Alpine Access SRD Equipment Agreement OVERVIEW: Alpine Access (Company) has agreed to provide Equipment to assist employee (Employee) in accomplishing job responsibilities and carrying out job duties. The Equipment is the property of the Company. The Equipment Agreement outlines terms of agreement between Company and Employee. 1) Definition of Equipment – Equipment in this agreement is defined as: Secure Remote Desktop (SRD) USB flash drive. 2) Use of Equipment a) Equipment is to be used by Employee only. No other parties may use the Equipment. b) Employee may use the Equipment for Company and Company’s client business purposes only. c) Use of Equipment outside of scheduled work or training hours is strictly prohibited and monitored for security and fraud prevention purposes. d) Employee is responsible for his/her User IDs to access Equipment and System Applications. Do not disclose IDs with anyone. Employees will be held responsible for any activity associated with assigned User IDs. e) Employee will be prosecuted by Company or Client for any fraudulent activities associated with equipment, system applications or IDs assigned to an Employee. 3) Revocation of Equipment – Company may revoke use of Equipment at any time for any reason. 4) Return of Equipment – In the event the Company revokes use of the items, or at the end of Employee’s employment with the assigned program or Company, whichever occurs first, Employee agrees to immediately return the above listed Equipment to the Company or the Company’s designated location within two weeks. Equipment must be returned in the same boxes and packaging materials as delivered and in the same condition as it was received, except for normal wear and tear. The Company shall have final discretion to determine the condition of the items and the replacement value of any excessive wear and tear. 5) Requirements for Shipping Returned Equipment – Employee agrees to return Equipment utilizing a shipping service that will track the shipping status of the returned Equipment. Employee is required to insure the Equipment package for the value of the Equipment. Company will provide initial return labels covering all shipping and insurance charges for returning the Equipment. If however, the Employee does not ship the Equipment back within 5 business days of receipt of return labels or during the life span of the return labels, the Employee becomes responsible for all shipping and insurance charges for returning Equipment to Company. 6) Financial Responsibility of Unreturned Equipment – In the event that the Employee does not return all of the Equipment to Company within two weeks, the Employee agrees to be financially responsible for the replacement cost of the items not returned and for any excessive wear and tear on items that are returned. Employee agrees to be liable for all reasonable collection costs incurred, including, but not limited to reasonable attorney’s fees. Alpine Access, Inc. Proprietary and Confidential 7) Equipment Failure – In case of Equipment failure or any type of technical issue with the equipment, Employee agrees to notify Company Help Desk immediately. In the event of a SRD flash drive equipment failure, the Employee may be unable to work or train until Equipment is repaired or replaced by Company or authorized technician. 8) Technical Events - Company has two basic forms of Technical Events, Approved Technical Events (paid) and Tech Events (unpaid). a) Approved Technical Events may include but not limited to Alpine Access and Client Systems outages or Equipment Failure that impacts the Employee’s ability to work. i) Approved Technical Issues are determined on a case by case basis using payroll records and Help Desk records. ii) Employee is paid for all missed scheduled work or training hours during Approved Technical Events. (1) Employee must be available during all scheduled work or training hours in order to receive technical support by Company or authorized technician during an Approved Technical Event. Employee will not be paid for time when Company or authorized technician is unable to reach Employee during a Technical Event. b) Tech Events include but may not be limited to ISP Outages, Power Outages, Phone Line Issues, Storm Related Issues, Router/Modem Issues, Lost SRD Flash Drive, or issues with Personal PC. c) In some cases prolonged individual technical issues may be designated “pending” and unpaid until it can be determined whether the issue was caused by the Employee’s home network (Tech Event) or by the Company or Client (Approved Technical Event). d) Company will replace equipment up to two times in an effort to resolve a ‘Pending Technical’ issue. If Company is unable to resolve technical issue by replacing equipment, the Employee becomes responsible for resolving technical issue within home network and the issue will be determined an unpaid Tech Event. e) In the event the Company and the Employee are unable to resolve a technical issue after two replacements and the Employee continues to be unable to work after 3 weeks; the Employee’s case will be escalated and reviewed to determine home environment compatibility. If Company determines the Employee’s home environment is not compatible or stable, employment with Company may be terminated. f) Repeated or cyclical Tech Events resulting in Employee missing work or training time may be subject to Disciplinary Action up to and including termination. 9) Misuse of Equipment – If damage to SRD flash drive occurs through misuse by Employee, Employee will receive disciplinary action and may be responsible for all financial charges incurred to fix the software or hardware of the computer and return to previous working order 10) SRD Flash Drives - Employee agrees to store SRD Flash Drives in a secure location at all times. a) Employee will be held responsible for any breaches in security or fraudulent activity associated with SRD flash drive including lost flash drives. b) If an SRD Flash Drive is lost, Employee must notify Company immediately to disable SRD Flash Drive for security reasons. Alpine Access, Inc. Proprietary and Confidential c) Company is willing to provide up to one SRD flash drive replacement per year per Employee. Employee will be responsible for any additional replacement flash drives including overnight shipment which may cost up to $75. 11) VOIP – Employee understands that telephone services provided company’s using Voice Over Internet Protocol (VOIP) is strictly prohibited. Employee agrees that he/she will use traditional, analog phone services in which the phone used for work purposes plugs directly into the phone jack in the wall of the employee’s home or by an approved Cable or DSL service provider. If Employee has questions about what services are VOIP, he/she may contact the Company Help Desk or Telephone Service Provider. The Employee’s recruiter also has a list of approved Cable and DSL telephone providers. a) VOIP services provided by Alpine Access or client owned equipment and networks used in training and production are permissible. 12) Length of Agreement – This Agreement shall remain in effect during Employee’s employment with Company and may not be revoked unless mutually agreed in writing by the Company and Employee. 13) Consequences of Failing to Abide by Company Equipment Liability Agreement – If Employees fails to abide by any of the terms of this agreement, Employee may be subject to Disciplinary Action up to and Including Termination. Please note that nothing in this Agreement is to be construed as an express or implied contract of employment. Alpine Access has the right to change this policy with or without notice. This policy will be in effect until further notice.
