SYRIAN ARAB REPUBLIC MINISTRY OF TRANSPORT DECISION NO. / 2222 / MINISTER OF TRANSPORT: By virtue of the provisions of legislative decree no. 93 for the year 1974 including forming of ministry of transport And the provisions of legislative decree no. 50 for the year 2006 including formation of the government And the provisions of the legislative decree no. 347 for the year 1969 including formation of shipping agencies company. And the provisions of the law no. 2 for the year 2005 regarding general establishments and companies. And the outturn of the committee formed by the two decisions 267 & 269 for the year 2008 issued by shipping agencies company requested to study decision of ministry of transport no. 1419 for the year 2008 and comparing it with the tariff of shipping agencies company and preparing a new tariff project keeping general interest and company's rights. And the outturn of the administrative committee of shipping agencies company no. 4 dated 19/05/2009 And the letter of the cabinet no. 8203/1 dated 29/09/2009 by virtue of recommendation of the economic committee issued in its session no. 34 dated 14/09/2009 including authority of shipping agencies company's administration council to decide the tariff And the general interest requirements DECIDES THE FOLLOWINGS : Article 1 : Shipping Agencies Company "Shipco" shall collect from foreign non-Syrian flagged vessels and tankers calling Syrian ports and terminals the fees and commission stated hereunder in American Dollars or equivalent convertible counter value of it in foreign currency as follows: A . Agency fees from ships: "Shipco" shall collect against services rendered to vessels intended for the carriage of cargoes of various types and methods of loading and handling including container, passenger and RO/RO vessels, Agency fees as the following: Vessel's GRT Up to 2000 2001-4000 4001-6000 6001-8000 8001-10000 Exceeding 10000 Fees from foreign vessels in USD 350 USD 600 USD 950 USD 1450 USD 1850 USD 70 USD for every 1000 Fees from Syrian vessels in Syrian Pounds 9375 S.P 14375 S.P 20625 S.P 30000 S.P 37500 S.P 1375 S.P for every 1000 GRT or fraction thereof GRT or fraction thereof * Tourist passenger vessels: Shipping Agencies company shall collect $ 1200 from foreign vessels, and S.P 30 000 from Syrian vessels . *Express Passenger Vessel: Hydrofoil-Hovercraft (Shipco) shall collect $ 500 from foreign vessel and S.P 15 000 from Syrian vessel. These fees shall be reduced by 50% in case any vessel calls at one of the Syrian Ports for the purpose of visit, or to be supplied with provision, or bunker, or to be repaired and likewise and does not perform any commercial operation during her stay provided that she is granted free pratique Agency service fees on oil tankers and its derivatives: Shipco shall collect agency fees from tankers of oil and its derivatives against services rendered to them as per the following: Vessel's GRT Agency fees in USD from foreign tanker Agency fees in S.P from Syrian tanker Up to 10 000 $ 750 S.P 35 000 Exceeding 10 000 $ 30 for each 1000 S.P 1400 for each 1000 Oil tankers shall remain under submission to agency fees in accordance to their respective gross registered tonnage. Article 2 : Commission on booking of export Cargoes : Shipco shall collect a commission on booking of export general cargoes at the rate of 2% of the freight , but as for export cargoes filled in containers, Shipco shall collect a commission of 3% of the freight. Article 3 : Commission on the freight of the import or export cargoes : Shipco shall collect a commission amounting 1.50 % of the value of gross freight for import and export cargoes on board of container vessels, or on vessels carrying general cargoes and RO/RO vessels, or the commission fixed under article no. /1/ of this decision concerning agency fees which is more for its favor. Article 4 : Commission of collecting freight payable at destination: Shipco shall collect a commission on freight of import cargoes duly collected at the rate of 1% of the amount of the freight. Article 5 : Containers' tracking fees: A . Fees for tracking the movements of containers, wagons, mafies (flat containers), and trailers: Shipco shall collect against tracking the movements of containers, or wagons, or mafies, or trailers during the various stages of transport and delivery a commission amounting USD 6 per unit what so ever its size is. This commission is not collected from export containers whether they are full or empty . B . Shipco shall collect a commission of 3% on container demurrage amount effectively collected for the account of the shipping lines or ship owners. Article 6 : Supervision and control fees on barges of lash vessels (vessel carrying barges full of cargoes): Shipco shall collect against supervision and control on barges of lash vessels during their stay at the port inside the breakwater the amount of USD 135 per barge discharged from foreign vessel and S.P 6000 per barge discharged from Syrian vessel. Article 7 : Hire of discharging equipments of cargoes released on Liner Terms: In addition to the handling charges, and cranes charges collected by port companies or containers terminals as per official receipts, Shipco shall collect the amount of USD 0.25 twenty five American cents per ton or fraction from foreign vessel and S.P 10 per ton or fraction from Syrian vessel with the exception of import cargoes transported on RO/RO vessels and cargoes loaded on trailers or trucks. Article 8 : Tallymen wages: Shipco shall collect from ship owners the amount of American Cent 15 per ton or fraction thereof of inward or outward cargoes irrespective of discharging or loading terms of carriage from/to foreign vessel including container vessel and Syrian Pounds 4 from /to Syrian vessel. Article 9 : Charges of controller on vessels carrying bulk or liquid materials: Shipco shall collect daily an amount of USD 20 from foreign vessel and S.P 700 from Syrian vessel irrespective of the shipping term . Article 10 : Chamber of shipping Dues: Shipco shall collect to the favor of the Syrian Chamber of Shipping the amount fixed in their tariff issued by decision no. /261/ dated 13/02/2007 per each vessel calling under her agency. Article 11 : Various commissions and charges: Shipco shall collect from every ship or tanker calling at Syrian ports or terminals the following fees and charges per call: A . USD 300 from foreign vessel, or S.P 6000 against (mail, correspondence, local cables ,fiscal stamps, local phone calls, sundry expenses, and renewal of vessel's certificates). B . USD 50, hire of motor boat from foreign vessel, or S.P 2000 from Syrian vessel per trip upon Master's or crew member's request . C . USD 10 hire of car per hour or fraction thereof from foreign vessel, or S.P 500 from Syrian vessel upon Master's or crew member's request. D . Official cost of faxes plus 20% commission . E . 10 % of the amount of invoices covering services rendered to vessels (fresh water, provisions, ironing, washing, cleaning holds, erection of bulkheads inside the vessel's holds, recovery of ropes or packages from sea, survey report on vessels, repairs of equipments, certificates of classification and qualification and what rendered from other parties). F . Amount of USD 15 from foreign vessel, or S.P 750 from Syrian vessel for the attendance or for departure of a crew member . G . Amount of USD 15 from foreign vessel, or S.P 750 from Syrian vessel for accompanying the patient to the physician or to the hospital per a day. H . Amount of USD 100 for providing foreign vessel with bunker, or S.P 4000 from Syrian vessel . I . For services rendered to vessels by others and mentioned in the articles of this decision Shipco shall collect a commission at the rate of 10% of the total amount of the service. Article 12 : Lawsuits and compromise settlements: A . The urgent pleas, description of the status quo, and release the vessel from arrest: Shipco shall collect in additional to the effective expenses and fees for each case an amount of USD 200 from foreign vessel and S.P 7000 from Syrian vessel. The said amount includes Shipco and lawyer fees, the sundry and administrative expenses and cost of translation. Following to be added to this amount: 1 . Cost of power of attorney ,in case of arranging same. 2 . The effective cost of survey, if any. B . The sea protest : Shipco shall collect the amount of USD 100 for every sea protest from foreign vessel and S.P 3500 from Syrian vessel. This amount includes the cost of registration of this protest in the Harbor Master and the cost of its registration in the first insurance court, the following to be added to this amount: 1 . Cost of power of attorney, if any. 2 . Other effective expenses, if any. C . Compromise settlements : 1 . Customs infringement: Shipco shall collects for every customs infringement 2% of the amount of compromise settlement, provided that it is not less than USD 20 from foreign vessel and S.P 500 from Syrian vessel. 2 . Cargo Claims: Shipco shall collect for every compromise settlement 25 % of the saved amount between the original amount claimed and the amount of the compromise settlement provided that it is not less than USD 25 and not more than USD 1000 from foreign vessel, and not less than S.P 1000 and not more than S.P 35 000 from Syrian vessel. D . Other Lawsuits : Shipco shall collect for every lawsuit the following amounts: 1. Cost of power of attorney. 2. Effective cost of survey if any. 3. Judicial dues paid to the court or the directorate of finance. 4. Expenses of appeal and reappear paid to the courts. 5. The fees for the lawyer, the share of advocate funds as well as Shipco, on every lawsuit are as follows: Up to $ 15000 from foreign vessel Up to S.P 300 000 from Syrian vessel Advance fees of claimed amount 6% but not less than $ 250 6% but not less than S.P 10 000 From 15001 till S.P 25000 5% but not less than $500 Claimed amount Balance of saved amount 5% 5% 5% From 300001 till S.P 500000 5% but not less than S.P 5% 20 000 4% but not less than More than $ 25000 5% $1000 4% but not less than S.P More than S.P 500 000 5% 30000 Provided the following: A-The advance fees should not exceed USD 4000 from foreign vessel and S.P 75000 from Syrian vessel. B- The balance fees should not exceed USD 5000 from foreign vessel and S.P 100000 from Syrian vessel. E . Shipco shall collect the amount of USD 2000 as a service fees for the general average or collision. F . Shipco shall collect USD 3000 as a salvage fees from the salvaged vessel. G . Shipco shall collect from vessels calling Arwad port the amount of USD 300 from foreign vessel and S.P 5000 from Syrian vessel during their whole stay at the port. Article 13 : Commission on inward cargo for local consumption, or outward cargo: Shipco shall collect from consignees against services rendered to inward cargo for local consumption or for cargo exported from Syrian ports on board of vessels calling under her Agency : A. Commission of Agency: Kind of cargo 1 FCL containers Commission & services fees 20" feet 500 S.P 40" feet 750 S.P 2 cars carried on RO/RO vessels 100 S.P per each car 3 Trucks and rollers carried on RO/RO vessels 400 S.P per each truck or machinery/vehicle 4 wood 10 S.P per ton or cubic meter 5 Bulk cargo 8 S.P per ton 6 Other kinds of cargoes 15 S.P per ton, or cubic meter If the size of cargo is fixed on the original bill of lading, or on the manifest, Shipco shall collect agency fees on basis either of the weight or of the size which is more for her favor. B. 8 S .P per ton or fraction thereof as charges of loading/discharging equipments if same are presented by Shipco and the cargoes loaded/discharged under / FIOS / terms. C. If the container is / LCL /,Shipco shall collect commission on it on basis of ton according to item no. /5/ of paragraph / A / of the article /13 / adding 500 S.P to each B/L. Noting that a fraction of ton is considered one ton. D. customs overtime dues on loading or discharging are collected and settled according to the condition of loading/discharging shown on B/L. E. In case the vessel's agent is a different party from the agent of the shipping line who transported the cargo as per a Bill of Lading issued by him on board the vessel of said agent, Shipco shall collect a commission of agency fees at the rate of 50% of the total commission to her account and 50% to the account of the agent of the shipping line. F. Shipco shall collect the effective expenses resulting from protecting the cargo and maintaining it such as cost of tarpaulin, stuffing of the damaged cargo and packing it up to the time of receiving it by consignees or by receivers, and these expenses are collected from receivers what so ever the condition of discharge is. G. 500 S.P against issuing any correction letter. H. 500 S.P against issuing any export B/L . Article 14 : Commission on import cargoes whose destination is free zone or outward transit: Shipco shall collect from consignees against services rendered to cargoes discharged at Syrian ports with the destination of free zone, or international transit, or to cargoes exported on vessels as per customs declarations except what is exported as per customs declarations /B7/ the following: A . Agency's commission: Services fees and commission Kind of cargo 1 FCL containers 20" feet 20 $ 40" feet 35 $ 2 cars carried on RO/RO vessels $ 8 per each car 3 Trucks and trailers carried on RO/RO vessels 4 Wood 5 Bulk cargo $ 0.15 per ton 6 Other kinds of cargoes $ 0.85 per ton or cubic meter. $ 20 per each truck, or machinery $ 0.75 per every ton, or cubic meter If cargo's size is fixed on the OB/L, or on the manifest, Shipco shall collect service fees on basis of weight or size which is more to her favor. B . 0.20 $ per ton or fraction thereof as charges of loading /discharging equipments if same are presented by Shipco and cargo is under / FIO / term. C- If container is / LCL / , Shipco shall collect service fees on basis of ton as per item number /5/ of paragraph /A / of article /14/ in addition to 10 $ for each B/L and the fraction of ton is considered as one ton. Article 15 : If the Syrian - flagged vessel is carrying cargoes in transit together with other cargoes for local consumption, the fees incurred on vessel shall be collected in foreign currency at the percentage of the weight of the cargo in transit to the weight of the total amount on board the vessel. The other expenses are calculated in Syrian Pounds. Article 16 : Hire of motor boats at Oil Terminals: Shipco shall collect an amount of 100 $ per trip at oil terminals. Article 17 : In case of clearing inward /LCL/ containers whose clearance requires replacement of BS/L, or in case of necessity of issuing a delivery order against presentation of house B/L, Shipco shall collect 200 S.P per each B/L and the agent of the cargo shall collect 1000 S.P per each B/L. This amount includes the expenses of stripping the containers at port companies' warehouses. Article 18 : Shipco shall collect commission on passenger tickets at the rate of 3% of value of tickets issued by Shipco, or for confirming reservation. This commission shall be collected either from vessel, or from the tourist office, or at the rate of 50% of the commission from both of them . Article 19 : Amounts which are not mentioned in this decision are to be calculated according to their sums in USD calculated according to the counter value rates of the national monitory in USD applied by the local banks exchange rates. Article 20 : Shipco shall collect an interest at the rate of 9% per annum for amounts not settled after the passage of one month from the date of its claim. Article 21 : Shipco shall be prevented from collecting any commission or remuneration on services unless they are stated in this tariff ,or collecting these commissions or remuneration on services not in conformity with its basis. Article 22 : All previous Tariff decisions concerning fees and commissions collected by Shipco from vessels, tankers and receivers are to be cancelled.
