ORDER
The Delhi Medical Council through its Disciplinary Committee examined a Shri Ajit Singh
Pannu C/o. Shri M.P. Gargi, Flat No. 503, Plot GH – 31, Sidhartha Society, Sector-56,
Gurgaon, Haryana – 122003 (referred hereinafter as the complainant), forwarded by
Directorate of Health Services, alleging medical negligence on the part of doctors of Kalra
Hospital, in the treatment administered to complainant’s wife Nirmal Kaur Pannu (referred
hereinafter as the patient) at Kalra Hospital, Kirti Nagar, New Delhi – 110015(referred
hereinafter as the said Hospital).
The Order of the Disciplinary Committee dated 27th September, 2013 is reproduced hereinbelow :“The Disciplinary Committee of the Delhi Medical Council examined a

Sidhartha Society, Sector-56, Gurgaon, Haryana – 122003 (referred
hereinafter as the complainant), forwarded by Directorate of Health
Services, alleging medical negligence on the part of doctors of Kalra
Hospital, in the treatment administered to complainant’s wife Nirmal
Kaur Pannu (referred hereinafter as the patient) at Kalra Hospital, Kirti
Nagar, New Delhi – 110015(referred hereinafter as the said Hospital).
The Disciplinary Committee perused the complaint, reply thereto of Dr.
R.N. Kalra, Medical Director, Kalra Hospital made to the Directorate of
Health Services, Govt. of NCT of Delhi, joint written statement of Dr.
Sameer Kalra and Dr. Rajiv Bhatt, Medical Superintendent, Kalra
Hospital, copy of medical records of Kalra Hospital and other documents
on record.

Neither the complainant Shri Ajit Singh Pannu nor Dr. Jatindar
Chowdhary appeared before the Disciplinary Committee.
The crux of the allegation of the complainant is that his wife late Nirmal
Kaur Pannu who was admitted in Kalra Hospital on 17th December, 2011
with head injury, developed urinary tract infection, as the same was not
treated during her admission, due to negligence of dotors of Kalra
Hospital, and the same caused her demise.
Dr. Samir Kalra and Dr. Rajiv Bhatt, Medical Superintendent, Kalra
Hospital in their joint written statement averred that the patient was not
having urinary tract infection till the date of her discharge as her urine
c/s conducting on 25th December, 2011 was found sterile and her blood
c/s report dated 24th December, 2011 were found having no growth.
Her TLC was 10500 under limit on 25th December, 2011.

It is also clarified further that as
antibiotics were being used for the treatment of the ailment of the
patient, urine culture would not have yielded any specific positive report
as antibiotics would have taken care of any positive development during
her hospitalization here. As far as outcome of pus cell of 10-12 of urine
R/E on 18th December, 2011, it is clarified that it could have been due to
long interval of urine pass which might also have resulted in output of
turbid of looking urine and not as a urine infection. The patient was not
having any serious urine infection during her treatment here.
The CT
scan of head, urine examination, blood test, LFT test, hematology, chest
x-ray , ECG, electrolytes examination were carried out w.e.f. 17th
December, 2011 to 24th December, 2011 which were essential to decide
the course of medical attention to the rendered to the patient.
It is
further averred that there is no cause to prove that the patient went into

septic shock because of gross negligence of Dr. Sameer Kalra, Dr.
Jitender Chaudhary and Kalra Hospital.
Both the doctors and Kalra
Hospital treated the patient to manage further deterioration of the
magnitude of the condition of her diagnosis i.e. acute subdural
hematoma left parietal region, SAH along Ant. inter hemispheric fissure
and
successfully acted in
deliverance
of
the required etiological
management of the same to the full satisfaction acted in deliverance of
the required etiological management of the same to the full satisfaction
of the patient and her attendants proving further not indulgence in any
act to deteriorate the magnitude of the management of the medical
attention. And, therefore, there is no cause to prove that they inflicted
infection to the patient to further deteriorate her condition, therefore,
there is no cause to admit that their doctor behaved inhumanly,
unethically and betrayed the oath of becoming a professional doctor
having concern, care, compassion that fades away the pain, anxiety and
helpless of every ailing person to be render medical attention by them.
Under such purview, the patient did not pass away due to the medical
attention, she got in Kalra Hospital and latter is not responsible,
therefore, for her death.
There were no unwarranted so called illegal
and callous acts committed by both the doctors and Kalra hospital, who
successfully managed to stop further deterioration in the condition of the
ailments which the patient was suffering from and the patient was
discharged from Kalra hospital in stable condition with no complaint
either from the patient or her attendants including the complainant.

In view of the above, the Disciplinary Committee observed that the urine
culture did not reveal any organism, and the patient was on antibiotics
while on treatment in the hospital and during discharge her total
leukocyte counts were normal and the patient was sent on antibiotics.
In light of the observations made herein-above, it is the decision of the
Disciplinary Committee that no medical negligence can be attributed on
the part of doctors of Kalra Hospital, in the treatment administered to
complainant’s wife Nirmal Kaur Pannu at Kalra Hospital.
Complaint stands disposed.”
