RESOLUTION NO. 2014 - 4344
A RESOLUTION AUTHORIZING THE RENEWAL OF THE
CONTRACT FOR RESIDENTIAL GARAGE COLLECTION
WHEREAS, City and Veolia ES Solid Waste Southeast, Inc., (hereinafter
referred to as “Veolia”), entered in to a Contract to provide residential garbage collection
services within the corporate limits of the City of Pell City, Alabama, which Contract became
effective on August 1, 2008, and was to expire on July 31, 2011, (hereinafter referred to as
“Original Contract”); and,
WHEREAS, on February 11, 2011, City and Veolia entered into an Agreement to
Renew or Extend the foregoing Original Contract to provide residential garbage collection
services within the corporate limits of the City of Pell City, Alabama, which Renewal Contract
became effective on August 1, 2011, and is scheduled to expire on July 31, 2014, (hereinafter
referred to as “First Renewal Contract”); and,
WHEREAS, Advanced Disposal Services Solid Waste Southeast, Inc., is the
successor in interest of Veolia ES Solid Waste Southeast, Inc., and as such assumed all the
rights, duties and responsibilities of Veolia in and to the foregoing First Renewal Contract; and,
WHEREAS, City has determined it to be wise, expedient, and in the best interest
and welfare of the citizens of the City of Pell City, to extend and renew the First Renewal
Contract for an additional one year term on the same terms, conditions, fees, and costs as that of
the First Renewal Contract; and,
WHEREAS, Advanced has agreed to the extension and renewal of the First
Renewal Contract for an additional one year term on the same terms, conditions, fees, and costs
as that of the First Renewal Contract.
THEREFORE, BE IT RESOLVED by the City Council of the City of Pell City,
Alabama, that it is in the best interest and welfare of the citizens of the City of Pell City, that the
existing First Renewal Contract providing for residential garbage collection services with
Advanced Disposal Services Solid Waste Southeast, Inc., as successor in interest of Veolia ES
Solid Waste Southeast, Inc., be extended and renewed for an additional term of one year
effective as of August 1, 2014, and expiring on July 31, 2015, on the same terms, conditions,
fees and costs as that of such existing First Renewal Contract.
RESOLVED FURTHER, that the City Manager be, and he hereby is, authorized
and directed to execute on behalf of the City, that Agreement to Renew or Extend Renewal
Contract to Provide Residential Garbage Collection Service in form and substance as that
attached hereto and made a part of this Resolution.
