SCOPE OF WORK
1.
GENERAL SCOPE
Contractor agrees to provide combined drug/alcohol testing and collection
services to Porterville Developmental Center (PDC), as requested and mutually
agreed upon by Contractor and Project Representative on the following
situations:

Non-DOT Collection and Testing:
Drug and/or alcohol testing for PDC applicants/employees subject to PreEmployment Drug testing, Reasonable Suspicion, Return to Duty, and
Random drug testing.
B.
On-Site DOT Collection:
This service only includes on-site collection and transporting the specimen
to another lab approved under the existing state contract for DOT Drug
and Alcohol Testing.

3.
SPECIFIC REQUIREMENTS
Contractor will meet all National Institute of Drug Abuse (NIDA) testing
requirements for collection and testing for specified drugs and alcohol. Positive
results will be sent to a certified lab for Gas Chromatology/Mass Spectrometry
(GC/MS) confirmation. In the case of any DOT Drug/ Alcohol testing, the

Contractor will comply with the DOT Federal Highway Administration (FHWA)
regulations.
The Contractor shall provide the combined services of:

Collection and testing of urine specimens and administration of breath
alcohol tests. Must also have capability of performing optional
testing/analysis such as, but not limited to, hair testing.
Laboratory analysis and services
Medical Review Officer (MRO) services in accordance with Department of
Personnel Administration (DPA) and State Personnel Board (SPB) laws
and rules for the State of California
Training and information services
COLLECTION AND TESTING LOCATION
Collection and testing services, as outlined herein, shall include 24 hours/7 days
a week availability and shall be done at either the State or Contractor’s place of
business, depending on the individual need and circumstance. The State shall
be the final judge as to the place of Collection and/or Testing in each individual
case and the Contractor will be required to comply accordingly.
The Contractor shall maintain all required forms, collection kits, and
miscellaneous supplies for collection services provided under this agreement.
Urine collection/breath alcohol testing procedures shall adhere to Federal and
State regulations. Such procedures shall encompass the complete testing
process, from collection to final result reporting, which includes a written MRO
review of all positive test results.
Result reporting shall include written verification of specimen collection test
results showing negative and/or positive results and their corresponding levels
above the designated cut off levels.
5.
TECHNICIAN CERTIFICATION
Contractor must ensure that all Breath Alcohol Technicians (BAT) are trained and
certified in accordance with, and adhere to collection procedures as defined in,
49 CFR Part 40 Subpart C. Reasonable Suspicion Testing requires a certified

BAT to respond within thirty (30) minutes to the State’s place of business. The
Contractor shall have a certified BAT available for response 24 hours a day, 7
days a week to meet this requirement.
Contractor shall provide qualified medical personnel or other staff as authorized
under federal regulation to collect urine or, if requested, hair samples for drug
panel testing.
6.
TESTING REQUIREMENTS

7.
LABORATORY SERVICES
Contractor must possess or contract with a Substance Abuse and Mental Health
Services Administration (SAMHSA) certified laboratory that possesses all
licenses and permits required by law for accomplishing any work required in
connection with this Agreement. The Laboratory must conduct its urine testing in
conformance with applicable SAMHSA standards. Contractor must provide to
the State evidence of licensure or contract with qualifying laboratory, prior to
commencement of any work under this agreement.
8.
MEDICAL REVIEW OFFICER (MRO) SERVICES
The MRO must be a licensed physician with knowledge of substance abuse
disorders and trained for this purpose. The MRO will:

Review and interpret all confirmed positive test results
Notify the employee of a confirmed positive test result
Provide an opportunity for employee to discuss positive test result
Review employee’s medical history as appropriate
Review medical records as appropriate
Verify laboratory results
Notify employer of verified positive test.
Make return to duty recommendation as appropriate
Maintain records of notifications for positive test results
The MRO shall review test results within 48 hours (two business days) of receipt
of the laboratory results. The MRO shall provide written notification of review to
PDC’s Project Representative within 72 hours (three business days) of receipt of
laboratory results. If employee cannot be reached for an interview or the review
cannot be completed within the 72 hour (three business days) time limitation, the
MRO shall notify PDC’s Project Representative no later than close of business
on the third day of the 72 hour (three business days) time limitation. The MRO
shall provide a written report on all positive test results to PDC’s Project
Representative via fax machine, no later than close of business on the third day
of the 72 hour (three business days) time limitation, unless otherwise agreed
upon via telephone with PDC’s Project Representative.
If required by the State, the MRO agrees to attend appeal hearings, depositions,
and/or court hearings to provide expert testimony concerning medical reviews

performed under the contract and shall be compensated as allowable under
provisions established by the Department of Personnel Administration and the
State of California’s Administrative Manual.
9.
TESTING RESULTS
Any breath/alcohol testing will be reported at the conclusion of the test to the
State personnel accompanying employee being tested. Drug testing results from
urine analysis will be expedited to PDC’s Project Representative, with written
notification provided no later than three business days from collection.
10.
URINE SAMPLE STORAGE
All positive urine specimens must be stored for one (1) year or until no longer
needed for appeal proceedings or litigation, whichever is longer. Upon
notification of a challenge or at the discretion of the State, the laboratory agrees
to maintain storage for an indefinite period.
11.
TRAINING AND INFORMATION
Upon request, the Contractor agrees to provide training regarding drug testing
and reasonable suspicion to designated State employees. This shall be provided
at the rate specified.
