In pursuance of their powers under the above Acts and Order the County Council as Local
Planning Authority CONSENT to:PROPOSAL: Listed Building Application - Alteration to previously approved conservatory
to amend glazed roof to slate roof
LOCATION: Greystones, Upper Bryn Coch, Mold, CH7 4AE
In accordance with the particulars and plans comprising your application received
completed on 29 October 2013. Subject to the attached conditions.
1. The works to which this consent relate must be begun not later than the expiration of
five years beginning with the date on which the consent is granted.
REASON: To comply with Section 18 of the Planning (Listed Buildings and Conservation
Areas) Act, 1990.
2. The development hereby permitted shall be carried out in accordance with the plan(s)
and specifications, (which are listed in the 'Notes to Applicant' below), unless specified
otherwise by the conditions of this permission, or otherwise agreed in writing by the
Local Planning Authority.
REASON: To ensure that the development is carried out in accordance with the approved
details.

The roofing materials (slate) to be used for the consevatory hereby approved shall
match those used for the extension as approved under reference 052111(Section 19
application for the continuance of development without compliance with precommencement conditions imposed under Listed Building Consent 049404).

REASON: For the avoidance of doubt and in order to ensure that the architectural /
historic character of the building is maintained and that the proposed works do not
compromise the special architectural and historic character of the property, in accordance
with policy HE2 of the Flintshire Unitary Development Plan.
4. Notwithstanding the details hereby approved the woodwork to be painted in an
appropriate heritage colour, samples of which to be submitted to and approved in writing
by the Local Planning Authority, within two months of the date of this decision notice.
Development to be carried out in accordance with the approved details.
REASON: In the interests of visual amenity and in order to ensure that the architectural /
historic character of the building is maintained and that the proposed works do not
compromise the special architectural and historic character of the property, in accordance
with policy HE2 of the Flintshire Unitary Development Plan.
5. All stonework shall be carried out in accordance with the detail shown in the attached
photograph, details of the mortar mix to be used shall be submitted to and approved in
writing prior to the commencement of any stonework. Development shall be car ried out in
accordance with the approved details.

the above specified plans and the conditions referred to upon this certificate of decision. If
any amendments are proposed, you should NOT proceed without first obtaining the
written approval of the Local Planning Authority.

3. Any development carried out without compliance with the plans and particulars
approved and the conditions of this permission, may be liable to enforcement action. You
are also advised that separate approval under the Building Regulations and/or a licence
under the Environmental Health Regulations may be required. Further advice on this may
be obtained from the relevant department of the County Council.

STATUTORY PROVISIONS & NOTES APPEALS TO THE WELSH GOVERNMENT
1. If the applicant is aggrieved by the decision of the County Planning Authority to refuse
listed building consent for the proposed works, or to grant consent subject to conditions,
he may by notice served within six months of receipt of the enclosed decision, appeal
to the Welsh Goernment in accordance with Section 20 of the Planning (Listed Buildings
and Conservation Areas) Act 1990. The Welsh Government has power to allow a longer
period for the giving of a notice of appeal and may exercise this power in cases where
they are satisfied that the applicant has deferred the giving of notice because negotiations
with the County Planning Authority in regard to the proposed works are in progress.
2. Notice of Appeal, should be given on the prescribed form, obtainable from the Welsh
Government, Planning Inspectorate, Crown Buildings, Cathays Park, Cardiff. CF10 3NQ.
(Tel. 02920 825670 Fax: 02920 825150). Should the appellant wish the Welsh
Government to appoint a Welsh speaking inspector to hear any appeal against the County
Planning Authority's decision, such request should be made to the Welsh Government
when Notice of Appeal is lodged.
3. PURCHASE NOTICES
If listed building consent is refused, or granted subject to conditions, whether by the
County Planning Authority or by the Welsh Government and the owner of the land claims
that the land has become incapable of reasonably beneficial use in its existing state and
cannot be rendered capable of reasonably beneficial use by
the carrying out of any works which have been or would be permitted, he may serve on
the County Planning Authority, a listed building purchase notice requiring the Council to
purchase his interest in the land in accordance with the provisions of Section 32 of the
Planning (Listed Buildings and Conservation Areas) Act 1990.
4. COMPENSATION
In certain circumstances, a claim may be made against the County Planning Authority for
compensation, where permission is refused or granted subject to conditions by the Welsh
Government on appeal or on a reference of the application to them. The circumstances in
which such compensation is payable are set out in Section 27 of the Planning (Listed
Buildings and Conservation Areas) Act 1990.
5. GENERAL
The enclosed decision relates to listed building control only and does not cover any other
statutory provisions for which consent may be required from the appropriate authority.
