This contract for SHIPPED SEMEN is made and entered into on this date ______/______/_______ by and between
_____________________________hereinafter designated Purchaser, and Karen Stopek, owner and trainer of STOPEK STABLES
hereinafter designated Stallion Owner. Stallion owner agrees to ship cooled semen collected from the Trakehner Stallion Prelude
By Mozart ATA Reg. #GRB-1S-1527, CTHS Reg.#665 to Purchaser for artificial insemination of the mare
____________________________ Reg_#____________________, subject to the following terms and conditions:
1. A non-refundable Booking Fee of $250.00 is payable with the execution of this contract.
2. The Breeding Fee of $1000.00 is due in full prior to semen shipments. The Shipping Fee is $150.00 per shipment and is
due prior to shipments. The Collection Fee is $50.00 and is due prior to shipments.
3. The Breeding Fee includes a live foal guarantee. A live foal is a newborn foal that stands and nurses without help. If
mare does not produce a live foal, or if mare does not settle, Purchaser must provide a veterinarian’s statement
confirming such. Stallion owner will then reship semen during the current breeding season or the following year’s
breeding season. If mare does not settle the second year, Stallion Owner will accept a replacement mare.
4. THE PURCHASER IS RESPONSIBLE FOR:

Determining the mare’s heat cycle and best insemination dates.

Notifying Stallion Owner in a timely manner when semen will be required. A minimum of 24 hours notice is
required.

Using a Veterinarian or Breeding Technician to inseminate the mare within 72 hours of collection.

Notifying the Stallion Owner of the time and date of insemination.

Pregnancy checking the mare on or about 16-20 days and notifying Stallion Owner of the result.

Completing all required forms in a timely manner.

Paying all fees required by mare’s breed for shipped semen registry, including DNA testing, parental
verification, additional registration fees, etc.

Inseminating only the designated mare with this stallion’s semen.
5. THE STALLION OWNER WILL:

Ship live and viable semen to Purchaser in a timely manner.

Complete all required forms in a timely manner.
6. If there is insufficient semen to fulfill all requests on a particular day, priority will be given to Purchasers with deposits and
fees paid in full and then to those mares deemed “most likely to settle” on this date, as determined by information
provided by purchaser’s veterinarian or breeding technician.
7. If, prior to settling the mare, the stallion should die, be sold, or become unfit for semen collection, $1000.00 of the
Breeding Fee (if it has been paid in full) and any balances in Shipping Fee accounts will be refunded, thereby canceling
this contract. Should the mare die or become unfit to be bred, Stallion Owner will ship semen to a substitute mare of
Purchaser’s choice.
8. This Contract is non-assignable and non-transferable except as stated above. This Contract is entered into in the State of
Iowa and shall be interpreted and enforced under the laws of this State. If any clause is against State Law, that individual
clause shall be null and void.
9. Should either party breach this contract, the breaching party shall pay for the other’s court costs and attorney’s fees
related to such breach.
10. This contract represents the entire agreement between the parties. No other agreement or promises, verbal or implied,
are included unless specifically stated in this written Contract. (Additional agreements should be individually initialed by
each party.)
When Stallion Owner and Purchaser sign this Contract, it will than be binding on both parties, subject to the above terms and
conditions.
