F.TheApplicationofGeneralPrinciplesofLawbyInternational Tribunals 25Generalprinciplesareoftenappliedbyinternationaltribunalsirrespectiveofwhetherthereisa specificreferenceintheirconstituentinstrument.Certaindecisionsrefer,liketheICJ,toprinciples thatfindaparallelinmunicipalsystems. 26Thus,thearbitrationawardintheBoundaryDisputebetweenArgentinaandChileconcerning theFrontierLinebetweenBoundaryPost62andMountFitzroystatedthat Adecisionwiththeforceofresjudicataislegallybindingonthepartiestothedispute.This isafundamentalprincipleofthelawofnationsrepeatedlyinvokedinthelegalprecedents, withregard[to]theauthorityofresjudicataasauniversalandabsoluteprincipleof internationallaw.(atpara.68) Similarly,thearbitrationawardintheCaseconcerningtheLoanAgreementbetweenItalyand CostaRicareferredtothefundamentalcharacteroftheprincipleofgoodfaithininternationallaw andincludeditamongthegeneralprinciplesoflawrecognizedbycivilizednations(atpara.14). 27Whentherearedifferencesinthewayinwhichmunicipalsystemsaddressanissue,the AppealChamberoftheInternationalCriminalTribunalfortheFormerYugoslavia(ICTY)notedinthe TadićCasethat nationallegislationandcaselawcannotberelieduponasasourceofinternational principlesorrules,underthedoctrineofthegeneralprinciplesoflawrecognizedbythe nationsoftheworld:forthisreliancetobepermissible,itwouldbenecessarytoshowthat most,ifnotall,countriesadoptthesamenotion…Morespecifically,itwouldbenecessary toshowthat,inthatcase,themajorlegalsystemsoftheworldtakethesameapproachto thisnotion.(ProsecutorvTadić[OpinionandJudgment]para.225) ThiscautiousattitudecorrespondstothatoftheICJ,butismoreexplicitlydefined. 28Otherinternationaltribunalshavehadlesshesitationinapplyinggeneralprinciplesoflaweven inthepresenceofdiscrepanciesamongmunicipalsystems.Forinstance,inBPExploration Company(Libya)LimitedvGovernmentoftheLibyanArabRepublic,thearbitratorwasrequired tointerprettherelevantcontract inaccordancewiththeprinciplesofthelawofLibyacommontotheprinciplesof internationallawandintheabsenceofsuchcommonprinciplesthenbyandin From: Oxford Public International Law (http://opil.ouplaw.com).
