TERMS & CONDITIONS HSBC AMANAH BALANCE CONVERSION PLAN CASH BACK CAMPAIGN 1. HSBC Amanah Malaysia Berhad (Company No. 807705-X) will be referred to as “HSBC Amanah”. CAMPAIGN PERIOD 2. The “HSBC Amanah Balance Conversion Plan Cash Back Campaign” (“Campaign”) shall run from 28 December 2015 to 29 February 2016, both dates inclusive (“Campaign Period”). ELIGIBILITY 3. This Campaign is open to all primary cardholders of HSBC Amanah Credit Card-i (s): HSBC Amanah Premier World MasterCard Credit Card-i, HSBC Amanah Advance Visa Platinum Credit Card-i, MPower Visa Platinum Credit Card-i and MPower Visa Credit Card-i issued by HSBC Amanah (herein after referred to as the “Participating HSBC Amanah Credit Cards-i (s)”). EXCEPT for the following categories of persons: i. Holder(s) of HSBC Amanah Credit Cards-i(s) that are not issued in Malaysia; and/or ii. Holder(s) of invalid or cancelled HSBC Amanah Credit Cards-i(s) and/or whose accounts are delinquent within HSBC Amanah’s definition at any time during the respective Campaign Period; and/or iii. Holder(s) of company and/or corporate HSBC Amanah Credit Cards-i(s) (herein after collectively referred to as the “Eligible Cardholder”). PARTICIPATION CRITERIA 4. Eligible Cardholders may convert a minimum of RM500 up to a maximum of RM50,000 of retail transactions to a Balance Conversion Plan (“BCP”). To qualify for this Campaign, the minimum amount converted to BCP is RM10,000 and which may comprise of one or more BCPs. 5. The Eligible Cardholders are required to apply for and convert retail transactions to a BCP by calling 1300 88 2626 for HSBC Amanah Credit Card-i(s). 6. Eligible Cardholders who qualify for this Campaign by satisfying clause 5 above stand to receive RM100 Cash Back for every RM10,000 or multiples thereof of retail transactions converted into BCP during Campaign Period. 7. During the Campaign Period, the Eligible Cardholder cannot: a. Cancel any existing primary or supplementary HSBC Amanah Credit Card-i(s); or b. Default on the minimum monthly payment on all of his/her HSBC Bank/HSBC Amanah Credit Card/i account(s); or c. Opt for an early settlement for all the BCP approved; otherwise the Eligible Cardholder will not be entitled to either the Cash Back. TERMS & CONDITIONS FOR CASH BACK 8. Each Eligible Cardholder will be entitled to receive a maximum of RM500 Cash Back under the Campaign, regardless of the number of and amount of BCP converted. 9. An illustration of the Cash Back which the Eligible Cardholders stand to receive for participation in this Campaign is as follow: BCPs successfully converted during Campaign Period Cash Back Amount Example 1 28/12/15– RM2,700.00 15/01/16– RM2,800.00 20/01/16– RM4,800.00 Total – RM10,300 (Since this total is just above RM10,000, the Cash Back entitlement isRM100) RM100 Example 2 28/12/15-RM12,700.00 15/01/16– RM3,100.00 20/01/16– RM4,300.00 Total – RM20,100 (Since this total is above RM20,000, the Cash Back entitlement is RM100 x 2) RM200 Example 3 28/12/15– RM20,000.00 15/01/16– RM20,000.00 20/01/16– RM10,000 Total – RM 50,000 (This total is above RM50,000 and the Cash Back entitlement is calculated as RM100 x 5 = RM500) RM500 (maximum cash back amount) 10. There is a maximum of RM40,000 Cash Back which is pooled together with “HSBC Balance Conversion Plan Cash Back Campaign” to be given out throughout the Campaign Period, on a first come, first served basis. HSBC Bank is the sole provider for all the Cash Back in this promotion. 11. The Eligible Cardholder will receive the Cash Back credited into the Participating HSBC Amanah Credit Card-i from which the first BCP was taken up under this Campaign, or any other Participating HSBC Amanah Credit Card-i account of the Eligible Cardholders as determined by HSBC Amanah, within 3 months after the end of the Campaign. The final Cash Back amount will be shown in the following month’s credit card-i statement after the crediting has been performed. 12. At the time of crediting the primary Eligible Cardholder’s Participating HSBC Amanah Credit Cards-i with the Cash Back, all the Participating HSBC Amanah Credit Card-i by Eligible Cardholders MUST NOT be delinquent, and/or invalid or cancelled within HSBC Amanah’s definition, otherwise they will be disqualified from participating or receiving the Cash Back from this Campaign. 13. HSBC Amanah will not entertain any request from any Eligible Cardholders or any other person to credit the Cash Back to the Eligible Cardholder’s other or any third party’s HSBC Amanah Credit Card-i account. GENERAL TERMS & CONDITIONS 14. HSBC Amanah shall not be held liable for any mishaps, injuries or accidents that may occur in the usage of the Cash Back received in this Campaign. 15. HSBC Amanah reserves the right to substitute the Cash Back with any item of similar value at any time with 3 days prior notice. 16. HSBC Amanah reserves the right to publish or display the name, picture and city of residence of the Eligible Cardholders who have been selected/who received the Cash Back and for this Campaign for advertising and publicity purposes. By participating in this Campaign, the selected Eligible Cardholders hereby consent to and agree that HSBC Amanah shall be at liberty to publish their names, pictures and city of residence without compensation for advertising and publicity purposes. 17. HSBC Amanah reserves the right at its absolute discretion to vary, delete or add to any of these Terms & Conditions with 3 days prior notice. The amended Terms and Conditions shall prevail over any provisions or representations contained in any other promotional materials advertising this Campaign. 18. HSBC Amanah may use any of the following modes to communicate notices in relation to this Campaign to the Eligible Cardholder: i) Individual notice to the Eligible Cardholder (whether by written notice or via electronic means) sent to the Eligible Cardholder’s latest address/email address as maintained in the HSBC Amanah‘s records; ii) Press advertisements; iii) Notice in the Eligible Cardholder’s credit card-i statement(s); iv) Display at its business premises; or v) Notice on HSBC Amanah internet website(s); where such notices shall be deemed to be effective on and from the 4th day after its delivery/publication/display as per the manner described herein. Save and except notices sent via ordinary mail which will be deemed delivered on the 3rd day after posting, notices sent via other modes as described herein are deemed delivered immediately after posting/publication/display. 19. These Terms and Conditions are in addition to the Terms and Conditions of “HSBC Bank Balance Conversion Plan Programme”, “HSBC Amanah Balance Conversion Plan Programme” and the respective Universal Terms and Conditions (“UTCs”) for HSBC Bank/HSBC Amanah of which the respective Cardholder Agreements are a part of and which regulate the provision of credit card/-i facilities by HSBC Bank/HSBC Amanah. The Terms & Conditions of the HSBC Bank Balance Conversion Plan Programme, Terms & Conditions of the HSBC Amanah Balance Conversion Plan Programme and the UTCs are available at www.hsbc.com.my/ www.hsbcamanah.com.my. In the event of inconsistency between these Terms and Conditions and the UTCs, these Terms and Conditions shall prevail in so far as they apply to this Campaign. 20. HSBC Amanah shall not be liable for any default due to any act of God, war, riot, strike, terrorism, epidemic, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of HSBC Amanah. 21. HSBC Amanah reserves the right to cancel, terminate or suspend this Campaign with 3 days prior notice. For the avoidance of doubt, cancellation, termination or suspension by HSBC Amanah of this Campaign shall not entitle the Eligible Cardholder to any claim or compensation against HSBC Amanah for any and all losses or damages suffered or incurred by the Eligible Cardholder as a direct or indirect result of the act of cancellation, termination or suspension. 22. HSBC Amanah shall only be liable for any losses or damages suffered or incurred as a direct result of HSBC Amanah’s gross negligence and shall not be liable for any other loss or damage of any kind such as loss of income, profit, goodwill or indirect, incidental, exemplary, punitive, consequential or special loss or damage howsoever arising, whether or not HSBC Amanah have been advised of the possibility of such loss or damage. 23. The Eligible Cardholder shall be personally responsible for all taxes, rates, government fees or any other charges that may be levied against them under applicable laws, if any, in relation to this Campaign. 24. HSBC Amanah’s decision on all matters relating to this Campaign including but not limited to the eligibility to participate, the selection of the recipient of the Cash Back and for this Campaign, and in case of any dispute, shall be final and binding on all Eligible Cardholders who participate in this Campaign and no correspondence will be entertained. 25. By participating in this Campaign, the Eligible Cardholder agrees to be bound by these Terms and Conditions and the decisions of HSBC Amanah.
