TENDER NOTICE
Milkfed having two Cattle Feed Plants i.e. Cattle Feed Plant, Khanna
(Cap.200 MT per day) and Cattle Feed Plant,Ghania-ke-Banger (Cap.
100 MT per day) invites sealed tenders from the suppliers interested for
the supply of Cattle Feed Ingredients. The Terms & Conditions and
guidelines for registration and or for participation in the tenders can be
obtained either
from the office of the undersigned or can be
seen/downloaded from the website of Milkfed www.verka.coop
The Tenders for the supply of Cattle Feed Ingredients will be opened on the
following dates at Milkfed H.O, S.C.O No.153-55, Sector-34/A,
Chandigarh.
September 2010 - 17th
October, 2010
- 1st, 15th & 29th
November, 2010 - 12th & 26th
The Tenders will be accepted upto 12.30 PM and opened at 12.40 PM in the
presence of representatives of Tenderers.
The Federation reserves the right to accept or reject any or all tenders
without assigning any reason what-so-ever.
The un registered parties can also participate in the tenders by depositing
Rs.50,000/- Earnest Money Deposit (EMD) for each Ingredients and
Rs.1,00,000/- for all Ingredients. The tenders without EMD are liable to be
rejected. The interested parties should quote their rates, as per the
specifications and terms & conditions of the Milkfed mentioned in NIT.

TERMS & CONDITIONS FOR REGISTRATION AS SUPPLIERS & FOR THE
PARTIES WILLING TO PARTICIPATE IN THE TENDER WITHOUT
GETTING THEMSELVES REGISTERED.
1. The Federation reserves the right to accept or reject any or all offers without
assigning any reason what-so-ever.
2. a)Offers by courier/by hand /by post on letter head pad of the firm shall be
received upto 12.30 Noon on fortnightly basis on the dates published in the
newspapers quarterly from time to time at Milkfed Head Office S.C.O
No.153-55, Sector-34/A, Chandigarh as decided by the Federation from time
to time of every month and shall be opened on the same very day at 12.40 PM
in the presence of the parties/representatives who may like to be present at
the time of opening of tenders.
b)Telephonic/E-mail/Fax tenders and tenders sent through any other
electronic media shall not be accepted.
c)Conditional tenders and the tenders received after prescribed time & date
shall not be accepted.
3. Offers should be sent in sealed cover. The offer for (item)_________________
due on (Date)_________________should be distinctively marked on the top of
envelope.
4. The offers shall be received and opened on the next working day in the
manner prescribed in conditions No.2., in case the day fixed for opening the
offers falls on gazetted holiday/Bandh has been declared for the day on
which the offers is to be opened.
5. For registration of the parties, the security amount/earnest money in case of
individual item will be Rs.20,000/- and for all items will be Rs.50,000/- for
registration/participation
as
suppliers.
For
the
purpose
of
registration/participation for molasses, the security amount/earnest money
will be Rs.30,000/-. For unregistered parties the earnest money in case of
individual item will be Rs.50,000/- and for all items, it will be Rs.1.00 lac.
6. Only the offers received from the approved registered /unregistered
suppliers, who has deposited required money/amount of earnest money and
accepted in writing these general terms and conditions will be considered as
valid. Earnest money deposited by the registered /unregistered suppliers
shall be treated as security deposit for all business transactions.
7. The term/tenure of the registered suppliers will be for a period of three years
& after three years, all registered suppliers will have to get their registration
renewed with the respective Cattle Feed Plants. During the period of three
years, the firm will not be allowed to withdraw its security deposit. The
Earnest money for unregistered suppliers shall be refunded after completion
of supplies of the successful tenders within one week after the allotment of
the orders to successful parties. The unregistered suppliers shall have to
deposit Earnest Money in the form of Demand Draft in favour of the
Punjab State Cooperative Milk Producer’s Federation Ltd., payable at
Chandigarh. The interested parties can revolve the same Earnest Money
deposit for subsequent tenders too after successful completion
of first
tender.
-28. No interest shall be paid on registration fee/security//earnest money.
9. Offers shall be signed by the persons, who are competent and lawfully
authorized to do so. Tenders should not be illegible, indecipherable and overwritten. Any correction should be duly authenticated/under the signatures of
the authorized person.
10. Offer must be kept open for acceptance for a period of one week from the
date of opening tenders. Normally orders will be confirmed telegraphically
or otherwise shortly after opening. But, offers open for acceptance for less
than one week will not be accepted.
11. Supplier is free to quote rates for all/any items. The Federation reserves the
right to place order for any item on one or more suppliers.
12. The Milkfederation reserves the right to place order for any quantity at one
time per item. Suppliers will, however, be at liberty to offer any quantity and
his responsibility will be limited to the stocks offered by him .
13. Rates should be mentioned both in figures and words & same should be
quoted F.O.D. (Free on destination) Cattle Feed Plant, G.T.Road,
Khanna/Ghania-Ke-Banger. Rates quoted other than F.O.D. basis will not be
considered.
14. Suppliers should quote rates packed in 2nd hand gunny bags bear good
conditions to avoid loss due to spillage of material. In case we received supply
in damaged/torn bags, proportionate deduction shall be made. The rate shall
be gross weight (Including weight of 2nd hand gunny bags.). The
“Federation/Cattle Feed Plant” shall provide gunny bags, in case the offer is
accepted for supplies of commodity in loose form. Packing, filling,
forwarding and all other charges shall be borne by the suppliers.
15. The supplier should be registered for the purpose of sales tax in case he is
dealing with the items covered under S.Tax.
16. Excise duty, advoloram, sales tax and any other Central/State levies as
applicable, if any, should be specifically mentioned in the offer. In case these
taxes are not mentioned separately, it shall be presumed that the rates are
including of all such duties/taxes and levies etc.
17. An individual/firm operating in the same premises can be registered only as
one supplier. Registration under different names with same
ownership/common business premises will not be allowed.
18. The General Managers, Cattle Feed Plant, Khanna & Ghania-Ke-Banger
shall draw three samples from each consignment received from the supplier.
The supplier or his representative may if he so likes to be present at the time
of sampling. One sample shall be delivered to the supplier or his
representative, if he is present at that time. Second sample shall be utilized
for testing in the Laboratory of Cattle Feed Plants. The third sample shall be
duly sealed and kept in the custody of the General Managers of Cattle Feed
Plants. The supplier may get his sample tested in our laboratory within seven
days of the quality/analysis report in case of any deviation/difference or
dispute in the quality report in that case the analysis report of the re-tested
sample will be treated as final report.
-319. The management reserves the right to reject wholly or partly the material
not confirming to the specifications. The rejected material shall be held at the
risk, cost and responsibility of the tenderers for a maximum period of one
month. In case tenderer fails to lift the rejected material within the stipulated
period, the “Federation/Cattle Feed Plant” reserve the right to dispose-off
the same by auction and no claim in respect of material shall be entertained.
20. The supplies shall be executed as per delivery schedule furnished by the
General Manager, cattle Feed Plant, Bhattian(Khanna)/Ghania-Ke-Banger
(Batala).Delivery schedule may vary from one week to two weeks as per the
manufacturing requirement in proportion to the quantities ordered as
mentioned in item at Sr.No.10.
a) Management may de-register a firm, in case it becomes habitually
defaulter and in case of failure of firm to deposit balance dues within
30 days.
21. Time is the essence of the contract, the “Federation/Cattle Feed Plant”
reserve the right to purchase the material at the risk,cost and responsibility
of the supplier, in case of non supplies/short supplies and supplies not
confirming to the orders. All expenses including excess payment in risk
purchase shall be adjusted against the security deposit/pending payment. In
case the expenses exceeds the amounts security deposit, the supplier will have
to deposit the balance amount within 30 days of risk purchase, otherwise the
“Federation/Cattle Feed Plant” will recover the amount through other
manner.
22. The payment for the supplies will normally be made within fifteen days of
the receipt and inspection of material, but even in case of unforeseen delays,
it will be cleared within 30 days.
23. Penalty clause as mentioned in condition No.21 may not be invoked by the
“Federation/Cattle Feed Plant” in the event of force- mejure circumstances.
24. The aforementioned terms and conditions shall be binding and operative
between supplier and “Federation/Cattle Feed Plant”. Any condition
stipulated/mentioned in the offer by the supplier shall be deemed to have
amended/modified in consonance with above terms and conditions.The terms
and conditions offered by suppliers shall not be operative and binding on the
“Federation/Cattle Feed Plant”.
25. Acceptance of the offer by the Managing Director, the Punjab State Coop.
Milk Producers Federation Limited, Chandigarh or by the General
Managers Cattle Feed Plant, Bhattian (Khanna)/Ghania-Ke-Banger or by an
officer authorized by them dispatched within the prescribed time shall
continue to be valid and legal contract between the supplier and the Punjab
State Coop. Milk Producers Federation Limited, Chandigarh. The execution
of separate deed would not be necessary.
-426. The supplies shall be executed as per delivery schedule given by General
Manager, Cattle Feed Plant, Bhattian (Khanna)/Ghania-Ke-Banger. If the
material is not supplied within the delivery period, the“Federation/Cattle
Feed Plant”reserve the right to either effect risk purchase or cancel the
pending order or to impose penalty @ 1% per day subject to maximum 5%
per week on the cost of the material on delay/non supplies with maximum
limit of 20%.
27. In case the parties/suppliers fail to complete the supplies within the given
period, extension will normally be granted with late supplies cut except in
extreme circumstance. Further, in case the parties/suppliers fails to execute
the order with in the extended period, the “Federation/Cattle Feed Plant”
reserve the right to purchase the material at the risk, cost and responsibility
of the parties and the difference of amount in rate as well as the late supplies
cut will be recovered from defaulter parties.
28. The ordered quantity will be accepted with variation of 2% excess or less
subject to maximum 5MTs Variation.
29. “Managing Director, Milkfed, may cancel/terminate the Registration at any
time in case of breach of contractual obligations and /or malafide/undesirable
activity on the part of the supplier, with 15 days prior registered notice”
30. The suppliers should submit their one time firm rates. The rates will not be
accepted, if linked with delivery period and shall be considered conditional
tender.
31. If any dispute or any controversy arises out of this contract, the same shall be
referred to the sole arbitration of the Registrar Co-operative Societies,
Punjab, Chandigarh and the decision of the Registrar Coop. Societies,
Punjab, Chandigarh or his nominee shall be final and binding on both the
parties. The above provision of the Indian arbitration Act 1940 and as
amended from time to time shall apply to Arbitration proceedings.
Arbitration proceedings will be held at Chandigarh Management reserves
the right to amend/modify the standards of cattle Feed Ingredients and terms
and conditions from time to time which shall be binding to all the suppliers.
32. Specification and deduction clauses of Cattle Feed Ingredients applicable to
the suppliers may be carefully studied. They are required to return one copy
of specification duly signed in token of their acceptance and give an
undertaking to make all supplies accordingly. It will be an implied condition
that the material offer is according to specifications.
33. Nominal Membership :Registered/Unregistered Suppliers shall have to
become nominal member of Milkfed as per Milkfed Bye-laws No.5.2 with
latest amendment dt.25.5.2001 after deposit of Membership Fee of Rs.1000/only once for all (non-refundable)
34. Normally orders will be finalised at the lowest quoted rates, however, in
exceptional cases where the lowest rates are not found reasonable, Milkfed
may negotiate the rates/terms.
