BREEDING CONTRACT
This Stallion Breeding Contract for the 2011 breeding season is made and entered by and between
___________________________ herein designated as Mare Owner and herein after designated as
Breeder____________________________________ on this ___________day of __________ 20___.
The Mare Owner agrees to breed the mare ____________________________________________, Reg.
No._______________________ to the Stallion________________________________ for a
Live Foal subject to the terms as follows:
1. The Stallion fee includes a non-refundable booking fee of $________________, payable upon execution
of this contract, and the balance of the Stallion fee is due and payable when Mare Owner retakes possession
of mare. Mare Owner may not remove mare from Breeders possession until all expenses are paid in full. In
addition, a Collection/Handling fee of $________ is charged. Breeding season covers the period of Feb. 1
thru July 1.
2. Mare Owners agrees to pay Breeder for care and feeding of mare and/or foal while in Breeders
possession. Mare care is $________a day for wet mares or dry mares. All mares must be halter broke. Mare
Owner must provide Breeder with copy of Registration Papers.
3. Breeder assumes responsibility for arranging veterinarian and farrier services as necessary (such as
pregnancy, palpations, suturing, ect...). Mare Owner agrees to pay all fees for such services.
4. Mare Owner shall deliver the mare in healthy and sound breeding condition free from infection or
disease. Mare Owner agrees that Breeder has permission, if necessary, to treat mare by a licensed
veterinarian for reasonable and necessary veterinary services for any condition which might insure mare’s
well-being at the expense of the Mare Owner. Breeder reserves the right to refuse any mare not in
satisfactory condition. If mare is refused, the Booking fee shall constitute liquidated damages.
5. Breeding agrees to diligently try to settle mare, if however, for any reason the mare does not settle, Mare
Owner will hold Stallion Owner and Breeder harmless.
6. A Breeder Certificate will be issued for the foal, conceived by the mating, when Stallion fee all other
expenses have been paid in full and when mare has produced a live foal
7. Mare Owner agrees that Stallion owner and Breeder, their agents or employees are not liable for death,
sickness and/or accidents including consequential damages caused to the mare and/or foal unless such
death, sickness, and/or accidents was by willful and wanton gross negligence of the Breeder and the Mare
Owner is not liable for death, sickness, and/or accident including consequential damages caused to Stallion.
8. If mare dies or becomes unfit to breed, the Mare Owner shall be required to breed a substitute mare to
the Stallion provided the Breeder has given advanced approval of substitute mare. No refunds shall be
permitted. In event of Stallions death or unfitness for breeding, the Breeding fee will be refund but the
booking fee will, at all times, be retained by the Breeder.
9. This contract is entered into the State of Ohio and will be interpreted and enforced under the laws of
state.
10. This contract contains the entire agreement between the parties with respect to its subject matter. All
prior promises or agreements (either written or verbal) between Mare Owner and Breeder shall be void
unless contain in this agreement. Any additions or changes must be in writing and signed by both Mare
Owner and Breeder
11. This Contract is non-assignable and non-transferable.
