This contract is entered into on ___/___/___, by Cross A7 Ranch (stallion
owner) and ______________________________(mare owner) and certifies that Mare
owner or agent has engaged in one service to the stallion Small Town Red,
registration number 3800655, for the mare ________________, registration number
_________________, for the breeding season (2010) for a fee of $ 850.00.
A non-refundable booking fee of $300 must be returned with a completed and
signed contract. The booking fee will be credited toward the breeding fee.
While mare is in care of the stallion owner a mare care fee of $10/day will be
assessed.
If mare is to be artificially inseminated a $250 collection fee will be imposed
per collection.
Mare owner agrees to pay all expenses monthly. Expenses may include, but not limited to,
board, farrier and veterinary fees. The mare will not be released to Owner/agent until such time as the
remainder of the breeding fee and afore mentioned expenses have been paid in full.
When mare leaves stallion owners care all bills become due.
Mare must be halter broke and reasonable to handle.
A health certificate along with a copy of mares registration papers must be presented to
stallion owner upon mares arrival.
It is agreed that stallion owners veterinarian can check the above mare for normal breeding
conditions and perform such vet services for the mare and/or her foal as is deemed necessary, at the
expense of the mare owner, such as ultra sounds, artificial insemination (if applicable), etc.
Stallion owner agrees to diligently try to settle mare. Mare owner agrees to give ample
opportunity to settle the mare (having bred her through four (4) heat cycles).
Mare owner agrees to have mare pregnancy checked within 16-21 days after breeding, by
veterinarian and agrees to supply stallion owner with the veterinarian’s findings along with signed
statement from veterinarian on his/her letterhead.
Live Foal Guarantee. Live Foal shall be defined as a foal that stands and nurses without
assistance and survives the first 24 hours. If mare aborts her foal, the foal is still born, or said foal does
not survive longer than 24 hours, a return season breeding will be guaranteed for the following year
only, provided proper notification is given to the Stallion Owner of the loss. Proper notification shall
be defined as written certification by a licensed veterinarian with seven (7) days from the date mare is
proved not to be in foal or loses her foal as set forth herein and mare Owner/Agent must certify that
such abortion or death of foal did not result from any act or omission of Mare Owner/Agent. Failure to
provide notification as set forth herein shall void the Live Foal Guarantee. The Live Foal Guarantee
shall be void if mare is abused, participates in a race, race training, or a racing event, or otherwise
participates in hazardous activity being pronounced safe in foal.
Booster rhino pneumonia vaccinations must be administered as indicated by the mare
Owner/Agents veterinarian as the mare progresses through her pregnancy. Failure to do this will void
the Live Foal Guarantee.
It is understood that the stallion owner will not be held responsible for any disease, accident,
sickness, or death of the mare or her foal. The Stallion Owner agrees to exercise his best judgement in
supervising the care of mare or her foal. Mare owner will likewise not be responsible for sickness,
accident, etc. to the Stallion Owners horse.
Breeding certificate will be issued when mare owner has notified stallion owner that above
mare has produced a live foal and all bills are paid in full.
This contract is non-transferable unless otherwise arranged by Stallion Owner. If the mare
changes ownership before foal is born, the Live Foal Guarantee is null and void.
Any changes to this contract must be made in writing and signed by both the mare and stallion
owners.
This contract is entered into and shall be interpreted and enforced under the laws of the State
of Arizona. Should it be necessary for Stallion Owner or Breeding Facility to employ an attorney to
enforce any of the terms of this Agreement, including collection of money owed. Mare Owner/Agent
shall pay all reasonable attorneys fees, costs of suit and other expenses related to enforcing this
Agreement.
