Stallion Service Contract for AI and Shipped Semen
This Stallion Service Contract for AI and /or Cooled Shipped Semen for the 20___ breeding season is made and entered into
on this ______ day of __________ 20___ made by and between Sam & Dawn Preuss, DBA Cowboy’s Dream Ranch, herein
referred to as the Breeder, and the Mare Owner described below. This contract shall be for the breeding of the following said
mare to the said stallion, Frenchmans Icy Frost, Registration #5132959 for the fee of $700.00 for a, “live foal”, and is
subject to the following terms and conditions:

A $100.00 nonrefundable booking fee (which is included in your total Stud Fee of $700.00) must be paid at the time
of signing of the contract. This $100 check, made out to, Cowboy’s Dream Ranch, along with two signed copies of
this contract and duplicate copy of the mare’s registration papers, should be sent via, the U.S.P.S., back to the
address at the top of this document, if it cannot be presented in person.

The balance of the stud fee must be paid in full before the semen will be shipped.

The collection and/or shipment fees, are NOT included in the above listed stud fee. This fee is $450.00 each time
this service is rendered. This charge is a combined cost of Fayette County Veterinary Clinic’s fee for collecting and
breeding AI, and then shipping semen via Fed-Ex, not Cowboy’s Dream Ranch.
a). To sum it up, if you are NOT doing “Live Cover,” and you ARE doing your breeding using either on site AI or
by receiving cooled shipped semen, your initial fees would total $1,150.00. This is $700.00 for your stud fee
(Booking fee included) and $450.00 for your AI procedure, done on site at Fayette County Veterinary Clinic, or
your shipment of cooled semen. There would only be an additional charge if your mare missed and needed
additional shipments sent out or another AI procedure done on site. Each AI procedure and/or shipment will cost
another $450.00, every time this service is rendered. Fayette County Veterinary Clinic handles all cooled semen
shipments, from their end, to insure it is safely handled and then sent off viable, properly packaged and at proper
temperature.
b). Therefore, with these fees, if you are doing on site AI, you will pay Fayette County Veterinary Clinic your
$450.00 directly. If you are receiving cooled shipped semen, you need to either send the Stallion Owner(s)/Manager
a check for the $450.00, with the signed contract, and made out to Fayette County Veterinary Clinic, or you can get
in touch with them to establish an account to pay them directly.

c) The facility reserves the right to refuse any mare not in satisfactory condition.

Mares on site will be given breeding priority. Therefore, we make no guarantees that cooled semen will be available
for a specific day. To accommodate the needs of your mare, it is in your best interest to keep Cowboy’s Dream
Ranch notified, in advance, of your projected needs. It is the Mare Owner(s)’s responsibility to inform the Stallion
Owner(s)/Manager at least 48 hours in advance when needing a shipment of semen. Cancellation must be made by
8:00 AM shipping day.

The Stallion Owner(s)/Manager will not be held responsible if the mare fails to settle for any reason. Mare must be
inseminated on the date of delivery by a licensed veterinarian. The semen may be used for the designated mare only.

This contract contains a live foal guarantee. A live foal shall be defined as a foal that shall stand and nurse without
assistance and survive the first 24 hours. If the Mare aborts her foal, the foal is stillborn or said foal does not survive
longer than 24 hours, a return season will be guaranteed for the following year only on same mare, provided proper
notification is given to Breeder of the loss. Mare must be 1 st checked for pregnancy by a licensed vet within 45 days
of being bred.
a. Proper notification shall be defined as written certification by a licensed veterinarian within 7 days from the
date Mare is proved not to be in foal or loses her foal. Failure to provide notification as set forth above
shall void the live foal guarantee.
b. This live foal guarantee shall not cover death of the foal due to neglect or deliberate destruction except for
humane euthanasia.
c. The live foal guarantee shall be void if mare is abused, participates in a race, race training or racing event,
or otherwise participates in hazardous/strenuous activity after being pronounced safe in foal.
d. Booster rhino pneumonitis vaccinations must be administered at the 5 th, 7th, and 9th months of pregnancy as
the Mare progresses through her pregnancy. Failure to do this will void the live foal guarantee.
e. Live foal guarantee applies only if Mare is checked in foal by a licensed veterinarian.
f. Mare Owner understands and agrees that Sam and Dawn Preuss and Cowboy’s Dream Ranch shall not be
held liable for the loss, abortion or death of any foal.
g.
A Breeder’s Certificate will be issued to the Mare Owner(s) after all expenses are paid, in full, and upon notification
of the birth of the foal.

It is further agreed that should the stallion die, be sold by the Owner(s), or become unfit for service prior to settling
the mare, that 100% of the breeding fee will be refunded, if it has been paid in full, thereby canceling this entire
contract. This refund will consist of the paid stud fee ONLY, which is a TOTAL of $700.00, and will NOT include
any money spent by the Mare Owner(s), for AI and /or Shipping, nor any other costs the Mare Owner(s) may have
incurred. If the mare dies or becomes unfit to breed, before being pronounced, “Safe in foal”, by a licensed
veterinarian, and witness of same verified by a licensed veterinarian and sent by Certified Letter, Return Receipt
Requested, the Stallion Owner(s)/Manager will accept another mare as a replacement. A replacement mare must be
selected, and presented for breeding, with all proper documents and health matters taken care of, as required in this
contract for the original mare, in either the same year as this contract was issued into, or NO LATER than the
IMMEDIATELY following year, otherwise the offer of the accepting a replacement mare will be rendered NULL
and VOID.

Responsibility for insurance and risk of loss passes to the Mare Owner(s) with this contract. Owner(s) assumes the
unavoidable risks inherent in all horse related activities, including, but not limited to the semen, shipping container,
Mare Owner(s)’s horse, mare Owner(s) and Mare Owner(s)’s family members. Mare Owner(s) agrees to look solely
to his or her insurance for compensation for any such loss, and further agrees to indemnify and hold harmless, the
Stallion Owner(s)/Manager, his or her family, and employees. In addition, Cowboy’s Dream Ranch and/or Fayette
County Veterinarian Clinic are not responsible for lost, delayed, or damaged semen and makes no representatives or
warranties of any kind with respect to semen, except that it is the stallion’s and it is viable semen at time of
shipment.
10. This contract cannot be assigned or transferred and constitutes the entire agreement between the parties. No other
agreements or promises, verbal or implied, are included unless specifically stated in the written Contract.
11. Mare Owner(s) warrants being the owner or a duly authorized agent of the designated mare and acknowledges to
have had sufficient opportunity to read this entire document and understands the content. Once signed, this Contract
will then be binding on both parties subject to the above terms and conditions.
12. This Contract is entered into, and shall be interpreted and enforced under, the laws of the State of Texas. Should it
be necessary for Breeder to employ an attorney to enforce any of the terms of this Agreement, including collection
of money owed, Mare Owner(s) shall pay all reasonable attorney’s fee, costs of suit and other expenses reasonably
related to enforcing this Agreement.
