FRANCONIA ZONING BOARD of ADJUSTMENT
MEETING
Wednesday, April 10, 2013
Board members present: Don Lawton, Melinda Richmond, Ken Mosedale, Mary Fowler, Phil
Krill, & Lydia Cumbee.
Other present: David Kerr, James Fitzpatrick, Kevin O’Neil, Bob Montagno,
A meeting of the Franconia Zoning Board of Adjustment (ZBA) was held on April 10, 2013 at
the Franconia Town Hall.
Don Lawton called the meeting to order at 6:00 PM.
Melinda Richmond and Phil Krill recused themselves from the hearing as they were listed
abutters to the property.
David Kerr, builder and agent acted for Erich Buddenhagen seeking a special exception to
construct a new garage between the existing house & garage and to convert the existing
garage into an in-law apartment. There were no objections received from abutters.
The Board went through the summary of the facts to determine whether this special exception
could be granted. The acreage requirement was met; road frontage requirements were met
there were no physical reasons found to reject this application.
The Chair closed the public meeting. Mary Fowler made a motion to accept the application;
Lydia Cumbee seconded, and all voted in favor.
Marilyn Knowlton presented some details about another case that was brought in to the office
for a use variance submitted by Gardner Kellogg for Tina & John Gargano. Upon looking at a
calendar the Chair proposed the date of May 8th at 6:00 for the next hearing. Marilyn will
make the necessary contacts and get the hearing noticed to all parties.
The Board proceeded to discuss the upcoming year’s slate of officers noting that Mary Fowler
and Lydia Cumbee’s terms were both up in 2013. Both Mary and Lydia agreed to fulfill
another term. Mary will stay on as an acting member and Lydia as the representative of the
Planning board. All other members agreed to remain in current positions with Don Lawton
continuing as Chair and Melinda Richmond as Vice Chair.
Don Lawton made a motion to nominate the slate of officers as they stand along with
reinstatements for Lydia and Mary. The motion carried and the officers for next year were
approved. Marilyn Knowlton will give the list to Selectmen so they may create appointment
letter for Mary Fowler.
Lydia Cumbee also mentioned that at last year’s town meeting one person had signed up as
an interested party to sit as an alternate on ZBA. Sharon Hoyle was never contacted. Marilyn
Knowlton will pass this along to Sally Small to see if she will notify her and see if she is still
interested. The concern of the Board was to get some new people on as alternates so that
other people are able to leave when there term is done.
The meeting was adjourned at 6:50 PM.
