CHAIR’S CALL TO ORDER/REPORT
Noting a quorum of the Board Dr. Henderson, Vice Chair called the meeting to order at 3:50 p.m.
EXECUTIVE COMMITTEE REPORT- Dr. Henderson stated the Executive Committee met over the
phone due to inclement weather. Most items discussed at the committee meeting were Policy related and
will be discussed in the Legislation and Policy Reports.
EXECUTIVE REPORT
The Executive Report was given by Carole Catalfo, Executive Director.
Legislation- The Policy Unit has a new Policy Analyst, Mark Woodard. The Board has made over 50
appearances in Annapolis. The Bills are moving through the legislative process. Carole Catalfo provided
update on the status of the Sunset, Licensure, Cosmetic Surgery, and Naturopathy bills. Carole reported
Kinesiotherapists, Naturopaths, and Certified Lay-Midwives will be presented to a work group/study with
objective criteria and then the Board will make recommendation.
POLICY- Robin Bailey reported that it seems likely that the Secretary will develop regulations for
cosmetic medical procedures and cosmetic surgical facilities. The Board would like to include medical
spas. Three amendments presented by the Board were discussed 1)Hospital/ambi-surg center privileges,
2)Advanced training, and 3) CMEs. Amendments 1 & 2 were opposed because these are already
requirements if the practitioner is plastic surgery board certified. MedChi opposed amendment 3 because
they are not in favor of a mandated CME requirement.

On a motion made by Dr. Rosenstein and seconded by Dr. O’Herlihy, the Board voted
unanimously to APPROVE the following lists of physicians for licensure and reinstatement.
On a motion made by Mr. Rosenstein and seconded by Ms. Baker, the Board voted unanimously to
APPROVE the following list of delegation agreements.

Protocols Specialized Tasks under the supervision of Yvette Rooks, M.D. The Board requested
additional information from Ellen Douglas-Smith, Manager, Allied Health, as to why Athletic Trainer

CLOSED SESSION: “Pursuant to Maryland State Government Annotated §10-501 et. seq., on a
motion made by Dr. Gupta, and seconded by Dr. Houston, the Board unanimously voted to close its
meeting on March 20, 2013 at 9:45 AM, in rooms 108/109 for the purpose of complying with the
Maryland Medical Practice Act that prevents public disclosures about particular proceedings or
matters. Pursuant to Md. Hth. Occ. Ann. 14-411 (a) and (b), the Board is prohibited from disclosing
any
information
contained
in
a
proceeding
record
or
file
of
the

SUMMARY OF CLOSED SESSION:
There were two exceptions hearings. There was one post deprivation hearing. There were nine cases
presented to the Board for charging. There was one case presented to Board for return to Board. There
were two cases for ratification of letter of surrender. There was one case presented for 14-404(b)
disposition. There was one case presented for consideration of ALJ’s proposed decision. There were
seven cases for ratification of consent order. There was one case presented for charging and summary
suspension and offer pre-charge letter of surrender. The February 27, 2013 Board meeting minutes were
approved.
