STALLION SERVICE CONTRACT This contract for the breeding season of 2005 is made and entered into on this _____day of_______, _____ and is by and between Pine Ranch, hereinafter referred to as Stallion Owners, and _________________, hereinafter referred to as Mare Owner. Stallion owners hereby agree to breed the Quarter Horse Stallion HIRED HANDS TRAVELER AQHA REG # 3601431 to the mare____________________, breed ___________, registration number_________________ Sire:____________ Dam:______________, Mare owner agrees to pay the following fees for service pursuant to this agreement: A nonrefundable boarding fee of ($5) per day shall be charged to Mare owner by Stallion owners for each day aforementioned mare (and foal) are at the Farm, excluding dates of arrival and departure. Said boarding fee shall be paid before aforementioned mare (and foal) leaves the farm. Stallion owners will exercise judgment consistent with recognized standards in care and supervision of mare and/or foal. Breeder assumes responsibility for arranging veterinarian and farrier services as necessary. A $450 breeding fee will be charged for registered AQHA, APHA, ApHC, or TB mares. $350 breeding fee to all other mares. This includes a booking fee of $150 which is due at the signing of this contract and is non-refundable. Should a registered mare produce a “colored” multi-register able foal, the mare owner agrees to contact the stallion owners and pay an additional fee of $200 to the stallion owners prior to the issuance of a breeder certificate. Should a registered mare produce a solid, non-colored foal register able only by one registry, the stallion owner agrees that no other fees are charged prior to the issuance of a breeder’s certificate. If the afore stated mare fails to have a live foal that stands and nurses, or has twins, the mare may be returned to the service of the stallion at the next breeding season only at no additional charge of stud fees. Chute fees of $150 plus any applicable mare care and veterinary fees will be charged. (Provided a licensed veterinarian attests to such occurrence in writing and notification is to the Stallion owners within five days of such occurrence.) Mare Owner hereby agrees that Stallion Owner reserves the right to refuse service to any mare which appears to be diseased or which is unfit for breeding before serving aforestated mare, or if aforestated mare should die, be sold, or become unfit for breeding before served, this agreement is and shall be null and void, except for provisions in paragraphs 1 and 2. Mare Owner hereby agrees to hold Stallion Owner harmless from any claim resulting from accidental injury or death of aforestated mare (and foal). Should aforementioned mare (and foal) become missing, lost, estrayed, seriously injured, sick or dead, Stallion Owner agrees to notify Mare Owner by phone and subsequently by mail. It is further agreed that should the stallion die, be sold by the owner, or become unfit for service prior to settling the mare, that 100% of the breeding fee minus the chute fee will be refunded, if it has been paid in full, thereby canceling this entire Contract. This Contract is non-assignable and nontransferable. Breeder strongly recommends that Mare Owner carry full insurance on mare and/or foal. Stallion Owner agrees to hold Mare Owner harmless from damage or injury to stallion by afore mentioned mare and (foal). Stallion Owner agrees to maintain aforestated mare (and foal) in good condition pursuant to this agreement, with proper care, handling, and protection, according to the rules of good animal husbandry and reasonable standards and practices of the horse industry. Stallion Owner agrees that Mare Owner may at any time go to the breeding facility and inspect afore stated mare (and foal) and determine if same is in good health and properly cared for. Mare owner agrees to provide Stallion Owner proof of negative breeding culture upon arrival of mare to breeding facilities. Mare owner also agrees to provide a current negative Coggins test, photo static copy of registration papers (both sides). If arrangements are not made to pick up mare (and foal) and all incurred expenses paid by________________________, the aforestated mare (and foal) will be considered abandoned and will be disposed of at public auction. This agreement and all covenants and agreements herein contained shall accrue to and be binding upon the parties hereto, their heirs, successors, administrators, and executors. Upon material breach of this agreement by one party, the other party may terminate the same. Mares that are not halter broken will not be accepted. No modification of this agreement shall be binding unless in writing and executed by the parties hereto.
