CHEMICAL USE AND RACIAL/RELIGIOUS/SEXUAL HARASSMENT/VIOLENCE PENALTIES
FOR STUDENTS IN ARTS AND ACTIVITIES

Definition of Mood Altering Chemical Use Violations
Rules apply to the entire school year and the summer months.
Use or possession of a beverage containing alcohol.
Use or possession of tobacco.
Use or consume, have in possession, buy, sell, or give away any other controlled substance.
Group A – Category I Minnesota State High School League (MSHSL). Included in this category are Policy
Debate, Lincoln Douglas Debate, and Speech. Penalties: See the 2008-09 Fine Arts Eligibility Brochure.
Group B – Performance Groups including Category II MSHSL Activities. Included in this category are all
plays (musical, fall, winter, or spring), Broadway, non-classroom Danceworks, music ensembles, Jazz Singers,
Varsity Edition, Jazz Band I and II, Percussion, Chamber Singers, large group and solo and ensemble music
contest, pit orchestra, and tech theatre.
Penalties:
1. First Violation: After confirmation of the first violation, the student shall lose eligibility for two (2)
consecutive contests/events/performances or two (2) weeks of a season in which the student is a
participant, whichever is less.
2. Second Violation: After confirmation of the second violation, the student shall lose eligibility for the
next six (6) weeks of a season in which the student is a participant.
3. Third and Subsequent Violations: After confirmation of the third or subsequent violations, the
student shall lose eligibility for the next twelve (12) weeks of a season in which the student is a
participant.
4. Accumulative Penalties: Penalties shall be accumulative beginning with and throughout the student’s
participation grades 9-12.
5. Racial/Religious/Sexual Harassment/Violence: For definition, see AVHS Handbook. Penalties are
the same as listed for chemical use.
Group C – Clubs and Limited Event Activities. Included in this category are Chess, Academic Quiz Bowl,
Knowledge Bowl, Math League, Science Olympiad, Mock Trial, Yearbook, non-classroom newspaper, AVRM,
Ambassador’s Club, DECA, Diversity, Rocket Team, etc.
Penalties:
1. First Violation: After confirmation of the first violation, the student shall lose eligibility for the next
two (2) weeks of a season in which the student is a participant.
2. Second Violation: After confirmation of the second violation, the student shall lose eligibility for the
next six (6) weeks of a season in which the student is a participant.
3. Third and Subsequent Violations: After confirmation of the third or subsequent violations, the
student shall lose eligibility for the next twelve (12) week of a season in which the student is a
participant.
4. Accumulative Penalties: Penalties shall be accumulative beginning with and throughout the student’s
participation in grades 9-12.

Group D – Service/Honor Organizations. Included in this category is NAHS, NHS, Student Council and class
officers.
Penalties:
1. First Violation: After confirmation of a first violation, the student shall lose eligibility for the next
thirty (30) days.
2. Second Violation: after confirmation of a second violation, the student will be removed from
membership in the service/honor organization(s).
3. Accumulative Penalties: Penalties shall be accumulative beginning with and throughout the student’s
participation in grades 9-12.
4. Racial/Religious/Sexual Harassment/Violence: For definition, see AVHS Handbook. Penalties are
the same as listed for chemical use.
Group E – Activities with Curricular Component. Included in this category are choir (s), band (s), newspaper,
yearbook and dance. Regular school day penalties will apply. If a student is suspended from school, they will
be concurrently suspended from an event or practice.
General Rules:
1. A student is suspended from practices, rehearsals, meetings and events, contests, competitions and
performances.
2. A student is suspended from all activities he/she is participating in at the time of the infraction.
3. If a student is not in an activity at the time of the infraction, the suspension will be served when
participation begins in his/her next activity.
4. Penalties must always be served for MSHSL Category I Activities (Speech and Debate) and MSHSL
athletics even if it means the student serves two suspensions (one at the time of infraction for Arts/Activities
and again when beginning a MSHSL Category I activity or athletics.)
5. A student who serves a MSHSL Category I or athletic suspension will not have to repeat the suspension
when they enroll in an arts/activity.
6. A student or parent may contest a loss of eligibility under these rules to a Due Process Review Committee
established by the principal. This will be modeled after the MSHSL procedure.
STUDENT CODE OF RESPONSIBILITIES/CONDUCT
As a student participating in my school’s interscholastic activities, I understand and accept the following
responsibilities:
 I will respect the rights and beliefs of others and will treat others with courtesy and consideration.
 I will be fully responsible for my own actions and the consequences of my actions;
 I will respect the property of others.
 I will respect and obey the rules of my school and the laws of my community, state and country.
 I will show respect to those who are responsible for enforcing the rules of my school and the laws of my
community, state and country.
A student whose character or conduct violates the Student Code of Responsibilities/Conduct is not in
good standing and is ineligible for a period of time as determined by the principal. This applies to all
activities of Apple Valley High School.
Penalties for Chemical Use and Racial/Religious/Sexual Harassment/Violence
I.
Penalties for MSHSL Activities – Applies to all Athletics (plus Speech and Debate)
A. First time offenders: 2 weeks or 2 contests – whichever is GREATER
II. Penalties for Fine Arts Activities NOT Covered by the MSHSL
A. First time offenders for the following activities: 2 weeks or 2 performances – whichever is less
Plays
Musical (plus Pit Orchestra)
Broadway
Danceworks
Vocal Co-curricular Ensembles
Instrumental Co-curricular ensembles
All Tech Crews Working with the Above Groups
B. First time offenders for the following activites: next 2 weeks of a season in which the student is
a participant
Chess
Clubs
Infinity
Knowledge/Quiz Bowl
Math League
Science Olympiad
Mock Trial
Yearbook
AVRM
Deca
Diversity
Robotics
Any other limited event activities
C. First time offenders the following activities: next 30 days of ineligibility
NAHS
NHS
Student Council
Any Service or honor organizations
Note: If an activity has a curricular component (choir, band, yearbook, band, etc.), students will attend their
curricular classes. In addition, students will be allowed to be a part of all before school/after school rehearsals,
practices, competitions, or performances—since this participation is an essential element of the graded
curricular class. However, a student suspended from school for disciplinary reasons may NOT attend any
activity until the school penalty has been served.
III.
Penalties for Athletics, Arts, Activities, and Academics for violations NOT RELATED TO
CHEMICAL USE/RACIAL/SEXUAL HARASSMENT/VIOLENCE
Both the MSHSL and Apple Valley High School have the CODE OF CONDUCT. Penalties for violating the
CODE OF CONDUCT are expressly determined by the school Principal/Administration.

Each year this form is signed at the time of the student’s first participation in any arts or activity listed in
the attached document. Signing once will cover all arts and activities participation for the student for the
current school year. This document will remain in effect until the student signs for the first activity the
following year.
