No substitutions permitted. Page 1 of 4 Dog Rules and Regulations: *Dog - maximum number: 1 *Pet fee $150 (non refundable one time fee). This fee will be paid prior to pet moving in. 1. Screening. All pet owners will be subject to a screening process by Landlord, which will include, but not be limited to, the suitability of the pet for the rental unit. No vicious or intimidating dogs are allowed. The following is a list of some of the breeds of dogs that are not allowed: Doberman, Rottweiler, and Pit Bull. The Landlord reserves the right to disapprove of any dog after the initial screening. No tenant may obtain a dog prior to gaining written approval of the landlord. The landlord has the absolute discretion to approve or disapprove any application for residence of any dog. Landlord’s approval is conditioned upon the tenants’ continued compliance with terms of this pet agreement. 2. Pet will not cause: damage, nuisance, noise, health hazard, or soil the apartment, premises, grounds, common areas, walks, parking areas, landscaping or gardens. Tenant agrees to accept full responsibility and liability for any damage, injury or actions arising from or caused by Tenant’s pet. The Tenant agrees that if the pet becomes annoying, bothersome, or in any way a nuisance to other Tenants or to the apartment operation, the Tenant shall immediately upon written notice from the Landlord, remove pet from the premises or vacate the apartment. If the Tenant vacates the apartment, the Landlord has the right to declare the lease in default. 3. Pets shall be prohibited from the common areas of the building such as the fitness center, laundry room, and community loft. When a dog is taken outside of the owner's rental unit, the dog must be on a leash or caged. At no time shall the dog be left unaccompanied. Tenant is not to leave pet unattended on the patio or balconies. 4. A pet owner shall physically control or confine his/her dog during the times when Landlord’s employees or agents must enter the pet owner’s unit to conduct business, provide services, enforce lease terms, etc. 5. Pet owners must clean up after their dog and dispose of pet waste in a designated pet waste receptacle. There are designated areas outside for pets and their waste removal. Pet waste or pet litter shall not be deposited in the toilet or in garbage cans around the property with the exception of the designated pet waste receptacle. 6. The Landlord will impose a separate waste removal penalty of $5 per occurrence for failure to comply with pet rules on waste removal. 7. To keep noise to a minimum, 25% of any individual room, foyer or hallway floor area, excluding bathrooms and non-walk-in closets, must be covered with rugs, carpet or other equally effective noise reducing material. On the upper floors, the mgt. reserves the right to increase the % of required floor covering. 8. Pet bedding shall not be washed in any Hyacinth Lofts laundry facilities. 9. If the owner is absent from the rental unit more than twenty-four (24) hours, accommodations must be made for a pet sitter or for outside boarding of the pet. In instances where a pet has been abandoned for more than 24 hours, and an emergency contact cannot be located, the Landlord shall report the matter to the City of Cleveland Kennel or other applicable authority for its removal. If necessary, Landlord will enter the apartment, as in an emergency, to rescue the animal. Page 2 of 4 10. Pets that make noise continuously and/or incessantly for a period of 10 minutes or intermittently for one-half hour or more to the disturbance of any person at any time of night or day shall be considered a nuisance. 11. Three repeated substantiated complaints by neighbors or Landlord personnel regarding pets disturbing the peace of neighbors through noise, odor, animal waste, or other nuisance may result in the owners having to remove the pet. 12. All dogs should be spayed/neutered. 13. Pet owners must show proof annually of license, distemper and rabies boosters for dogs. The tenant shall be responsible for proper care, including but not limited to flea control, yearly vaccinations, and compliance with all applicable state and federal statutes and City of Cleveland ordinances. Pets shall wear a collar with a tag identifying the pet and its owner, with name and telephone number. 14. Tenant shall be responsible for the cost of all materials and/or labor for repair of any damage caused by their pet. Tenant shall be responsible for any pet insect infestation and shall pay promptly, upon receipt of bill for all materials and/or labor used for necessary extermination. 15. The Tenant warrants that the pet is housebroken. Tenant also warrants that the pet has no history of causing physical harm to person or property, such as biting, scratching, chewing, etc. and further warrants that the pet has no vicious history or tendencies. 16. Tenant shall not alter their apartment, patio or other areas on the property to create an enclosure for their pet. 17. Tenant shall allow the Landlord and staff to inspect their unit at any time in order to ensure compliance with these rules. 18. All violations of this pet policy shall be dealt with as a material violation of the lease and appropriate lease enforcement action up to and including eviction shall be taken. In addition, if the Landlord determines that the presence of a pet constitutes a risk of damage to The Hyacinth Lofts or creates a threat to the health and safety of an member of the apartment community, including residents, household members, guests and/or employees, Landlord may require the removal of the resident’s pet upon 48 hours written notice. Failure to comply with this notice shall be deemed a violation of the resident’s lease obligation. 19. Unauthorized pets: After an unauthorized pet as been seen, a violation notice will be given to the resident. This violation shall stated that the resident must remove the pet within seven (7) dyas or eviction proceedings will commence. Seven days after this violation, Landlord will inspect the apartment to verify the removal of the animal. 20. Indemnification and Insurance: Tenant indemnifies Landlord from and agrees to acquire sufficient renter’s insurance and/or other liability insurance to cover the wrongful actions and behavior of the pet. Such indemnification and insurance shall include but not be limited to the attack or biting of other residents, occupants, guests or invitees in the resident’s apartment or any other apartment, building or grounds of The Hyacinth Lofts. Page 3 of 4 21. Animal Bites: The pet owner must report all animal bites to the City of Cleveland Police Department and The Hyacinth Lofts within twenty-four (24) hours of occurrence. Should a pet bite a person, the pet may be quarantined as determined by the City of Cleveland Police Department and City of Cleveland Kennel. 22. Early Termination: If Resident decides to not keep pet in said apartment, resident may terminate this agreement upon a 30-day written notice to Landlord. Landlord may terminate the agreement at any time if any of the rules set forth above are violated. 23. The Hyacinth Lofts and its management reserves the right to amend these rules by giving tenants 30 days written notice of these changes. 24. A copy of these rules shall be given to every resident who registers a pet and additional copies will be available at The Landlord’s Management office. 25. The Management Office shall be responsible for maintaining records required by this policy including all pertinent pet-related information and documents supplied by tenants, periodic unit inspections, investigation of complaints regarding pets, billing for damages caused by pets and scheduling of repairs required because of pet action. 26. This Pet Agreement is an Addendum to the Lease between Owner and Tenant. If any rule or provision of this Pet Agreement is violated, Owner shall, in addition to the foregoing, have all rights and remedies set forth in the Lease for violations thereof, including but not limited to, eviction, damages and attorneys’ fees. 27. The Landlord retains the right and the Tenant acknowledges the right of the landlord to remove or order to be removed any resident dog at any time.
