Local Government Infrastructure Surtax
A RESOLUTION OF THE CITY OF PALM COAST, FLAGLER
COUNTY, FLORIDA, RELATING TO THE DISTRIBUTION
PERCENTAGES OF THE HALF-CENT LOCAL GOVERNMENT
INFRASTRUCTURE SURTAX BEING COLLECTED IN
FLAGLER COUNTY DURING CALENDAR YEAR 2012;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
CONFLICTS; PROVIDING FOR IMPLEMENTING ACTIONS
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Palm Coast, Flagler County, Florida,
adopted Resolution 2002-17 on June 4, 2002, imposing a Local Government Infrastructure
Surtax on all authorized taxable transactions occurring within Flagler County as authorized
by Section 212.055(2), Florida Statutes; and
WHEREAS, said Resolution stated that the Local Government Infrastructure
Surtax Resolution would be imposed only upon the approval by the citizens of Flagler
County at a referendum election; and
WHEREAS, said referendum election took place and the half-cent Local
Government Infrastructure Surtax was approved by the majority of voters; and
WHEREAS, on November 18, 2002, the City of Palm Coast entered into an
interlocal agreement between Flagler County, Beverly Beach, Bunnell, Flagler Beach and
Marineland regarding the use and distribution of the half-cent Local Government
Infrastructure Surtax Resolution.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PALM COAST, FLORIDA, THAT:
SECTION 1. ESTABLISHMENT OF ALLOCATION PERCENTAGES. The
City Council of the City of Palm Coast, Flagler County, Florida, establishes the distribution
of the funds collected by the half-cent Local Government Infrastructure Surtax during
calendar year 2012 by utilizing the formula setout in the interlocal agreement as follows:

SECTION 2. SEVERABILITY. If any section or portion of this Resolution
proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or
impair the validity, force, or effect of any other section or part of this Resolution.
SECTION 3. CONFLICTS. All resolutions or parts of resolutions in conflict with
any of the provisions of this Resolution are hereby repealed.
SECTION 4. IMPLEMENTING ACTIONS. The City Manager is hereby
authorized to take any actions necessary to implement the action taken in this Resolution.
SECTION 5. EFFECTIVE DATE. This Resolution shall take effect immediately
upon adoption by the City Council.
