Special Meeting
April 22, 2008
Chairman Rick Monroe called the meeting to order at 6:00 p.m. The three trustees, Brian
Richter (Medina Co. Prosecutor’s Office), Sharon Adams, Fred Boreman (Medina Co.
Engineer’s Office) Mr. & Mrs. John Davies and Bev Fry were present.
Rick explained to Sharon Adams and Mr. & Mrs. John Davies that the township want to put
a fence up around the Branch Road Cemetery. Rick then turned it over to Fred Boreman to
explain the results of the survey.
Fred handed packets to the Adams and Davies. It began with a copy from the 1910 Tax
Maps showing the distance of 211.2’ from centerline of Branch Road with cemetery
dimensions of 153.12’ north/south x 181.5’ east/west.
The next copy shows the Meers Estate Subdivision Phase I plat showing the cemetery as
Block A with a distance from the centerline of 212.46’ and the cemetery dimensions of
164.34’ north/south x 198.8’ east/west. It appears they were platting at least the amount of
the original cemetery. There is also a copy from Tax Maps after the Subdivision recorded.
There is also a present day copy from Tax Maps showing the dimensions the same as the
subdivision record. There is a gap between the boundary lines of the cemetery and what
the township’s deed says. Each of the residents received a copy of their lot as listed in Tax
Maps. The package was completed with aerial photographs of the cemetery and the lots in
question.
Fred then went on to explain the issues with the boundaries and overlapping portions.
There are a couple of graves that are in the overlapping portion. In order for the township
to have access, the Meers Subdivision people gave the township a 25’ easement to access
the cemetery which is on the Davies’ property. The easement comes to the corner of Block
A. When comparing the trustees’ deed with Block A, the trustees don’t have a full 25’
easement.
Mr. Davies commented that he doesn’t mind taking down bad trees but doesn’t want to
take down good trees. There was discussion about moving the fence north a little to avoid
taking down any trees or putting the fence closer to the headstones.
There was discussion regarding the easement. Could it be moved closer to the center?
There are graves located there so it would prohibit a tractor getting in to mow. The Davies
explained they didn’t have any problem with someone parking at the road and walking
back. We do have to have access. The easement grants the township access. There was
discussion regarding moving the easement so the Davies’ turn around doesn’t encroach
the easement. The trustees were asked about the type of fence and it would be woven wire
fence. If the northern line is moved toward the road 5’, it would allow for a fence to not take
down any trees or move any headstones and still allow the township space for
maintenance. The other three sides would just have the new fence replace the old fence. It
has space that is no man’s land. It will be investigated as to finding a successor from the
original developer, Western Reserve Limited that would agree to sign over the no man’s
space to the residents. For the Davies, it would move the corner of the cemetery out of
their pond.

Both the Davies and the Adams agreed to the changes of the boundary lines so Fred can
re-plat and clean up the boundaries. Fred will put stakes out so everyone can see the end
result. Mr. Davies asked if the township could put in some dirt on the easement to make it
level. There were some other ruts that needed repaired that the trustees will look into.
Brian Richter left at 7:09 p.m.
Roger Morlock and Gilbert Wolf came in and asked questions regarding meeting agendas.
They then wanted to know when the township would be discussing the riparian setback.
The trustees weren’t planning on discussing it on Thursday, April 24th. They were at a
meeting two weeks ago that left them with the impression that all townships would be
approving a riparian setback. Colene stated that the trustees have not seen any proposals
yet. Soil and Water was going to investigate. The trustees felt that the County Township
Association would discuss it together before adopting anything. Roger Morlock commented
that he’d like to be present if we discussed it in the future as would Gilbert Wolf. Rick
commented that the meeting just ended, they never gave what a next step would be.
Moved by Conley, second by Pavlick to adjourn the meeting at 7:18 p.m. Roll: Conley, yes;
