HORSEBACK RIDING AGREEMENT (Hunting Trip)
This Horseback Riding Agreement ("Agreement") is made on __________________, 20__
between _____________________ ("Hunter") and Tererro General Store and Riding Stables, Inc.
("Stables").
Hunter is participating on a hunting trip and will be riding a horse furnished by Stables. The
hunting trip will occur from ______________, 20__ to _______________, 20__. Hunter agrees to
comply with all rules, regulations and laws governing hunting during this trip. Hunter states that Hunter
has the following experience regarding horseback riding:
I am a beginning rider ____ I am an intermediate rider ____ I am an expert rider_____
Stables agree to provide a riding horse, bridle, blanket, and saddle for Hunter to use. Stables will
properly saddle the horse for Hunter. Stables will show Hunter how to saddle the horse and how to check
the cinch of the saddle and Hunter agrees that prior to mounting the horse and each time Hunter
dismounts and remounts the horse, Hunter will check the cinch to make sure that it is tight.
Stables will give Hunter a horse that is suitable for Hunter, based upon the experience of Hunter as
indicated above. Hunter understands and recognizes that horses are unpredictable and that a horse may
act contrary to the way Stables might expect it to act based upon Stables' prior experience with the horse.
There are many things that may scare or "spook" a horse and a spooked horse may buck, jump, kick, bite,
run, or throw Hunter. Some examples of the things that may spook a horse include loud noises, gunshots,
insects, cars, motorcycles, aircraft, animals, birds, raincoats, ponchos, clothing, lightening, thunder, snow,
rain, hail, fire, smoke, rocks, streams, springs, water, bridges, culverts, logs, fences, gates, barbed wire,
people, or even other horses. Hunter recognizes that horses may bite and kick other horses or people.
Hunter understands that Stables cannot be responsible for any occurrence or incident based upon the
unpredictable nature of horses or a spooked horse even if the occurrence or incident may not be included
in the above list. Hunter agrees to watch out for and be careful with respect to any incident or occurrence
which may cause a horse to scare or spook.
Stables has not and does not maintain the trail over which the hunting trip will travel. There may
be logs, large rocks, tree branches or other items extending into the trail, and Hunter agrees to watch out
for and avoid such obstructions. If Stables provides a wrangler or guide, Hunter agrees to follow the
instructions of the wrangler or guide throughout the hunting trip and understands that the wrangler or
guide may terminate the hunting trip at any time.
Hunter states that Hunter has not consumed any alcoholic beverage or other intoxicating
substances prior to commencing each horseback ride on the hunting trip and Hunter will not consume any
alcoholic beverage or intoxicating substance during any horseback ride. Hunter will not smoke or ignite
any flammable substance while mounted on a horse or in the vicinity of any horse. Hunter will not
discharge any firearm while mounted on a horse or in the vicinity of any horse.
Hunter and Stables agree that all disputes and matters arising under, in connection with or incident
to this Agreement shall be litigated, if at all, in and before a Court located in the State of New Mexico to
the exclusion of the Courts of any other state or country. Hunter and Stables agree that the performance of
this Agreement and all matters of interpretation and construction of this Agreement shall be governed by
the laws of the State of New Mexico.
