1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 ORDINANCE NO. 2008 WHEREAS, the State Legislature passed the Local Government Comprehensive 17 Planning and Land Development Regulation Act requiring all counties and cities to 18 prepare a Comprehensive Land Use Plan; and AN ORDINANCE OF THE CITY OF HALLANDALE BEACH, FLORIDA, APPROVING A CHANGE OF LAND USE FROM RESIDENTIAL MEDIUM DENSITY TO RESIDENTIAL HIGH DENSITY-2 FOR THE PROPOSED PROJECT REFERRED TO AS “PARK CENTRAL”, ON THE PROPERTY LEGALLY DESCRIBED AS LOTS 1 THROUGH 22 OF BLOCK 4, LOTS 1 THROUGH 22 BLOCK 5 AND LOTS 1 THROUGH 18 BLOCK 6 OF HOLLYWOOD PINES ESTATES, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 6 AT PAGE 41, OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA. 19 WHEREAS, the City of Hallandale Beach, pursuant to Florida Statutes and the 20 City of Hallandale Beach Zoning Code, has designated the Planning and Zoning Board 21 as the Local Planning Agency; and 22 WHEREAS, Application No. 35-07-PA was submitted requesting that the Future 23 Land Use Map of the Comprehensive Land Use Plan be amended to change the land 24 use of various Parcels of land from “Residential Medium Density” to “Residential High 25 Density-2” on the properties legally described in the heading of this ordinance; and 26 27 WHEREAS, after a courtesy public notice was mailed to all property owners within the affected area, and within 1,000 foot radius from the affected area; and 28 WHEREAS, after notice of a public hearing being duly published, a public 29 hearing was held before the Planning and Zoning Board, acting as the Local Planning 30 Agency, of the City of Hallandale Beach on October 31, 2007 at which hearing all 31 interested parties were afforded the opportunity to be heard; and 32 1 Ord. 2008- 33 WHEREAS, at the October 31, 2007 Local Planning Agency meeting, the Local 34 Planning Agency recommended approval of the proposed amendment to the Future 35 Land Use Map; and 36 37 WHEREAS, the City Commission on January 22, 2008 passed the proposed amendment to the Future Land Use Map on First Reading as provided herein; and 38 WHEREAS, due to the location of the application site with the City’s Urban Infill 39 District, the application is considered a small-scale amendment, and therefore not 40 subject to state and regional review. 41 42 43 44 45 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF HALLANDALE BEACH: SECTION 1. That the Future Land Use Map of the City of Hallandale Beach 46 Comprehensive Land Use Plan be amended to change the land use of various parcels 47 of land from “Residential Medium Density” to “Residential High Density-2” on the 48 properties legally described in the heading of this ordinance, and as graphically 49 displayed on the proposed Future Land Use Map attached hereto and provided herein 50 as “Attachment A.” 51 SECTION 2. That the City transmit the amendment to the Florida Department of 52 Community Affairs with an acknowledgement that the amendment is a small-scale 53 amendment as defined by Florida Statutes, and therefore not subject to state and 54 regional review. 55 56 57 58 SECTION 3. The official future land use map of the City shall be amended to reflect the above change. SECTION 4. All ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict herewith are hereby repealed, to the extent of the conflict. 2 Ord. 2008- 59 SECTION 5. If this ordinance or any part thereof is declared by a court of 60 competent jurisdiction to be invalid, such decision shall not affect the validity of the 61 remainder of the ordinance other than the part declared to be invalid. 62 63 SECTION 6.
