BILL AS INTRODUCED 2006 1 S.309 Page 1 S.309 2 Introduced by Senator Campbell of Windsor District 3 Referred to Committee on 4 Date: 5 Subject: Health; pharmaceuticals; wholesale; licensure 6 Statement of purpose: This bill proposes to require wholesale drug distributors 7 to maintain a drug pedigree identifying the chain of distribution of the drug. 8 9 AN ACT RELATING TO PRESCRIPTION DRUG PEDIGREES It is hereby enacted by the General Assembly of the State of Vermont: 10 Sec. 1. 26 V.S.A. § 2068 is amended to read: 11 § 2068. REQUIREMENTS; APPLICANTS; LICENSEES 12 13 An applicant shall satisfy the board that it has, and licensees shall maintain, the following: 14 (1) Acceptable storage and handling conditions plus facilities standards. 15 (2) Minimum liability and other insurance as may be required under any 16 17 applicable federal or state law. (3) A security system which includes after hours, central alarm or 18 comparable entry detection capability, restricted premises access, adequate 19 outside perimeter lighting, comprehensive employment applicant screening, 20 and safeguards against employee theft. www.leg.state.vt.us BILL AS INTRODUCED 2006 1 S.309 Page 2 (4) An electronic, manual or any other reasonable system of records, 2 describing all wholesale distributor activities governed by this subchapter for 3 the two-year period following disposition of each product which shall be 4 reasonably accessible, as defined by the board by rule, during any inspection 5 authorized by the board. Inventories and records of all transactions regarding 6 the receipt and distribution or other disposition of prescription drugs, including 7 pedigrees for all prescription drugs described by section 2068a of this title that 8 leave the normal distribution channel. 9 (5) Officers, directors, managers, and other persons in charge of 10 wholesale drug distribution, storage, and handling, who shall at all times 11 demonstrate and maintain their capability to conduct business according to 12 sound financial practices as well as state and federal law. 13 (6) Complete, updated information about the applicant or licensee, 14 which shall be provided the board. The information shall include all pertinent 15 ownership and other key personnel and facilities information deemed 16 necessary, by the board, for enforcement of this subchapter. Any changes in 17 such information shall be submitted at the time of license renewal or within 12 18 months from the date of such change, whichever occurs first. 19 (7) Written policies and procedures which assure reasonable wholesale 20 distributor preparation for, protection against, and handling of any facility 21 security or operation problems, including those caused by natural disaster or www.leg.state.vt.us BILL AS INTRODUCED 2006 S.309 Page 3 1 government emergency, inventory inaccuracies or product shipping and 2 receiving, outdated product or other unauthorized product control, appropriate 3 disposition of returned goods and product recalls. 4 5 6 (8) Sufficient inspection procedures for all incoming and outgoing product shipments. (9) Operations in compliance with all federal requirements applicable to 7 wholesale drug distribution. 8 Sec. 2. 26 V.S.A. § 2068a is added to read: 9 § 2068a. PEDIGREES 10 (a) Each person who is in possession of a pedigree for a prescription drug 11 shall affirmatively verify before distribution of a prescription drug that each 12 transaction listed on the pedigree has occurred. 13 14 (b) The pedigree shall include: (1) All necessary identifying information concerning each sale in the 15 chain of distribution of the product from the manufacturer, through acquisition 16 and sale by any wholesale distributor, until final sale to a pharmacy or other 17 person dispensing or administering the drug. At minimum, the necessary chain 18 of distribution information shall include: 19 (A) The name, address, telephone number, and if available, the e- 20 mail address, of each owner of the prescription drug, and each wholesale 21 distributor of the prescription drug; www.leg.state.vt.us BILL AS INTRODUCED 2006 1 2 S.309 Page 4 (B) The name and address of each location from which the product was shipped, if different from the owner’s; 3 (C) Transaction dates; and 4 (D) Certification that each recipient has authenticated the pedigree; 5 6 and (2) The name of the prescription drug, the dosage form and strength of 7 the prescription drug, the size of the container, the number of containers, the 8 lot number of the prescription drug, and the name of the manufacturer of the 9 finished dosage form. 10 11 12 13 14 15 (c) Each pedigree shall be: (1) Maintained by the purchaser and the wholesale distributor for three years from the date of sale or transfer; and (2) Available for inspection or use within two business days upon a request of an authorized police officer. (d) The pharmacy board shall adopt rules and a form relating to the 16 requirements of this subsection no later than 90 days after the effective date of 17 this section. 18 Sec. 3. STUDY 19 The pharmacy board shall study the feasibility of an electronic pedigree 20 system and shall report the findings and recommendations no later than 21 January 15, 2007.
