This agreement is made between Scott and Heidi Mobley of Sanger, Texas hereinafter known as the BREEDER, and
________________________________, hereinafter known as the PURCHASER (S). This agreement regards the
sale of the purebred Australian Shepherd described as: _________________________________________

Dam: Western Hills My Candy Girl Los Suenos DNA-VP , CGC "Sugar"
Part 1 – Conditions of Agreement
Purchaser Promises
1. To notify breeder immediately if purchaser cannot keep said dog for ANY reason. Breeder will have first
right of refusal if for any reason purchaser cannot keep said dog, the dog will be returned to the breeder
(will not be sold, traded, given away in part or in whole, or relinquished to a pound, shelter or rescue). All
costs to return the dog to the breeder will be paid by the purchaser. If dog is placed, it will be at the
agreement of the breeder and purchaser, and then all information will be forward to the breeder.
2. To notify breeder of change of address or telephone number.
3. To register dog with the American Kennel Club and the Australian Shepherd club, and to use the prefix
Western Hills in the dog’s registered name. Prefix must appear as the first word in the name.
4. Purchaser agrees to abide by the rules and regulations of the American Kennel Club and the Australian
Shepherd club regarding said animal and to remain in good standing with AKC and ASCA.
5. The buyer certifies by signing this contract, that the puppy will live with the owner, be confined by a
fenced yard, will have adequate exercise, nutritious food, and necessary health care, including necessary
vaccinations and heartworm prevention. This animal is not to ride in the back of a truck unless in a crate at
anytime.
6. To notify breeder of ANY/ALL titles obtained by this dog in ANY venue.
7. The buyer agrees to train, condition and show the dog in ASCA and AKC for conformation and/or
performance titles. While good faith effort has been made to provide Show/Performance and/or Breeding
quality dog, no guarantee exists pertaining to the future show success, potency, or breeding results of this
animal.
Breeder Promises
1. The Breeder guarantees that the said puppy is in good health at the time of transfer. The puppy has been
vaccinated and dewormed regularly if fecal was positive for parasites (see accompanying health record).
Note: Immunity to diseases such as Parvo and Distemper, even with appropriate vaccinations, is a risk
prior to three to four months of age. It is the buyer’s responsibility to continue vaccinations and keep the
puppy safe from exposure to such diseases. The owner agrees to have the puppy examined by a
Veterinarian within 72 hours of this agreement. If the puppy is determined to be in poor health the puppy
must be brought back to the seller for full refund of money with a statement from the Veterinarian.

To refund the difference in price between a competition dog and a pet, in the amount of $______, if
competition dog develops any of the heritable defects listed below, or is found to be unsuitable for
breeding before forty-eight (48) months of age (if sold as breeding potential). Unless here said dog has
produced a litter either willfully or un- willfully. Dog will be classified as a pet and buyer has 30 days to
spay/neuter dog. Veterinarian proof must accompany request for refund.
Heritable defects include: Hip/Elbow Dysplasia (any OFA reading below fair), heritable ophthalmic
defects or blindness, blood clotting disorders, epilepsy or seizures, severe thyroid dysfunction,
reproductive anomalies in males and any disqualifying faults under the AKC/ASCA Breed Standard for the
Australian Shepherd. These guarantees do NOT cover problems caused by diet, hormonal additives, drug
treatments, environment, accident, or buyer’s inexperience. The buyer is fully aware of the inherent
epilepsy risk in this cross and is willing to accept responsibility for possible future problems that the dog
may develop. If the dog does develop epilepsy, buyer is willing to keep, care for, and spay or neuter the
dog and seller will warrant dog under the conditions above.

Co-owned dogs – To sign off the dog’s papers if he/she is not “breeding” quality and /or after the dog is
altered. A veterinarian’s receipt will be produced before Breeder will sign off the AKC and ASCA papers.
Part II – Additional conditions for dog sold as non-breeding dogs.
1. All puppies sold as non-breeding will be sold with limited registration in both AKC and ASCA.
2. Purchaser promises to have dog spayed or neutered by 12 months of age unless growth plates have not
closed and to send a copy of the veterinarian’s proof of sterility to the breeder.
3. Dog will NOT be used for breeding at anytime prior to this operation. Any get produced by dog either
willfully or by accident will be cause for immediate void of contract on dog by breeder. There will be no
compensation for a dog under this condition and a $2000.00 fine will be paid to the breeder.
Part III – Additional conditions for dog sold as a Breeding Prospect animal.
1. Dog will not be bred until the following conditions have been met.
1. OFA certification on hips and elbows.
2. Clear eye exam by a veterinary ophthalmologist – Yearly
3. All current testing recommend via ASHGI for breeding.
4. Dog has obtained an ASCA Championship or ASCA OPEN performance title: Agility, Obedience, or
Herding (sheep or cattle).
5. Dog is at least 48 months of age
Dog will not be used for breeding while it is co-owned by the breeder without breeder consent. Any get
produced by this dog either willfully or by accident while it is co-owned by the breeder will be placed with
out AKC or ASCA reg. papers and will only be placed on alter agreements. Willful use of dog for breeding
while it is co-owned by the breeder will be cause for immediate void of all contract of dog by breeder.
There will be no compensation for a dog under this condition. Dog will be forfeited back to breeder/coowner and a fee of $2000.00 will be paid to the breeder.
2. Purchaser agrees to breed to ONLY clear stock as outlined in Part III (1-5)
3. On ALL male dogs- Breeder will obtain unlimited breeding (at no expense to the breeder) on all stud dogs.
Limited to bitches owned, co-owned, or leased by breeder. If co-owned pup is a bitch, breeder will be
entitled to 1 puppy (2nd pick) from breeding of their choice (not to exceed 3 rd litter) at no expense to the
breeder. Breeder will pay shipping of picked puppies. Breeder will then sign off co-ownership of said bitch
when all terms of this contract are met.

Purchaser agrees to place puppies in loving homes and with limited registration as necessary.

Purchaser will NOT use said dog or any of its offspring in ANY Miniature or Toy Australian Shepherd
breeding program. If purchaser uses said dog in those breeding programs, dog and all paper work (signed)
will be forfeited back to breeder and a fee of $5000.00 will be paid to the breeder.
Any breech of the contract by the Purchaser will result in immediate void of this contract. Purchaser and
breeder agree that Texas State Laws apply to this contract and further agree that the place of venue if
needed, shall be Denton County, Texas.
