CHAPTER VI. FIRE PROTECTION

DEPARTMENT ESTABLISHED. There is hereby created in this city a
volunteer fire department composed of a chief, an assistant chief, and no fewer than
five (5) nor more than twenty (20) firemen. (Code 1988)

FIRECHIEF. The mayor by and with the consent of the council shall appoint the
chief of the volunteer fire department. (Code 1988)

SAME; DUTIES.
(a)
The chief of the fire department shall, under the direction of the mayor,
have and he or she shall be responsible for the proper organization,
training, discipline, and functioning of the personnel of the fire
department and for the proper care, use, and safety of the equipment and
fire apparatus. (Code 1988)
(b)
The chief shall give notice of the time and place for fire drills, the fire
department which shall be at his or her pleasure to call. (Code 1988).
(c)
It shall be the duty of the chief to keep an accurate record of fire alarms,
practice drills, and attendance at the same, and to make all reports
required by law of the chief for the fire department. (Code 1988)
ASSISTANT FIRE CHIEF.
(a)
The chief of the fire department shall appoint the assistant chief and
firemen of the department. (Code 1988)
(b)
In the absence of the chief, the assistant chief shall have all of the powers
and perform all of the duties of the fire chief. (Code 1988).

DISCHARGE. Any subordinate officer or fireman who refuses or neglects to
attend any fire or practice drill, without submitting an excuse which is satisfactory to the
chief, or who shall neglect or refuse to do his or her duty or to obey the orders of his or
her chief or his or her proper commanding officer or who shall leave his or her post of
duty while at a fire, without the permission of the fire chief, shall be subject to expulsion
from the fire department. (Code 1988)

COMPENSATION. The chief of the fire department shall be paid a salary of
$30.00 for attending each fire call and each fireman shall receive $25.00 for attending

ACTIVITY FUND DEPOSITS. The city shall make monthly payments of
$30.00 for chief of the fire department and $25.00 per fireman in attendance at the
monthly fire department meeting/training session to the fire department activity fund. (Ord

FIREWORKS; PERMIT REQUIRED. It shall be unlawful for any person,
persons, firm or corporation to sell, offer for sale, or give away any fireworks of the
various kinds or explosive missiles commonly called “firecrackers” without first
having paid to the city clerk the sum of $25 and secured a license therefore. (Code
1988).

PENALTIES. Any person, firm or corporation violating the provisions of
section 6-201 will be fined the sum of at least $25 but not more than $500. The fire
department chief or any city marshal may take into his possession any fireworks
exposed for sale in violation of the provisions set forth herein. (Code 1988).

DISCHARGE WITHIN CITY LIMITS. It shall be unlawful to discharge any
firecrackers, bottle rockets or any explosive of the nature known as fireworks within
the city limits of the City of La Cygne, Kansas at any time, except as provided at
Section 6-204.

EXEMPT DAYS. It shall be lawful to discharge firecrackers and other
fireworks, excluding bottle rockets, in the City of La Cygne on the Twenty-seventh
day of June through fifth day of July between the hours of 6:00
a.m. and 12:00 a.m. (midnight), except that, it shall be unlawful to ignite, fire, setoff or otherwise discharge firecrackers or other fireworks under any parked
motorcycle or motor vehicle or in the path of moving bicycles, motorcycles or motor
vehicles.

PROHIBITION DUE TO EXTREME FIRE DANGER.
(a) During periods of extreme fire danger the Mayor may, by proclamation or order,
prohibit the igniting, firing, setting-off, or otherwise discharging of all fireworks
during Exempt Days as described in section 6-204. This decision will be based on
consultation with representatives of the City Fire Department. (Ord 1407 June 2012)

NOTIFICATION OF PROHIBITION DUE TO EXTREME FIRE DANGER.
(a) Before igniting, firing, setting-off, or otherwise discharging any fireworks, it will
be the responsibility of every citizen to check with City Hall to determine whether
any proclamation or order prohibiting or banning the discharge of fireworks is in
place. (Ord 1407 June 2012)

PENALTIES. Any person violating the provisions of Sections 6-203, 6-204, 6204.1, or 6-204.2 will be fined the sum of at least $25.00 but not more than $500.00.
The fire department chief or any city marshal may take into his possession any
fireworks discharged in violation of the provisions set forth herein. (Ord 1172 June
