BOARDING CONTRACT & AGREEMENT
PLEASE READ CAREFULLY BEFORE SIGNING

This Boarding Contract & Agreement is made between Dr. Jeffrey & Lori Menoff, doing business as Nash Hill
Equestrian Center & Menoff Family Inc., and ______________________________________________________,
owner of the horse described in Section 2 below. The above signature indicates the person who is solely
responsible for paying the board.
It is hereby agreed to as follows:
Definitions: The term “OWNER” shall herein refer to as the owner or part-owners of the animal which is
contracted to be boarded under this agreement.
The terms “HORSE” and “ANIMAL” shall herein after refer to all equine species and also to the specific animal to
which this agreement refers. The terms “BOARD” and “BOARDING” shall herein refer to the provisions for
compensation of daily routine food and physical space for the animal by a party who does not generally have a
financial interest in the animal.
The term “RIDER” shall herein refer to a person who rides a horse mounted or otherwise handles or comes near
a horse from the ground. The term “I”, “Me” or “My” shall herein refer to the owners and the parents or legal
guardians there of if a minor.
AGREEMENT PURPOSE & CONSIDERATION: At the commencement of this agreement the OWNER agrees to
pay all bills prior to removing the horse from the premise. Boarder’s Initials: ____________________.
OWNER DISCLOSURE OF INFORMATION ABOUT THE HORSE TO BE BOARDED BY THIS STABLE IS
HEREBY STATED AS FOLLOWS:
1. Term.
(a) The term of this Boarding Agreement shall begin on (date): ___________________________, 20___
Termination Agreement at any time without notice: Any termination of the Boarding Agreement is with the
understanding that any outstanding fees will be due and payable immediately and that in no case will
any fees be refunded for unused boarding time.

3. Ownership.
Owner warrants that he/she owns the above-described horse free and clear, is at least 18 years old, and
has the right to execute this Boarding Agreement. Owner’s Initials: _____________________.
4. Requirements prior to commencement of boarding.
Owner will provide Nash Hill Equestrian Center/Menoff Family Inc. with the following for each horse to be
boarded:
A. A signed waiver of liability for any other person (not including trainers/employees of Nash Hill or
immediate family members: mother, father, siblings, legal spouse and children) that will be riding or
handling Owner’s horse.
I agree all persons’ who come to handle my horse in any capacity and/or to ride my horse will sign a
liability waver prior to riding/handling my horse releasing Dr. Jeffrey & Lori Menoff, Nash Hill Equestrian
Center, Menoff Family Inc. and any and all persons associated with the facility from any responsibility
including injury or death. Should someone not sign a liability waiver, I agree not to allow them to handle
my horse and if they do and an injury/death results, I agree that I, the owner, am solely responsible for
any damage, injury or death or any other circumstances that result in litigation.
Minors riding/handling horses must have a parent/legal guardian sign the release and be present while
riding. Nash Hill Helmet Policy: Helmets are mandatory for anyone up to age 19 and under to ride on the
premises.
I agree I am responsible for enforcing the provisions of this policy and for the health, safety and
well-being of any guests I bring to any property owned by Dr. Jeffrey & Lori Menoff, dba Nash Hill
Equestrian Center.

5. Consideration/Payment.
Owner shall pay a monthly boarding fee of a $291.67 (Board) plus $23.33 (Sales Tax) for a total of
$315.00 due on the first (1st) of each month for each horse boarded. This boarding fee does not include riding
lessons, training, or extra services (such as holding for veterinary, dentist, farrier appointments or extra care such
as bandaging wounds) etc. Nash Hill Equestrian Center/Menoff Family Inc. will provide Owner with a monthly
invoice which will include the board amount and any other charges. Disputes may be addressed to the office.
Full Payment is expected by cash, check, certified check, or money order, made payable to MENOFF
FAMILY INC. or credit card with a service/processing fee by the (1st) first of the month each month.
There will be a minimum late fee of $5.00 on any past due balances assessed at the end of each month for any balances
that are not paid in full by the end of the current month.

This stable’s fee schedule may change at any time. If a change becomes necessary Nash Hill Equestrian Center
owners/staff will notify current boarders by letter posted on the bulletin board by the indoor arena.

THE BOARDING FEE INCLUDES:
(1) 1 Box Stall
(2) Feeding. Horses will be fed hay two to three times per day consisting of any combination of this stable’s
hay and grain. All feeding instructions will be posted on the stall card located on the stall door. Owners,
(or their chosen representatives), must sign all stall cards to agree with feeding instructions.

(3) Stall cleaning. All stalls are cleaned and fresh shavings added as needed.
(4) Tack Room: Owner is provided a locker and saddle rack in the tack room for personal equipment.
Arrangements for larger equipment can be made with the staff. It is HIGHLY RECOMMENDED you LOCK
YOUR THINGS UP. Nash Hill owners and employees are not responsible for any lost or stolen items.
(5) Arena’s (Indoor/Outdoor) and Round Pen
(6) Wash Racks: both indoor and outdoor
(7) Kitchenette and bathrooms
(8) Turn outs
(9) Obstacle course (NOTE: Please refrain from using course if it is wet unless given permission by staff.)
THE BOARDING FEE DOES NOT INCLUDE:
(1) Damage to Nash Hill Equestrian Center/Menoff Family Inc.’ property. Any damage caused either directly
or indirectly by Owner’s horse to Nash Hill Equestrian Center/Menoff Family Inc. property, including, but
not limited to, stalls, fences, tack, equipment, etc. must be paid for by Owner before the horse is removed
from Nash Hill. Nash Hill will notify the Owner of the damage and provide an invoice for the damage.
Owner agrees to pay in full the fees and charges billed by the contractor of Nash Hill’s choice. Owner’s

(2) Veterinarian/Dental/Farrier or other similar care. These services must be paid for by Owner. Owner
should be on-site during the visit. There will be a $10.00 fee (additional charges may be assess if
more than one person is needed to assist) charged to the Owner’s next boarding invoice if Nash Hill
staff is required to assist with veterinarian/dental/farrier services.

I understand I realize that in the event of an emergency Nash Hill staff will call me first, then my
trainers and emergency contact numbers and my veterinarian in that order.
Example: Your horse begins to colic and our staff catches it early in the process. Our staff will call you. We
will also call the emergency numbers & trainers if we are unable to reach you. If the person/persons
responsible for treating your horse are not immediately available we will call the vet.
Our Staff will NOT provide anything other than what is listed on the stall card if you check this box.

(3) Medicines. Nash Hill Equestrian Center/Menoff Family Inc. will not administer routine medicine to your
horse that has been prescribed by a veterinarian or other horse care practitioner unless the appropriate
box is checked above. Arranging for the purchase and shipment of such medicine, as well as monitoring
supplies, is Owner’s responsibility.
We will only provide this service by written instructions from owner(s).
(4) Supplements. Nash Hill Equestrian Center/Menoff Family Inc. will feed supplements per instructions listed
on the stall card. However, arranging for the purchase and shipment of such medicine, as well as
monitoring supplies, is Owner’s responsibility.
We will only provide this service by written instructions from owner(s).
(5) Special hay and/or grain. If you do not want your horse fed the house hay or grain, Nash Hill Equestrian
Center/Menoff Family Inc. will feed your horse any hay or grain you provide. However, arranging for the
purchase and shipment of such hay or grain, as well as monitoring supplies, is Owner’s responsibility.
There is no reduction in board if you bring your own grain/hay.
We will only provide this service by written instructions from owner(s).
(6) Riding instruction. Nash Hill Equestrian Center/Menoff Family Inc. provides a variety of riding instruction
and lesson packages for a separate fee.
(7) Training. Nash Hill Equestrian Center/Menoff Family Inc. can provide training for Owner and Owner’s
horse for a separate fee.
THIS STABLES RIGHT TO REFUSE BOARD: We reserve the right to deny boarding and services to any horse
for any reason including but not limited to: animals poor health or unsoundness, dangerous propensities, habits,
vices which this stable is not equipped to handle; owners’ refusal to obey stable rules or to cooperate with this
stable on reasonable requests relative to the management, welfare and safety of animal and people on premises;
and also in event of discontinuation of the business of boarding horses. After all fees have been paid in full and
the animal has vacated the stall this Agreement is concluded. Should the Owner wish to return a new boarding
agreement must be signed.
7. Right of Lien.
Nash Hill Equestrian Center/Menoff Family Inc. has the right of lien for the amount due for board and any
additional agreed upon fees and services and shall have the right, without due process of law, to retain or sell
Owner’s horse to recover the outstanding balance in full. OWNERS INITIALS to agree: ________________
Board is due on the first of each month. If board is not paid in full by the end of the second month of nonpayment
(based on the due date (the first of the month each month)), we reserve the right to sell the horse to satisfy any
outstanding balance owed to us.
STEPS TO ENFORCE LEIN: On the first day of the second month your balance is not paid in full all riding
privileges will be suspended. On the first day of the third month if the balance is not paid in full the horse will be
listed for sale on our website and face book page. If the horse is still in our possession at the last day of the third
month without payment in full the horse will be auctioned. Any additional money from the sale of the horse will be
refunded.
EXAMPLE
 (Note: January Invoice sent mid-December)
- January 1: Board is due in full on January 1, but not paid by January 31
- February 1: Board is due in full, but not paid again
- February 1: Riding privileges in arenas and round pen area are suspended until the balance is
paid.
- (Note: February Invoice sent mid-February.
- February 1: Finance Charge (Minimum $5.00 late fee for unpaid January balance))
- February 28: Finance Charge on January and February past due board balances ($10.00).
- March 1: Horse will be listed for sale on our website.
- March 30: Horse will be auctioned.

I agree to all provisions of the Right of Lien policy and acknowledge that failure to pay boarding fees or other
charges as due shall entitle this stable to terminate this Agreement and to keep or sell the animal in this stable’s
possession until all fees and charges are paid in full.

8. Indemnification.
Owner acknowledges the inherent risks which are involved in riding and working around horses. These
risks may include, but are not limited to, damage to personal property, illness, bodily injury, disability, trauma, or
death resulting from a fall or while riding or being in close proximity to horses. In consideration, therefore, for the
privilege of riding and/or working around horses at Nash Hill Equestrian Center, Menoff Family Inc., Owner agrees
to indemnify and hold harmless Dr. Jeffrey & Lori Menoff & Menoff Family Inc., Nash Hill Equestrian Center, their
agents, employees, trainers, instructors, their respective heirs, or volunteers and further release them from any
liability or responsibility for any accident, damage, injury, illness, or death to Owner, Owner’s horse, Owner’s
family members or guests on the premises of Nash Hill Equestrian Center/Menoff Family Inc./Dr. Jeffrey & Lori
Menoff.
Riding Helmet Warning: Owner is hereby warned by this stable that all horse handlers and riders should
purchase and wear properly fitted and secured protective headgear (equestrian riding helmet), and that wearing
of such headgear while mounted, riding, dismounting and being around horses, may prevent or reduce severity of
some head injuries and may even prevent death happening as a result of a fall or other occurrence.
OUR POLICY: ANYONE UNDER THE AGE OF 19 MUST HAVE AN APPROVED
HELMET TO RIDE ON THE PROPERTY.

9. Risk of Loss and Insurance.
As a condition for Dr. Jeffrey & Lori Menoff, Nash Hill Equestrian Center & Menoff Family Inc. providing
the services described herein, Owner hereby agrees to solely be responsible for insuring Owner’s horse against
all insurable risks including but not limited to public liability, accidental injury, theft, death, or equine mortality
insurance. While Owner’s horse are boarded at Nash Hill Equestrian Center, either on premises or in transit, Dr.
Jeffrey & Lori Menoff, Nash Hill Equestrian Center & Menoff Family Inc. and its employees shall not be liable for
any sickness, disease, estray, theft, death, or injury which may be suffered by Owner’s horse, or any other cause
of action arising from or connected in any way with Dr. Jeffrey & Lori Menoff, Nash Hill Equestrian Center &
Menoff Family Inc. programs (boarding, training, showing, instructions etc).
All risks are assumed by Owner. Owner agrees to hold Nash Hill Equestrian Center/Menoff Family Inc. and its’
owners, employees and volunteers and anyone of its associates harmless from any loss or injury to said horse.
All costs, no matter how catastrophic, connected with boarding are borne by Owner.
In addition:
(a) Owner may maintain at his/her own expense and at all times during the term of this Boarding
Agreement insurance on his/her horse. Dr. Jeffrey & Lori Menoff, Nash Hill Equestrian Center & Menoff Family
Inc. assumes no responsibility for any loss of Owner’s horse.
(b) Owner may maintain at his/her own expense and at all times during the term of this Boarding
Agreement a policy or policies of insurance for his/her own personal property, such as any tack. Dr. Jeffrey & Lori
Menoff, Nash Hill Equestrian Center & Menoff Family Inc. assumes no responsibility for any loss of Owner’s
personal property.
(c) Owner may maintain at his/her own expense and at all times during the term of this Boarding
Agreement a policy or policies of insurance for Owner’s own injuries or illnesses. Dr. Jeffrey & Lori Menoff, Nash
Hill Equestrian Center & Menoff Family Inc. assume no responsibility for any injury or illness to Owner, Owner’s
family members or guests on the premises of Dr. Jeffrey & Lori Menoff, Nash Hill Equestrian Center & Menoff
Family Inc.

10. Transportation.
It is Owner’s responsibility to arrange for the transportation of his/her horse in the event of a medical
emergency. If no prior arrangements are made, Dr. Jeffrey & Lori Menoff, Nash Hill Equestrian Center & Menoff
Family Inc. may arrange for such transportation, but Owner will be responsible for payment of such transportation
and any additional costs such as staff time.
11. Indemnity.
Owner agrees to hold Dr. Jeffrey & Lori Menoff, Nash Hill Equestrian Center & Menoff Family Inc.
harmless from any claim caused by his/her horse and agrees to pay any/all legal fees and/or costs incurred by
Dr. Jeffrey & Lori Menoff, Nash Hill Equestrian Center & Menoff Family Inc. in defense of a claim resulting from
damage by his/her horse.
12. Standard of Care.
Owner understands that for the health and safety of all the horses Dr. Jeffrey & Lori Menoff, Nash Hill
Equestrian Center & Menoff Family Inc. requires that Owner’s horse be given certain vaccines on a yearly basis
as recommended by Nash Hill Equestrian Center veterinarian; that Owner’s horse be wormed as recommended,
and that an equine dentist check Owner’s horse yearly; and that a farrier trim and/or shoe Owner’s horse every
six to eight weeks.
13. Emergency Care.
In the event of an emergency, Dr. Jeffrey & Lori Menoff, Nash Hill Equestrian Center & Menoff Family Inc.
will make every reasonable effort to contact Owner but if Owner is not readily available Owner gives Dr. Jeffrey &
Lori Menoff, Nash Hill Equestrian Center & Menoff Family Inc., staff express permission to contact a veterinarian,
farrier, and/or other equine practitioner, and in consultation with that equine practitioner to authorize any
emergency care, including euthanasia, which may be necessary. However, Owner is responsible for paying all
costs relating to this care and Dr. Jeffrey & Lori Menoff, Nash Hill Equestrian Center & Menoff Family Inc has no
responsibility to pay for such emergency care.

14. Covenant.
Owner and any visitors/guests brought to Nash Hill Equestrian Center covenants and agree to follow the
Barn Rules.
Direct Loss to Personal Property Warning: Owner is hereby warned that while on this stable’s premises direct
loss, damage, theft or injury to owners horse, tack, equipment and any other personal possessions, trailer and
equipment is not covered by this stable’s insurance. The actual owner, having financial interest in such items
must carry his own personal property insurance under a homeowner’s, tenants or other insurance poly or under a
separate policy as in the case of the loss of a horse.

15. Termination.
This Boarding Agreement is terminated upon a breach of any material term and the non-breaching party
has the right to collect all reasonable fees, including but not limited to attorney fees, and costs from the breaching
party. Dr. Jeffrey & Lori Menoff, Nash Hill Equestrian Center & Menoff Family Inc. have the right to terminate at
any time for any reason.
16. Governing Law and Arbitration.
This Boarding Contract and Agreement shall be construed in accordance with and shall be governed by
the laws of the State of New York. The parties to this Boarding Contract and Agreement mutually agree that any
and all disputes arising in connection with this Boarding Contract and Agreement shall be settled and determined
by binding arbitration conducted in accordance with the then existing rules of the American Arbitration Association
by one or more arbitrators appointed in accordance with its rules. Any arbitration shall take place in Cattaraugus
County, State of New York.
17. Entire Agreement
This constitutes the entire Boarding Contract and Agreement between the parties. Any and all
modifications or additions MUST be in writing and signed by all parties to this Boarding Contract and Agreement.
All parties signing this Boarding Contract and Agreement covenant that they have read the entire
Boarding Agreement and agree to and understand its provisions.
