Description__________________________ I/We agree to a NONREFUNDABLE*donation* of $_____________** The further consideration (quid pro quo) which makes this contract enforceable is $1.00 for the adopted animal's collar/tag. 1. I acknowledge that I have been told that the dog I am adopting has come from a Puppymill or Animal shelter. I have been advised of the issues that accompany a dog from this background. This dog has come from poor health conditions. He/she may have spent long hours, days, weeks, months or even years with no human contact or exercise. He/she may have arrived to the rescue organization with severe behavioral and medical problems. To insure that the dog continues to recover, we reserve the right to request that specific care and treatment be offered this dog. _____ Initial 2. While we try to send every dog home in 100% perfect condition, it's just not possible. The dogs visit the vet, but they are constantly exposed to other rescue dogs; in their foster homes, at the vet, at adoption events. Several common conditions such as kennel cough and some types of worms are very contagious and take several days or weeks to detect. We send a dog home - we think he's healthy - you think he's healthy - the vet cleared him less than a week ago... Then four or five days later a problem may surface. We can't help it. Our contract requires you to take full and immediate financial responsibility for your new pet but we're honestly not out to "stick" anyone with sick dogs or vet bills. We want to keep our good reputation and we want to do everything we can to encourage rescue in general. If you think your pet is ill or has a problem that should have been taken care of before you adopted him let us know. We'll be happy to set up an appointment with our vets and take care of the problem. We are not able to reimburse for visits to vets other than our own. We provide detailed vet records with our dogs. If you don't see paperwork for a particular procedure assume it has not been done and if there is a problem, we are not aware of it. If you have a particular concern please ask. _____ Initial 3. To provide one of the following: a premium quality kibble, a home cooked or raw diet, or combination there of. Vegan/Vegetarian diets are not allowed, they do not meet the nutritional requirements of a dog. Fresh water, shelter and humane protection and treatment as a member of our family at all times. 4. To adopt this animal as a household pet and companion and to treat the animal in a kind and gentle manner. This animal will not be maintained outside and will be allowed to live and sleep inside the adopter's home and under no circumstances will be an "outside" pet. The dog cannot be tied/chained to a doghouse, building, stake or any other object. Except where temporarily secured outdoors in the owner's presence. The adopted animal may also be kept on an appropriate and safe harness and leash in the owner's presence. 5. Not to sell, trade, give away or abandon this animal. I will RETURN this animal to Stickney Toy Breed Rescue if at any time I can no longer provide him/her with a suitable home. Stickney Toy Breed Rescue may refund the adoption donation, at their option. 6. Not to euthanize this animal, except in cases of suffering, or incurable disease. 7. The adopted animal must have appropriate vaccines as required for good health and as required by state laws. The adopted animal must be maintained on heartworm preventative, and must have a physical exam at least once per year by a licensed veterinary doctor 8. The adopted animal must be licensed as required by the adopting party's state and/or local municipality. 9. The adopted animal must not be allowed to run loose except in a safe, enclosed, fenced area. All adopted animals must be under control at all times. 10. In the event the adopted animal is not altered prior to placement (e.g.-age and/or illness) all animals must not be allowed to breed. The adopted animal must be spayed or neutered as soon as medically possible. I/we further agree to refrain from unnecessary cosmetic surgery (e.g. ear cropping and tail docking). 11. I agree to telephone Stickney Toy Breed Rescue immediately if the adopted animal is lost or stolen. If the animal is lost, I will make every effort to recover him/her. If the animal is seized, I agree to pay all redemption fees and/or fines. 12. I agree that a representative of Stickney Toy Breed Rescue may inquire about the animal after placement. I agree to allow Stickney Toy Breed Rescue and its representatives to inspect the adopted animal at their request. The inspection shall occur at or near the residence of the adopting owner(s) and/or the residence of the animal. 13. I/We agree to assume all responsibility for the adopted animal and further agree that if for any reason, I find I am unable to keep it, or unable to give it proper care, I MUST RETURN THE ADOPTED ANIMAL TO THE CUSTODY OF STICKNEY TOY BREED RESCUE . It is further understood that any donation given by the undersigned is wholly voluntary and is in no sense to be regarded as a return for value received**. The return for value received lies only in the reimbursement of our costs for the adopted animal's collar/tag ($1.00). All donations are non-refundable.* 14. I agree that should cause exist, (e.g. neglect, abuse, or animal fighting) and should it be in the best interest of the animal, The STICKNEY TOY BREED RESCUE has the option to reclaim the adopted animal from me/us for the sum of $1.00. The terms of surrender of the adopted animal are: immediate, peaceful, voluntary, delivery of the animal to The STICKNEY TOY BREED RESCUE or its representatives. The adopting party agrees to release and otherwise hold harmless Stickney Toy Breed Rescue from any and all claims against it arising from the reclaiming of the animal. 15. Should the animal require treatment after having been reclaimed by, returned by, or surrendered to Stickney Toy Breed Rescue , I/We agree to pay all veterinary bills incurred by Stickney Toy Breed Rescue resulting from the cause for which the animal was removed (e.g. bills due to neglect, lack of medical care, disease, abuse or animal fighting). 16. I agree that Stickney Toy Breed Rescue and Retirement cannot be held liable for any medical or behavioral problems of the adopted animal. 17. If the adopted animal is neglected, abused, used for fighting or if for cause is reclaimed by Stickney Toy Breed Rescue , I AGREE TO PAY ANY ATTORNEY'S FEES AND COURT COSTS DUE BECAUSE OF MY/OUR FAILURE TO RELINQUSIH THE ANIMAL. These fees and costs need not be paid until after the court determination of the breach of the provisions of this contract by the adopting party and until after a court determination that Stickney Toy Breed Rescue had cause for reclaiming the adopted animal. In the event of a court determination of a breech of contract by the adopting party(s), THE ADOPTING PARTY(S) AGREES TO PAY A $500.00 FINE to Stickney Toy Breed Rescue. 18. I HAVE READ AND UNDERSTAND THIS ENTIRE ADOPTION AGREEMENT AND AGREE TO ABIDE BY ALL THE RULES AND REGULATIONS SET FORTH HEREIN. I ALSO UNDERSTAND THAT STICKNEY TOY BREED RESCUE, CONSISTENT WITH WHAT IS OUTLINED ABOVE, RESERVES THE RIGHT TO RELCLAIM THE ADOPTED ANIMAL IF THE PROVISIONS ABOVE ARE NOT COMPLIED WITH. 19.
