representation are analyzed. Data from the Canlii database
is used. All entries that fit the parameters of the study for the last 10 years are included in full. The cases
used in this study are listed in the appendixes.

Family appeals comprise only 2.1 % of appeals heard at the Supreme Court over the last decade. Self
represented appeals comprised only 0.37 %. There has not been one single self represented family appeal in
the last 25 years. No self represented appellant has won an appeal in the last 10 years. Two self represented
female respondents have won in family cases in T. (M.) v. A. (H.), [1995] 1 S.C.R. 445, and Leskun v.
Leskun, 2006 SCC 25. A male self represented respondent also won in a civil case in Blank v. Canada
(Minister of Justice), 2006 SCC 39 (CanLII). Males have won 33.3 % of the family appeals they have
brought before the Supreme Court. Females have won 68.0 % of their family appeals. Support and ‘ other ‘
issues were the most prevalent issues for both sexes. By far the most common ‘ other ‘ issue was property
equalization. The odds of a man bringing a family appeal before the Supreme Court are extremely low,
close to 1 %. The chances of a self represented person of either sex bringing a self represented family
appeal before the Supreme Court are apparently nonexistant. Examples of cases that appear to demonstrate
a sexual bias are portrayed in the next segment. A full list of the cases appraised in this study is given in the
appendixes following. It must be concluded that family cases comprise only a very small percent of the
total and there is a clear bias in favor of women. Self represented parties have almost no access to the
highest court.
Sexual Bias Cases
R. v. Lavallee, [1990] 1 S.C.R. 852
Appellant, a battered woman in a volatile common law relationship, killed her partner late one night by
shooting him in the back of the head as he left her room.
I share the view expressed by Willoughby in "Rendering Each Woman Her Due: Can a Battered Woman
Claim Self-Defense When She Kills Her Sleeping Batterer" (1989), 38 Kan. L. Rev. 169, at p. 184, that
"society gains nothing, except perhaps the additional risk that the battered woman will herself be killed,
because she must wait until her abusive husband instigates another battering episode before she can
justifiably act".
R. v. Gladue, [1999] 1 S.C.R. 688
The accused, an aboriginal woman, pled guilty to manslaughter for the killing of her common law husband
and was sentenced to three years' imprisonment.
She suspected the victim was having an affair with her older sister and, when her sister left the party,
followed by the victim, the accused told her friend, "He's going to get it. He's really going to get it this
time".
When the accused and the victim returned to their townhouse, they started to quarrel. During the argument,
the accused confronted the victim with his infidelity and he told her that she was fat and ugly and not as
good as the others. A few minutes later, the victim fled their home. The accused ran toward him with a
large knife and stabbed him in the chest. When returning to her home, she was heard saying "I got you, you
fucking bastard".
Held: The appeal should be dismissed.
More importantly, the accused was granted, subject to certain conditions, day parole after she had served
six months in a correctional centre and, about a year ago, was granted full parole with the same conditions.
The results of the sentence with incarceration for six months and the subsequent controlled release were in
the interests of both the accused and society.
R. v. Latimer, [2001] 1 S.C.R. 3
The accused was charged with first degree murder following the death of T, his 12-year-old daughter who
had a severe form of cerebral palsy. T was quadriplegic and her physical condition rendered her immobile.
She was said to have the mental capacity of a four-month-old baby, and could communicate only by means
of facial expressions, laughter and crying. T was completely dependent on others for her care. She suffered
five to six seizures daily, and it was thought that she experienced a great deal of pain.
After learning that the doctors wished to perform additional surgery, which he perceived as mutilation, the
accused decided to take his daughter's life. He carried T to his pickup truck, seated her in the cab, and
inserted a hose from the truck's exhaust pipe into the cab. T died from the carbon monoxide.
The trial judge explained that the Criminal Code provided only for a recommendation over the 10-year
minimum, but suggested that the jury could make any recommendation it liked. The jury recommended one
year before parole eligibility. The trial judge then granted a constitutional exemption from the mandatory
minimum sentence, sentencing the accused to one year of imprisonment and one year on probation. The
Court of Appeal dismissed.affirmed the conviction but reversed the sentence, imposing the mandatory
minimum sentence of life imprisonment without parole eligibility for 10 years.
Held: The appeals against conviction and sentence should be dismissed
Weatherall v. Canada (Attorney General), [1993] 2 S.C.R. 872
It does not follow from the fact that female prison inmates are not subject to cross-gender frisk searches
and surveillance that these practices result in discriminatory treatment of male inmates.
Given the historical, biological and sociological differences between men and women, it is clear that the
effect of cross-gender searching is different and more threatening for women than for men.
Moreover, women generally occupy a disadvantaged position in society in relation to men.

In Canada, statutes providing for equality in entitlement to custody were passed in some provinces as early
as 1923, although the process of legislative entrenchment was not completed until 1977
Moreover, research uniformly shows that men as a group have not yet embraced responsibility for
childcare. The vast majority of such labour, both before and after divorce, is still performed by women,
whether those women work outside the home or not
Frame v. Smith, [1987] 2 S.C.R. 99
After their separation, the wife was granted custody, with generous visiting privileges to the husband, and
more specific orders of access were later issued. The husband maintains that his former wife did everything
in her power to frustrate his access to the children: she moved to distant cities without notification, changed
the children's surname and religion, told them that the appellant was not their father, forbade telephone
conversation with him, and intercepted his letters to them. The husband alleges he has undergone
considerable expense and has suffered severe emotional and psychic distress because of this conduct and
claims damages from respondents flowing from their wrongful interference with the legal relationship he
had with his children.
20 In sum, it is by no means certain that permitting civil actions against the custodial parents can be said to
be in the best interests of the child, whether this be by creating a tort or recognizing a fiduciary relationship
arising out of a court order. Resort even to fines and imprisonment, which is permitted by the Act, has been
described as not "entirely appropriate"; see James G. McLeod, "Annotation" to O'Byrne v. Kore (1986), 2
R.F.L. (3d) 104, at p. 105. That is because these may encroach on the resources of the custodial parent and
because the child may suffer from the knowledge that one parent has taken such drastic action against the
other.

T. (M.) v. A. (H.), [1995] 1 S.C.R. 445
2 The applicant was found to have failed to pay a sum of $25,000 on account of arrears of support
payments. Briefly, the history of the proceedings is as follows. On July 31, 1991, Bishop J. rendered
judgment against the applicant ordering payment of, inter alia, support payments. On May 7, 1992, the
applicant was found in contempt by Zerbisias J. of the Superior Court, District of Montreal, [1992] R.D.F.
386 (sub nom. Droit de la famille ‑ ‑ 1605), and sentenced to four months in prison provided that he was
to be released on payment of the sum in arrears.
I am also persuaded by the respondent that as a further condition of this order, the applicant is not to
exercise his right of access to the children of the marriage under the judgment of Bishop J. during the
period of interim release.
Thibaudeau v. Canada, [1995] 2 S.C.R. 627
, … , and (5) the status of separated or divorced custodial parents is linked to the enumerated ground of sex
given that the great majority of the members of this group are women. The distinction in s. 56(1)(b), based
on the status of separated or divorced custodial parent, is discriminatory and infringes s. 15(1) since it runs
directly counter to the values underlying it.
The respondent and the intervener SCOPE relied on the evidence in the record as showing that 98 percent
of alimony recipients are women.
The non-custodial parent, for his part, always automatically benefits from the deduction,
The logic of the deduction/inclusion scheme is further called into question by the fact that our society
strongly encourages women to attain financial self-sufficiency, and, in pursuit of that essential objective, to
increase their income.
Miglin v. Miglin, [2003] 1 S.C.R. 303
It is typically women who come to the bargaining table as the financially dependent spouse, and hence the
more vulnerable party in the negotiating process.
It would be perverse in the extreme to assume that Parliament's intention in enacting the Act was to
financially penalize women in this country.
Miron v. Trudel, [1995] 2 S.C.R. 418
I think it important to note at this juncture that courts and legislatures have already acknowledged that the
effect of a distinction based on marital status may be felt more severely by women than by men.
Following the lesson of Brooks, I would respectfully suggest that more is required; if we are not to
undermine the promise of equality in s. 15(1) of the Charter, we must go beyond biological differences and
examine the impact of the impugned distinction in its social and economic context to determine whether it,
in fact, perpetuates the undesirable stereotyping which s. 15(1) aims to eradicate.
M. v. H., [1999] 2 S.C.R. 3
If the relationship breaks down, the woman is usually left in a worse situation, probably with impaired
earning capacity and limited employment opportunities.
First, Part III of the FLA is said to have been designed to remedy the systemic inequality associated with
opposite-sex relationships, including the economic dependence of women on men resulting from women
assuming primary responsibility for child care and from gender-based inequality in earning power.
The history of family law is, in many ways, the history of the gradual emancipation of women from legal
impediments to full equality.
Clarke v. Clarke, [1990] 2 S.C.R. 795
The Act is accordingly remedial in nature. It was designed to alleviate the inequities of the past when the
contribution made by women to the economic survival and growth of the family was not recognized. In
interpreting the provisions of the Act the purpose of the legislation must be kept in mind and the Act given
a broad and liberal construction which will give effect to that purpose.
Peter v. Beblow, [1993] 1 S.C.R. 980
As Lord Simon observed nearly 30 years ago: "The cock-bird can feather his nest precisely because he is
not required to spend most of his time sitting on it"
Finally, I come to the argument that, because the legislature has chosen to exclude unmarried couples from
the right to claim an interest in the matrimonial assets on the basis of contribution to the relationship, the
court should not use the equitable doctrine of unjust enrichment to remedy the situation. Again, the
argument seems flawed. It is precisely where an injustice arises without a legal remedy that equity finds a
role.
Willick v. Willick, [1994] 3 S.C.R. 670
Moreover, there are related public policy goals to consider. As recently recognized by L'Heureux-Dubé J.
in Moge v Moge ( 1992 ) 3 SCR 813 "there is no doubt that divorce and its economic effects" (p. 854) are
playing a role in the "feminization of poverty" (p. 853). A statutory interpretation which might help defeat
this role is to be preferred over one which does not. [Emphasis added.]
I most heartily agree.
Moge v. Moge, [1992] 3 S.C.R. 813
The general economic impact of divorce on women, however, is a phenomenon the existence of which
cannot reasonably be questioned and should be amenable to judicial notice.
Nova Scotia (Attorney General) v. Walsh, [2002] 4 S.C.R. 325
After the Divorce Act, S.C. 1967-68, c. 24, was enacted in 1968, divorce became more common as a social
phenomenon. , … , In the notorious case of Murdoch v. Murdoch, [1975] 1 S.C.R. 423 (Laskin J. (as he
then was), dissenting), this Court refused to allow a wife of 25 years to obtain any interest in the property,
the title to which was held in her husband's name. All claims in equity and partnership failed. Despite one
successful attempt by this Court a few years later to redress this shameful situation, in Rathwell v. Rathwell,
[1978] 2 S.C.R. 436
Francis v. Baker, [1999] 3 S.C.R. 250
The respondent earned $63,000 per year at the date of trial. Under the terms of a separation agreement, she
also received $30,000 per year in child support payments from the appellant.
The trial judge exercised her jurisdiction under the Divorce Act to award the respondent the Table amount
of child support applicable to the appellant's income or $10,034 per month for both children.
Parliament did not choose to impose a cap or upper limit on child support payments, and the appellant has
advanced no reason why this Court should do so.
Marzetti v. Marzetti, [1994] 2 S.C.R. 765
The central issue in this appeal, as I have already noted, is whether the Trustee or the Director ( Family
Responsibility Office ) has priority in respect of Marzetti's post-bankruptcy income tax refund

Brooks v. Canada safeway ltd., [1989] 1 S.C.R. 1219
Everyone in society benefits from procreation but one of its major costs is placed, under this plan, on one
group in society -- pregnant women.
Underinclusion may be simply a backhanded way of permitting discrimination.
Discrimination on the basis of pregnancy is discrimination on the basis of sex.
In the second part of this judgment I state that this disadvantage can be viewed as a disadvantage suffered
by women generally.
The disfavoured treatment accorded Mrs. Brooks, Mrs. Allen and Mrs. Dixon flowed entirely from their
state of pregnancy, a condition unique to woman. They were pregnant because of their sex.
R. v. Morgentaler, [1988] 1 S.C.R. 30
Forcing a woman, by threat of criminal sanction, to carry a foetus to term unless she meets certain criteria
unrelated to her own priorities and aspirations, is a profound interference with a woman's body and thus a
violation of security of the person.
A woman's right to make that choice freely is fundamental
It is probably impossible for a man to respond
This is not, in my view, just a matter of interfering with her right to liberty in the sense (already discussed)
of her right to personal autonomy in decision-making, it is a direct interference with her physical "person"
as well.
Thus, women's needs and aspirations are only now being translated into protected rights.
Furthermore, as the Chief Justice correctly points out, at p. 56, the committee bases its decision on "criteria
entirely unrelated to [the pregnant woman's] own priorities and aspirations".
She is truly being treated as a means -- a means to an end which she does not desire but over which she has
no control. She is the passive recipient of a decision made by others as to whether her body is to be used to
nurture a new life. Can there be anything that comports less with human dignity and self-respect?
Per McIntyre and La Forest JJ. (dissenting):
Historically, there has always been a clear recognition of a public interest in the protection of the unborn

In August 1996, the respondent was five months pregnant with her fourth child. She was addicted to glue
sniffing, which may damage the nervous system of the developing fetus. As a result of her addiction, two of
her previous children were born permanently disabled and are permanent wards of the state. On a motion
by the appellant, a superior court judge ordered that the respondent be placed in the custody of the Director
of Child and Family Services and detained in a health centre for treatment until the birth of her child. One
of the grounds for the order was the court's parens patriae jurisdiction. The superior court judge, while
acknowledging that the courts have never exercised this power on behalf of an unborn child, saw no reason
why the power should not be extended to protect unborn children. The order was later stayed and ultimately
set aside on appeal. The Court of Appeal held that the existing law of tort and of parens patriae did not
support the order and, given the difficulty and complexity entailed in extending the law to permit such an
order, the task was more appropriate for the legislature than the courts.
Held (Sopinka and Major JJ. dissenting): The appeal should be dismissed.
By contrast, extension of the parens patriae jurisdiction of the court to unborn children has the potential to
affect a much broader range of liberty interests since the court cannot make decisions for the unborn child
without inevitably making decisions for the mother herself.
Tremblay v. Daigle, [1989] 2 S.C.R. 530
Held: The appeal should be allowed.
The injunction must be set aside because the substantive rights which are alleged to support it -- the rights
accorded to a foetus or a potential father -- do not exist.
The hearing before this Court was interrupted just after the lunch recess by Mr. Bédard, counsel for Ms.
Daigle, who informed the Court that he had just learned that his client had had an abortion.

Trociuk v. British Columbia (Attorney General), [2003] 1 S.C.R. 835
On September 5, 1997, the court recognized Mr. Trociuk as the father. In that and subsequent hearings, the
chambers judge declined to amend the birth registration forms to include the father's particulars and to
change the surnames of the triplets. The father twice requested that the Director of Vital Statistics amend
the birth registration forms to include his particulars. Both requests were refused.
44 Mr. Trociuk asks this Court to order that his particulars be included on the registration of birth and that
his children's surname be changed to Ernst-Trociuk. The amended legislation provides a procedure by
which Mr. Trociuk can apply to have his particulars included on the birth registration. That is the
appropriate means by which to achieve this end. The children are now 7 years old. This Court is not in a
position to determine whether the asked-for change of surname is in the best interests of the children and,
absent the consent of both parents, this surely must be considered before an order to change the surname
can be made. The request is therefore denied.
Newfoundland (Treasury Board) v. N.A.P.E., 2004 SCC 66
The purpose of the Public Sector Restraint Act was to reduce the women's pay below this contractual
entitlement and its intended effect was to continue to pay women less than was paid to men for work of
equal value. Passage of the Act on April 18, 1991 put women hospital workers in a worse position than
they were on April 17, 1991.
The contextual factors listed in Law lead to the conclusion that the targeting of an acquired right to pay
equity amounted to discrimination within the meaning of s. 15(1) of the Charter. First, a pre-existing
disadvantage is shown since "women's jobs" are chronically underpaid and the Act perpetuated and
reinforced the idea that women could be paid less for no reason other than the fact that they were women.
British Columbia (Public Service Employee Relations Commission) v. BCGSEU, [1999] 3
S.C.R. 3,
The British Columbia government established minimum physical fitness standards for its forest firefighters.
One of the standards was an aerobic standard. The claimant, a female firefighter who had in the past
performed her work satisfactorily, failed to meet the aerobic standard after four attempts and was
dismissed. The claimant's union brought a grievance on her behalf.
Held: The appeal should be allowed
The procedures adopted by the researchers who developed the aerobic standard were problematic on two
levels. , … , Second, the studies failed to distinguish the female test subjects from the male test subjects,
who constituted the majority of the sample groups.
The broader legal issue is whether the aerobic standard that led to Ms. Meiorin's dismissal unfairly excludes
women from forest firefighting jobs. Employers seeking to maintain safety may err on the side of caution
and set standards higher than are necessary for the safe performance of the work. However, if men and
women do not have an equal ability to meet the excessive standard, the effect may be to exclude qualified
female candidates from employment for no reason but their gender.
Janzen v. Platy enterprises ltd., [1989] 1 S.C.R. 1252
It strains credulity to argue that the sole factor underlying the discriminatory action was appellants' sexual
attractiveness -- a personal characteristic -- and that gender was accordingly irrelevant.
The evil to be remedied is the utilization of economic power or authority so as to restrict a woman's
guaranteed and equal access to the work-place, and all of its benefits, free from extraneous pressures
having to do with the mere fact that she is a woman.
Because they were women, the appellants were subject to a disadvantage to which no man at the restaurant
would have been subject.
Symes v. Canada, [1993] 4 S.C.R. 695
The definition of "business expense" was shaped to reflect the experience of businessmen, and the ways in
which they engaged in business. As Dorothy Smith points out in "A Peculiar Eclipsing: Women's Exclusion
From Man's Culture" (1978), 1 Women's Studies Int. Quart. 281, when only one sex is involved in defining
the ideas, rules and values in a particular domain, that one-sided standpoint comes to be seen as natural,
obvious and general. As a consequence, the male standard now frames the backdrop of assumptions against
which expenses are determined to be, or not to be, legitimate business expenses.
Native Women's Assn. of Canada v. Canada, 1994 CanLII 27 (S.C.C.)
During the constitutional reform discussions which eventually led to the Charlottetown Accord, a parallel
process of consultation took place within the Aboriginal community of Canada. The federal government
provided $10 million to fund participation of four national Aboriginal organizations: the Assembly of First
Nations ("AFN"), the Native Council of Canada ("NCC"), the Metis National Council ("MNC") and the
Inuit Tapirisat of Canada ("ITC"). The Native Women's Association of Canada ("NWAC") was specifically
not included in the funding
NWAC was concerned that their exclusion from direct funding for constitutional matters and from direct
participation in the discussions threatened the equality of Aboriginal women
The application was dismissed by the Trial Division. The Federal Court of Appeal also refused to issue an
order of prohibition.
Held: The appeal should be allowed and the declaration made by the Federal Court of Appeal should be set
aside.
