HUMAN WELFARE CONCERNING FEDERAL STATE SANITARY AND

In accordance with Federal Law N 294-FZ of December 26, 2008
"On
protection of rights of legal entities and individual entrepreneurs in the exercise of
state control (supervision) and municipal control" (Collected Legislation of the

to approve the attached Administrative Regulations for the cooperation of the
Federal Environmental, Industrial and Nuclear Supervision Service with the Federal
Supervision Service for Consumer Rights Protection and Human Welfare
concerning federal state sanitary and epidemiological supervision of construction.

ADMINISTRATIVE REGULATIONS FOR THE COOPERATION OF THE
FEDERAL ENVIRONMENTAL, INDUSTRIAL AND NUCLEAR
SUPERVISION SERVICE WITH THE FEDERAL SUPERVISION SERVICE
FOR CONSUMER RIGHTS PROTECTION AND HUMAN WELFARE
CONCERNING FEDERAL STATE SANITARY AND EPIDEMIOLOGICAL
SUPERVISION OF CONSTRUCTION
I. GENERAL
1 Administrative Regulations for the cooperation of the Federal Environmental,
Industrial and Nuclear Supervision Service (hereinafter "Rostechnadzor") with the
Federal Supervision Service for Consumer Rights Protection and Human Welfare
(hereinafter
"Rospotrebnadzor")
epidemiological
supervision
of
concerning
construction
federal
state
(hereinafter
sanitary
and
"Administrative
regulation") set the timing and sequence of cooperation of the Federal
Environmental, Industrial and Nuclear Supervision Service and the Federal
Supervision Service for Consumer Rights Protection and Human Welfare
(hereinafter "the Bodies") concerning federal state sanitary and epidemiological
supervision of construction (hereinafter "Cooperation").
2. Cooperation is exercised by Rostechnadzor (headquarters and territorial
bodies) and Rospotrebnadzor (headquarters and territorial bodies).
3. Implementation of cooperation is regulated by:
Federal Law N 294-FZ of December 26, 2008 "Protection of rights of legal
persons and individual entrepreneurs in the exercise of state control (supervision)
and municipal control" (Collected Legislation of the Russian Federation, 2008, N

protection of rights of legal persons and individual entrepreneurs in the exercise of
state control (supervision) and municipal control" (registered by Ministry of Justice
of the Russian Federation of May 13, 2009, registration N 13915) (Rossiyskaya
Gazeta, 2009, N 85), as amended by Order of the Ministry of Economic
Development of the Russian Federation N 532 of September 30, 2011 (registered
by Ministry of Justice of the Russian Federation, November 10, 2011, registration
number N 22264) (Rossiyskaya Gazeta, 2011, N 260);
Laws and other regulatory legal acts, which came into force after the entry into
force of the Administrative Regulations governing the cooperation.
Payment from legal entities and individual entrepreneurs for control activities is
not to be charged.
4. In organizing and conducting audits the Bodies cooperate on the following
issues:
1) information on regulatory legislative acts and methodological documents on
the issues of organization and performance of the federal state supervision;
2) definition of the objectives, volumes and timing of inspections;
3) information on the results of inspections, compliance with the legislation of
the Russian Federation in the established sphere of activities, and efficiency of the
federal state supervision;
4) preparation to the established procedure of the proposals to improve the
legislation of the Russian Federation where related to the organization and
performance of federal state supervision.
5. The results of cooperation are:
the Bodies exchange information on the results of state control (supervision)
activities, compliance with the legislation of the Russian Federation in the
established sphere of activities, and efficiency of the federal state supervision;
the Bodies coordinate proposals to improve the legislation in terms of the
federal government control and supervision, as well as proposals to improve the
skills of officials of the Bodies exercising control (supervisory) activities.
6. The results of cooperation should be legal facts as follows:
preparation and execution of the necessary documents on the results of the
completed actions of state control (supervision), envisaged by the legislation of the
Russian Federation;
exchange of information between the Bodies on the results of their actions
relating to state control (supervision) of legal entities and individual entrepreneurs.

you may see in Appendix N 1 to the Administrative Regulations.
II. REQUIREMENTS FOR THE ORDER OF COOPERATION
The procedure of informing about the rules of cooperation
7. Rostechnadzor Headquarters locations:

13. Information on cooperation issues is provided:
by posting on bulletin boards in the premises of the Bodies;
by posting on the official Internet sites of the Bodies;
with the use of telephone communications, electronic notification;
through publication in the mass media, publishing information materials
(brochures, collections of regulatory documents).
14. Information posted on the bulletin boards located in the premises of the
Bodies should be the following:
working hours;
how to obtain advice;
phones of information services;
Bodies' location addresses, addresses of Internet resources and e-mail
addresses.
Full information should be provided on the state control (supervision) activities
and joint actions of the Bodies envisaged by the legislation of the Russian
Federation on official sites of the Bodies (territorial bodies) on the Internet.
15. Consultations (information) on the implementation of cooperation should
be provided by public officers on the phone and during personal reception of
citizens.
Information on hours of personal reception of applicants by the officers should
be provided on the official websites of the Bodies (territorial bodies) on the Internet.
16. Advice can be provided upon written request. Response to a request should
be sent to the applicant by mail in a timely manner.
Terms of cooperation
17. Terms of cooperation between the Bodies should provide timely and
complete performance of the state control (supervision) functions entrusted to the
Bodies.
Grounds for denial or suspension of cooperation
18. Grounds for denial of cooperation are:
elimination of the federal state supervision body;
termination of the state control (supervision) authorities of the federal state
supervision body.
Requirements for the cooperation venues
19. The locations of cooperation are office premises of the Bodies which house
officers authorized to exercise cooperation.
20. Public facilities (toilets) and outdoor clothes closet should be provided for
in the premises of the Bodies.
21. The Bodies' premises intended for performance of state control
(supervision) functions should be provided with the respective plates containing
room numbers, names of the structural units, full names and positions of specialists.
In the rooms, the work places of state control (supervision) specialists should
be equipped with ventilation or air conditioning systems, telephones, fax machines,
copiers, computers with the ability to print out documents and access to the Internet
(subject to information security measures) and other office equipment enabling
timely arrangement and full cooperation.
Joint activities in the federal state supervision
22. Actions relating to state control (supervision) should be carried out to the
procedure provided in the RF federal law № 294-FZ of 26.12.2008 " On protection
of rights of legal entities and individual entrepreneurs in the exercise of state control
(supervision) and municipal control".
23. When jointly performing activities for the federal state control
(supervision), the Bodies within the time established by laws of the Russian
Federation, before the expected start of actions should coordinate with each other
the timing of the federal state control (supervision) actions, and prior to the
implementation of the federal state control (supervision) actions send to each other
by fax, electronic mail or other available means the copies of their directives
(orders) on the federal state control (supervision) action.
Information exchange
24. At the end of the joint action in state control (supervision) the Bodies within
60 days of the termination of such action should exchange information:
on the results of the performed activities;
on the status of compliance of a legal entity and an individual entrepreneur, in
respect of which the activities of state control (supervision) were implemented, with
the legislation of the Russian Federation in the specified area.
25. Information submitted by the Body should be in electronic form. If
necessary, upon written request, the information can be provided on paper.
III. PROCEDURE AND FORMS OF CONTROL
OF COOPERATION IMPLEMENTATION
26. Routine control of cooperation implementation by the officers should be
exercised by the heads (deputy heads), or authorized by them in a lawful manner
officers of the headquarters or the territorial bodies and their structural units.
The completeness and quality of cooperation between the territorial bodies
should be inspected by the headquarters of the Bodies in the complex, target and
performance inspections of compliance with the Administrative Regulations, laws
and other regulatory and legal acts of the Russian Federation establishing the
requirements for the implementation of cooperation.
IV. COMPLAINTS PROCEDURE IN RESPECT OF ACTIONS (FAILURE TO
ACT) OF AN OFFICER, AND HIS DECISION TAKEN IN THE
IMPLEMENTATION OF COOPERATION
27. Actions (failure to act) of officers of the Bodies, the decisions taken by
them in the course of cooperation are appealed on the out-of-court basis.
28. The applicant may apply for appealing the actions (or failure to act) and
decisions of officials, provided (adopted) during cooperation, at the location of the
Body in writing or by sending a fax or verbally, as well as in electronic form.
Actions (failure to act) and decisions of officials adopted in context of
cooperation may be appealed to the head of the relevant body (the territorial body),
or his deputy.
29. The applicant in a written application should point out on a mandatory
basis:
the full name of the body (territorial body) where a written application is sent,
or full name of the official concerned, or position of the person concerned;
mail address to which the reply should be sent;
the essence of the proposal, application or complaint.
If necessary, in support of its case the applicant should attach to the written
application the documents and materials or copies thereof.
30. The head of the federal state supervision body (territorial body) or his
deputy should:
provide objective, comprehensive and timely consideration of the application, if
necessary with the participation of the applicant who submitted the complaint, or his
legal representative;
request the required for consideration of the application documents and
materials in other state bodies, local self-government bodies and from other
officials, with the exception of the courts, the inquiry and the preliminary
investigation bodies;
upon consideration of application take measures to protect or restore the
violated rights, freedoms and legitimate interests of the applicant, provide a written
response on the merits of the delivered outstanding issues;
notify the applicant that his application is circulated for consideration to
another state agency in accordance with their competence.
31. Response to the application should be signed by the head of the federal state
supervision body (territorial body), or his deputy, or an authorized officer (of the
territorial body) and sent to the postal address given in the application.
32. Should the applicant raise an outstanding issue which has been repeatedly
addressed with written pertinent answers in response to his previous applications,
and in the current application there is no new arguments or circumstances, the head
of the federal state supervision body (territorial body), officer or authorized person
is entitled to decide that the current application lacks merit and terminate exchange
of correspondence on the matter with the applicant, provided that the said
application and earlier applications were submitted to the headquarters or the same
territorial body. The decision should be intimated to the applicant who sent the
application.
33. If the issue raised in the application cannot be answered without disclosing
information constituting a state or other secret protected by federal law, the
applicant submitted the request should be informed that it is impossible to give an
answer concerning the issues raised therein since the disclosure of the above
information is inadmissible.
34. If the reasons for which an answer concerning the issues raised in the
application could not be given were subsequently eliminated, the applicant has the
right to renew his application to the relevant federal state supervision authority.
35. A written application received by the federal state supervision body should
be reviewed within thirty days from the date of registration of the application.
In cases when to respond to application is necessary to request additional
information in other state authority executive bodies and local self-government
bodies, the head of the federal state supervision body (territorial body), or his
deputy, or an authorized official of the federal state supervision body may extend
the term of consideration of the application not more than for thirty days having
informed the individual who submitted the application on the extension of the
review.
