PARTICIPANT IN EQUINE ACTIVITIES RESULTING FROM THE INHERENT RISKS OF
EQUINE ACTIVITIES.
Release and Hold Harmless
I, the undersigned, assume all risk inherent in horse related activities, including but not
limited to property damage, bodily injury and physical harm to horse owner, handler and
spectator. I realize that all types of horse related activity is inherently dangerous (and can
even be fatal); therefore, I understand that my family member’s and my guest
participation in an “equine activity” as defined by applicable laws is wholly at my own
risk. I understand that our partition involves all inherent risk associated with the dangers
and conditions which are an integral part of equine activities including but not limited to
the propensity of an equine to behave in ways that may result in personal injury or death
to a person on or around it; the unpredictability of an equine’s reaction to sound, sudden
movement, unfamiliar objects, persons or another animal, hazards related to land
conditions (including but not limited to brush, other animals or reptiles, surface cracks,
irregularities and subsurface conditions), collision with other equines, objects or animals
and the potential of a participant to act in a negligent or unskilled manner which may
contribute to injury to the participant or others including failing or inability to maintain
control of the equine.
I agree to ASTM/VSEI certified helmet whenever I ride on property owned or leased by
Golden Curls Ranch.
I acknowledge that it is my responsibility to carry full and complete insurance coverage
for myself, my family members, my guest and my personal property (including any
equine of mine) including but not limited to medical, life and accident insurance.
I agree to assume any and all risk and damages involved in or arising from my, family
members or my guests use and/or presence upon the property and facilities owned or
leased by Golden Curls Ranch, including, without limitation but not limited to, the risk of
death, bodily injury, property damage, falls, kicks, bites, collisions with vehicles, horses
or stationary objects, fire, explosion, the unavailability of emergency medical care, or the
negligence e or deliberate act of another person.
I agree to hold Golden Curls Ranch and its mangers, members, partners, successors
assigns subsidiaries, affiliates, officers directors employees, equine instructors and agents
completely harmless from any and all expenses and costs (including attorneys fees and
costs) and not liable for any damage or liability (direct or indirect), regardless of the
cause relating to any act, omission, property condition or animal behavior while I, my
family or my guest are on the premises owned or leased by Golden Curls Ranch. I
release Golding Curls Ranch from all liability whatsoever and agree not to sue any of
them on account of or in connection with any claims, causes of action, injuries, damages,
cost or expenses arising out of my, my family members or my guests use of or presence
upon the property or facilities owned or leased by Golden Curls Ranch, including without
limitation, those based on death, bodily injury, property damage, including consequential
damages and punitive damages. I agree that I can virtually represent any minors under
my care or control on Golden Curls Ranch premises and, to the extent allowable,
releasing any claims that they may have for any damages and injuries as well.
I agree to indemnify and defend Golden Curls Ranch and its managers, members,
partners successors assigns, subsidiaries, officers, directors, employees equine instructors
and agents against, and hold harmless from, any and all claims, causes of action,
damages, judgments, cost or expenses, including medical and attorneys fees, which in
any way arise from my, my family member’s or my guests use of the property owned or
leased by Golden Curls Ranch.
I acknowledge that I have read a copy of Golden Curls Ranch Rules, and agree to abide
by same. This agreement is made and entered into the State of Texas and the County of
Kaufman and shall be enforced and interpreted by the laws of this State. Should any
cause be in conflict with State law, then the cause is null and void, but the remainder of
this agreement shall continue to be valid and enforceable. This agreement is binding on
the heirs, executors, personal representatives, administrators, and family members,
guardians, successors, assigns and dependants of the undersigned.
