PART 1 - INTRODUCTION
Division 1 - Preliminary
1.1.1
Short title
This planning scheme policy may be cited as Planning Scheme Policy
No. 11.26 (Infrastructure Contributions for Stormwater Infrastructure) 2009.
1.1.2
Commencement
This planning scheme policy commences on the day the notice of adoption of
the planning scheme policy is published.
Division 2 - Purpose of the planning scheme policy
1.2.1
Purpose of the planning scheme policy
The purpose of this planning scheme policy is to assist with the
implementation of the Caloundra City Plan 2004 by specifying the method
for calculating an infrastructure contribution for stormwater infrastructure.
Division 3 - Relationship to the Integrated Planning Act 1997
1.3.1
Authorising legislation
This planning scheme policy is made pursuant to the Integrated Planning Act
1997.
Division 4 - Relationship to the planning scheme
1.4.1
Relationship to the planning scheme
(1)
1.4.2
This planning scheme policy is to be read in conjunction with—
(a)
section 6.1.31 (Conditions about infrastructure for
applications) of the Integrated Planning Act 1997; and
(b)
Parts 7.9 (Flood Management Code), 7.11 (Natural
Waterways and Wetlands Code), 7.14 (Water Resource
Catchment Code) and 9.10 (Stormwater Management
Code) of the Caloundra City Plan 2004.
Application of planning scheme policy

This planning scheme policy applies in respect of a development
application for—

(a)
a development permit for a material change of use or a
reconfiguring of a lot that is assessable development; or
(b)
a preliminary approval to which section 3.1.6 (Preliminary
approval may override a local planning instrument) of the
Integrated Planning Act 1997 applies, where the
development which is the subject of the preliminary
approval is stated to be self-assessable development.
This planning scheme policy does not apply—
(a)
where an infrastructure charges schedule which deals with
infrastructure charges in respect of stormwater
infrastructure has been adopted;1 or
(b)
where a legally binding agreement exists between the local
government and the applicant that deals with stormwater
infrastructure and which relates to the land to which the
development application relates.
Division 5 - Interpretation

Definitions – the dictionary

The dictionary in Schedule 1 (Dictionary) of this planning scheme
policy defines particular words used in this planning scheme policy.
Interpretation of the planning scheme policy
(1)

A term used in the planning scheme policy which is not defined in
Schedule 1 (Dictionary) of this planning scheme policy is to be
given the meaning in—
(a)
Part 3 (Interpretation) of the Caloundra City Plan 2004; or
(b)
the Integrated Planning Act 1997.
Section 6.1.20(3) (Planning scheme policies for infrastructure) of the Integrated Planning Act 1997
provides that if the local government has an infrastructure charges plan, an infrastructure charges
schedule or a regulated infrastructure charges schedule, the planning scheme policy must not deal with
the same matters as the infrastructure charges plan, the infrastructure charges schedule or the regulated
infrastructure charges schedule.

Division 1 - Basis of infrastructure contribution
2.1.1
Stormwater infrastructure
The stormwater infrastructure comprises both quantity and quality
infrastructure and is identified in Table 2.1.1 (Stormwater infrastructure).

2.1.2
Stormwater infrastructure charge areas
(1)
The stormwater infrastructure and charge rates have been
determined for charge areas based on the natural hydrologic
catchments of the various creek and river systems within the
Planning Scheme Area.
(2)
Charge rates have been prepared for the catchments identified in
Table 2.1.2 (Stormwater catchments) and shown on Map SWFUI
(Future Stormwater Index) in Schedule 6 (Stormwater infrastructure
maps).

The infrastructure provision and demand for stormwater infrastructure has
been based on full development of the precincts identified in Caloundra City
Plan 2004.

2.1.4
Establishment cost of stormwater infrastructure
The establishment costs for the existing and future stormwater trunk
infrastructure and timing for future works are summarised for each
catchment in Schedule 4 (Future stormwater infrastructure projects).
2.1.5
Apportionment of establishment cost
(1)
The average cost apportionment method has been adopted for
stormwater infrastructure with charge rates based on apportioning
the total establishment cost of existing and future infrastructure
within a catchment over the total existing and future demand for the
catchment.
(2)
Impervious area has been adopted as the standard demand unit for
calculating charge rates and estimates of the impervious areas for
each catchment are based on the impervious factors detailed in
Schedule 3 (Impervious factors for individual precincts).
Division 2 - Type of Infrastructure Contribution
2.2.1
Type of infrastructure contribution for stormwater infrastructure
An infrastructure contribution for stormwater infrastructure may be in the
form of—
(a)
a land contribution being the provision of land for stormwater
infrastructure that is identified in the list of future stormwater
infrastructure projects identified in Schedule 4 (Future stormwater
infrastructure projects) (“land contribution”); or
(b)
a financial contribution being the provision of money (“financial
contribution”); or
(c)
a works contribution being the carrying out of works for stormwater
infrastructure (“works contribution”); or
(d)
a mixed contribution involving a combination of a land contribution,
a financial contribution or a works contribution (“mixed
contribution”).
Division 3 - Calculation of the infrastructure contribution
2.3.1
Land contribution
(1)
A land contribution is the provision of land for stormwater
infrastructure that—
(a)

is required for a future stormwater infrastructure project
identified in Tables 4.1 to 4.13 of Schedule 4 (Future
stormwater infrastructure projects); and

2.3.2
when valued at the rates in Table 5.1 (Land values) in
Schedule 5 (Land values) is equal to the value of the
financial contribution calculated in accordance with section
2.3.2 (Financial contribution) of this planning scheme
policy.
A land contribution shall only be accepted by the local government
where the local government has identified and approved as a land
contribution the area of land that is required for the stormwater
infrastructure.
Financial contribution
(1)
A financial contribution for stormwater infrastructure is an amount
calculated in accordance with the following formula—
H = [ (SW1 - SW2) x CSW ] x I
Where—
H = The total infrastructure contribution for stormwater
infrastructure expressed as ($).
SW1 = The total impervious area which will result from the
development expressed as impervious hectares. SW1 is calculated as
the product of the developable area of the site and the impervious
factor identified in column 2 of Table 3.1 (Impervious factors) of
Schedule 3 (Impervious factors).
SW2 = The impervious area of an existing lawful use which exists
on the site at the time the development application is made which
shall be determined as(a)
for an existing single unit residential site an impervious
area of 480 m2, or,
(b)
for an existing multi-unit residential or non-residential
development the lesser of either
(i)
the measured impervious area of the site, or,
(ii)
the product of the developable area of the site and
the impervious factor identified in column 2 of
Table 3.1 (Impervious factors) of Schedule 3
(Impervious factors) that applies to the existing
lawful use.
CSW = The catchment charge rate shown in column 4 of Table 2.1
(Stormwater infrastructure charge rates) in Schedule 2 (Stormwater
infrastructure charge rates) expressed as ($) per impervious hectare
corresponding to the column 1 stormwater catchment area for the

location of the development as referenced in Map SWFUI in
Schedule 6 (Stormwater infrastructure maps).
I = The ratio of the most recently published producer price index
for non-residential construction (4113) Queensland, available at the
time of payment of the contribution, divided by the non-residential
construction (4113) Queensland producer price index for the June
2006 quarter (153.3).
2.3.3
(2)
The local government is not required to provide the stormwater
infrastructure immediately upon the payment of a financial
contribution or in the immediate vicinity of the development.
(3)
The financial contribution may be reduced by the local government
where it is satisfied that a previous infrastructure contribution for
stormwater infrastructure has been provided for the site.
Works contribution
(1)

2.3.4
A works contribution for stormwater infrastructure is works—
(a)
for a future stormwater infrastructure project listed in
Tables 4.1 to 4.13 of Schedule 4 (Future stormwater
infrastructure projects), and
(b)
to the value of an amount equal to the value of the financial
contribution calculated in accordance with section 2.3.2
(Financial contribution) of this planning scheme policy;
and
(c)
which complies with the local government’s design
requirements.
A works contribution shall only be accepted by the local
government where—
(a)
the local government has agreed to the provisions of a
works contribution; and
(b)
the local government has approved detailed construction
plans, landscaping plans and costings for the proposed
works contribution.
Mixed contribution
(1)

A mixed contribution for stormwater infrastructure is land, a
monetary sum or works to the value of an amount equal to the value
of the financial contribution calculated in accordance with section
2.3.2 (Financial contribution) of this planning scheme policy.

Division 4 - Form of the infrastructure contribution
2.4.1
Form of the infrastructure contribution
(1)
The local government is to specify the form which an infrastructure
contribution for stormwater infrastructure is to take.
Division 5 - Timing of the infrastructure contribution
2.5.1
Timing of the infrastructure contribution
(1)
Amended – October 2009
An infrastructure contribution for stormwater infrastructure is to be
provided to the local government—
(a)
prior to the time specified in the development approval; or
(b)
if no time is specified in the development approval, prior to
the time being—
(i)
in the case of a development, which is a material
change of use, the commencement of the
development; and
(ii)
in the case of a development which is
reconfiguring a lot, the approval of the plan of
subdivision; and
(iii)
in the case of a development, which is not a
material change of use or a reconfiguring a lot, the
commencement of the development.

DICTIONARY
S1.1
Defined terms
“developable area” means the total area of the development minus the land for a
major road,(collector or above) open space or a waterway corridor.
“impervious area” means that part of the development which forms a barrier
preventing rainfall from directly contacting undisturbed ground.
“stormwater infrastructure” see section 2.1.1 (Stormwater infrastructure) of this
planning scheme policy.
