STALLION BREEDING CONTRACT
This STALLION BREEDING CONTRACT for the breeding season of 2012 is
made and entered into on ___________________(date) by and between Maple
Swamp Farm, hereinafter designated MSF, located at 1260 Maple Swamp Rd,
Waynesburg, KY 40489 and

MARE HEALTH
• Mare owner represents that mare is healthy and sound.
•Mare owner represents that mare has no condition(s) that will hinder or prevent
her from settling in foal as stated by a licensed equine veterinarian.
•Mare owner agrees to provide breeding history.
•Mare owner agrees to provide any veterinary records upon request.
MARE HANDLING
• MSF will exercise judgment consistent with recognized standards in care and
supervision of mare.
•MSF assumes responsibility for arranging veterinarian and farrier services as
necessary. Mare owner will be notified of and have approval for all needed
services in advance.
•All veterinarian, farrier and other service fees will be paid by the mare owner.
PAYMENT AND FEES
• A non-refundable booking fee of one hundred and fifty dollars ($150.00) will be
paid upon booking of the breeding or upon mare being delivered to MSF for
breeding. The full amount of the booking fee will be credited towards the total
breeding fee and will be deducted from the total breeding fee upon pick up of the
mare.

•Mare care will be charged at the rate of fifteen dollars ($15.00) per day
beginning on the day that the mare is dropped off at MSF and including the day
of picking up the mare from MSF. The total mare care charge will be paid upon
pick up of the mare from MSF.
•All payments will be made by cash or check.
•
A twenty five ($50.00) service fee will be charge on all returned checks.
•
Mare owner agrees to pay all charges due, including cost of mare care, any
veterinarian, farrier or other service fees and balance of stallion breeding fee
upon picking up the mare from MSF
INDEMNIFICATION
•
Mare owner represents and warrants that they are the lawful owner or
holder of a lawful lease or purchase contract on the mare and have all rights to
enter into a breeding contract.
•
MSF represents and warrants that they are the lawful owner of the stallion
and has all rights to enter into a breeding contract.
•
Mare owner assumes all risks associated with breeding the mare•
Stallion owner assumes all risks associated with breeding the stallion
LIVE FOAL GUARANTEE
•
This breeding contract contains a live foal guarantee
•
A live foal is described as a foal who stands and nurses for a minimum of
seventy two (72) hours from birth.
•
If the foal is born dead or dies within 72 hours of birth mare owner will
receive a rebreed at no additional breeding fee to be used for mare owner’s
choice of 2012 or 2013 breeding season. Mare owner will provide a
veterinarian’s statement confirming the death to MSF.
•
If the foal dies due to mare owner’s negligence (e.g. failing to vaccinate
mare during gestation) MSF reserves the right not to honor the live foal
guarantee.
•
If the mare should miscarry or abort after being diagnosed in foal, mare
owner will have the choice of returning for a rebreed during the 2012 breeding
season or during the 2012 or 2013 breeding season.
STALLION LIMITATIONS
•
Should the stallion listed above be injured, retire, die or be sold prior to the
end of the 2012 breeding season mare owner will have the option to breed to any
other stallion owned by MSF at no additional fee or have the full amount of the
breeding fee refunded.
•
Should the stallion listed above be injured, retire, die or be sold prior to the
end of the 2012 or 2013 and mare is unable to use a rebreed offered with the
live foal guarantee MSF will have the option to offer another MSF stallion to the
mare owner at no additional fee. No refund of breeding fee will be made.
CONTRACT ENFORCEMENT
•
This contract is entered to in the state of Kentucky and will be interpreted
and enforced under the laws of that state.
•
Should either party breach this contract, the breaching party shall pay for
the others court costs and attorney’s fees related to such breach.
•
This contract represents the entire agreement between the parties. No
other agreements or promises, verbal or implied are included unless specifically
stated in this written contract.
