The Alliance and its officers and directors and the Program sponsors, volunteers, and chapter officers and members (collectively, the “Alliance”) wish to ensure to the fullest extent possible that they are not sued or held liable for injuries or damages sustained by participants or those participating in the Program. I make this release and agreement on my behalf of anyone else who would be able to sue if I were injured while participating in the Program. I agree and acknowledge as follows (1) Participation carries with it some risk of serious injury. The risks include but are not limited to those caused by over-exertion, vehicular traffic, the weather, facilities, equipment, the Alliance and other participants; (2) I assume all risk of participating in the Program; (3) I understand the Alliance is relying upon the agreements and representations I make on this form; (4) I release the Alliance from any and all claims, including negligence claims and claims relating to personal injury of property arising out of my participation in the Program except I do not release reckless or intentional tort claims; (5) I agree to indemnify the Alliance if I or anyone else brings a claim against the Alliance for injuries I receive due to my participating in the Program. (“Indemnify” means to reimburse the Alliance for any amounts they have to pay and expenses/fees they incur due to an injury claim relating to me); (6) I have read this document and understand it. If I am under age 18, my parent or guardian is signing on my behalf, and my parent or guardian also agrees to indemnify the Alliance if I, or anyone else, brings a claim against the Alliance due to injuries I receive due to my participating in the Program. The segment takes advantage of existing trails in Robert O. Cook Memorial Arboretum. (9b) The Devil’s Staircase Segment is a “Must See”! The IAT climbs up a steep stone staircase and travels on the side of a bluff, along a natural shelf. There are diverse wildflowers and plants, exposed rock cliffs, and beautiful views overlooking the Rock River. (9a) The Janesville Segment uses two paved recreational trails. The route follows an intermittent stream that was once a large glacier melt-water river. The route passes Palmer Park, Rotary Gardens, Lion’s Beach, and along the west bank of the Rock River to Riverside Park. (7, 8) The Milton Segment meanders along sidewalks, past the historic Milton House Museum. The old Milton College sits atop the terminal moraine of the last glacial period. The old depot area, Milton Junction, is now restaurants and specialty shops. (4) Janesville to Milton Segment of trail through the Wildlife Area’s mixed hardwoods, tall prairie grasses, wildflowers, and dry kettles. The area is home to sandhill cranes, deer, ducks, turkey, pheasants, and owls. (3) travels an abandoned railroad bed that has been converted for public use.
