STATE OF LOUISIANA PARISH OF WASHINGTON WASHINGTON PARISH COUNCIL ORDINANCE No. 13-577 Introduced on September 23, 2013 Introduced by Greg Route______ Public hearing held on October 21, 2013 AN ORDINANCE ESTABLISHING NO TRUCK ROUTES AND NO THRU TRUCK ROUTES WHEREAS, certain Parish roads are not suitable for use by heavy trucks without causing damage to the roads; and WHEREAS, there exists heavy trucks that are known to be using Parish roads for purposes of short-cuts and/or avoiding state highways and not for the necessity of the ordinary course of business; and WHEREAS, such use contributes to damage and unnecessary wear on Parish roads. BE IT ORDAINED, as follows: 1. DEFINITIONS: a. “NO TRUCK ROUTE” means no truck shall operate on the designated Parish road, subject to the weight limits and exceptions contained herein. b. “NO THRU TRUCK” or “NO THRU TRUCK ROUTE” means no truck shall use the designated Parish road as a short-cut, cut through or alternate route wherein a state highway could be used based upon the sole discretion of the Parish Government. c. “Truck” includes, but is not limited to, a tractor/trailer. 2. It shall be unlawful for any person to operate a truck of a weight of more than five (5) tons on any Parish road where a sign has been erected, “NO TRUCK ROUTE”, “NO THRU TRUCK ROUTE” or “NO THRU TRUCK” by the Parish Government giving notice thereof. 3. Excluded from this ordinance is any person operating a truck of a weight of more than five (5) tons making deliveries or pickups of merchandise, products, goods or equipment in an area where it would be necessary for the truck to use the Parish road in the ordinary course of business. 4. “NO TRUCK ROUTES” and “NO THRU TRUCK ROUTES” will be established by a majority vote of the Washington Parish Council. 5. Violations of this ordinance shall be a misdemeanor and will result in a fine of $100.00, first offense; $200.00, second offense; and $500.00, third offense and each offense thereafter. 1 6. “NO TRUCK ROUTES” and “NO THRU TRUCK ROUTES” will be established or removed by ordinance of the Washington Parish Council. BE IT FURTHER ORDAINED, that this ordinance shall become effective immediately upon the signature of the Parish President and all previous ordinances in conflict with said ordinance are hereby repealed.
