Register of Public Roads
1. Introduction
This document, Register of Public Roads (the Register), is made in accordance with Section
19(1) of the Road Management Act 2004 (the Act).
The Register forms part of the Road Management Plan (the RMP) which is made in
accordance with Division 5 of the Act.
The Register provides the following information for roads located in the municipality:

Public roads in respect of which City of Whittlesea (the Council) is the Coordinating
Road Authority.

Arterial roads in respect of which VicRoads is the Coordinating Road Authority.

Road management arrangements made with neighbouring municipal Councils and
any designated road project.

Road management clarification – public roads, non-public roads and structures in
respect of which the Council seeks to clarify the road management responsibility.

Melbourne Water Corporation structures (e.g. bridge or culvert over aqueduct) which
form part of public roads, in respect of which the Council and Melbourne Water
Corporation have separate road management responsibilities.

Ancillary areas to a public road in respect of which the Council is the Coordinating
Road Authority.

Discontinuance of Roads

Pathway (footpath, bicycle path and shared path) which have been classified with
Pathway Hierarchy 1 and 2.

Private roads in respect of which a body such as a body corporate, university,
company and the like, is responsible to ensure the private road is safe for its users.
If a road does not appear on the Register it is deemed that the City of Whittlesea is not
responsible for that road including its road-related infrastructure
The data of the Register is current as at 31 December 2015, and it will be updated every six
months approximately.

2. Public Roads
A list of public roads in respect of which City of Whittlesea is the Coordinating Road Authority
is outlined in Attachment 1.
The list is from data extracted from Moloney Pavement Management System, which is
Council’s asset information system for road infrastructure. Roads are broken down into road
segments to help the management of operation, construction, inspection, maintenance,
repair, renewal, condition assessment and valuation of road infrastructure.
The data contained in Attachment 1 should be read in conjunction with the following Table 2
– Road Hierarchy.

In addition to the roadway of a public road, the City of Whittlesea is also responsible for road
infrastructure and road-related infrastructure forming part of a public road. For example,
bridge, culvert, traffic control device, roundabout, traffic island, drainage, road signs, street
signs, roadside vegetation, pathway and ancillary area of a public road.

3. Arterial Roads
A list of arterial roads in respect of which VicRoads is the Coordinating Road Authority is
summarised in Table 3 below. The list is from data from VicRoads’ Register of Public
Roads. Please refer to VicRoads’ Register of Public Roads for the latest update.
With respect to the roadside of arterial roads, the City of Whittlesea is the Responsible Road
Authority to the physical limits set out in the Code of Practice for Operational Responsibility
for Public Roads published by the Minister.
With respect to the roadway of arterial roads, currently City of Whittlesea is a maintenance
service provider to VicRoads.

4. Road Management Arrangements
4.1 Arrangements with other Authorities
The City of Whittlesea has made arrangements for the transfer of road management
functions in respect of the public roads listed in Table 4. The arrangements were made in
accordance with Section 15 of the Act.

project’ by the Minister under the provision of Section 16 of the Act.

provision of Section 22 of the Act.

5. Clarification of Road Management Functions
5.1 Public Roads, Non-Public Roads and Fire Access
An ‘not used’ government road is defined as land (also referred as ‘not used Crown road
reserve’) that has been officially set aside for public traffic, now or in the future, but never
constructed or used.
Note: 'Unused road' means a road declared as unused in accordance with Section 400 of
Land Act 1958. When a road is 'not used' as a road but has not been declared as unused
under Section 400 of Land Act 1958, it is described as 'not used'.
In relation to ‘not used’ government road, it is only upon a roadway has been built in such
road reserve, and that roadway is considered by Council to be reasonably required for public
use, then the Council would maintain the road as a public road. City of Whittlesea is
responsible for the land management of an ‘not used’ government road except when it has
been licensed for agricultural use or other approved uses. For example, Avelin Road
Donnybrook, and Wells Road Thomastown.
In relation to the licensing of ‘not used’ government road for agricultural use or other
approved uses, please refer to Department of Sustainability and Environment (DSE) for the
details, terms and conditions of the lease.
In relation to road infrastructure assets managed or controlled by Responsible Authority such
as Melbourne Water, DSE, Parks Victoria, VicRoads, AusNet Services (formerly SP Ausnet),
please refer to the relevant Authority for further details.
Unless otherwise arranged, all made or unmade roads and tracks including structures:–

located within the State Forest would be the responsibility of Department of Sustainability
& Environment (DSE) and/or Parks Victoria.

located within the Yan Yean Catchment and Toorourrong Catchment would be the
responsibility of Melbourne Water Corporation.

located within the private land and vacant private land would be the responsibility of the
owner/occupier of that private land.

located within the public land would be the responsibility of the owner/occupier of that
public land.

Fire Access Tracks would be the responsibility of the Responsible Authority listed in
Table 5.1. Upon request to the City of Whittlesea, the Council may help provide basic
grading maintenance to Fire Access Track, for the respective Responsible Authority.
The following Table 5.1 is a summary list of public roads, non-public roads and Fire Access
Tracks, in respect of which the Council seeks to clarify the road management functions and
responsibilities. Where the Responsible Authority is not just City of Whittlesea, please also
refer to Table 4, Road Management Arrangements, for more details.

5.2 Structures of Melbourne Water Corporation
A list of structures (bridges or culverts over the aqueduct) forming part of public roads in
respect of which both the Council and Melbourne Water Corporation (MWC) have road
management functions, is outlined in Table 5.2 below.
For the public roads listed in Table 5.2, the management responsibilities are –
In relation to the road assets which are constructed over and above a MWC structure (e.g.
bridge or culvert over an aqueduct); City of Whittlesea has the management responsibility for
those road assets. This includes the construction, inspection, maintenance and repairs of
road pavement, road seal, lane markers, line marking, road signs, and approach guard
railing.
In relation to the MWC structure (e.g. bridge or culvert over an aqueduct); Melbourne Water
has the management responsibility for that structure. This includes the construction,
inspection, maintenance and repairs of the foundation, substructure, piers, embankments,
bridge bearings, superstructure, decking, expansion joints, posts and railings on the
structure.
