Minutes of the Planning Committee meeting held at the Town Hall, Bexhill-on-Sea on
Thursday 15 March 2007 at 9.30am.

The Chairman was authorised to sign the minutes of the meeting of the
Committee held on 15 February 2007 as a correct record of the
proceedings.

APOLOGIES FOR ABSENCE
Apologies for absence were received from Chairman of Council, Councillor
Mrs W.M. Miers (ex-officio) and Councillor Mrs. D.C. Williams.
PL94.
ADDITIONAL AGENDA ITEMS / WITHDRAWN APPLICATIONS
The Development Control Manager advised the Committee of the planning
applications which had been withdrawn from the Agenda, by the applicants.
The Head of Planning confirmed that in future this information would be
notified as a formal Agenda Item, at the commencement of each meeting.
This improved communication would enable both Members of the
Committee and members of the public to know before the application was
called, whether or not it was due for consideration at the meeting. This
information would also be added to the Planning Committee Agenda on the
website, as and when applications were withdrawn, if any, following the
publication of the Agenda.

DECISIONS TAKEN UNDER DELEGATED POWERS
PL95.
ENFORCEMENT MATTERS
The following enforcement matter was reported:
(1) Icklesham – Regina, Tram Road, Rye Harbour
RESOLVED: That subject to being satisfied evidentially, the District
Secretary be authorised to issue the appropriate enforcement notice
and take any other steps necessary including legal action under
Sections 179 and 181 of the Town & Country Planning Act 1990.
Compliance period: Two months.
PL96.
TREE MATTERS
The following tree matters were reported:
(i)
10.4.2.269 – The District of Rother (Woodlands Caravan Park,
Westfield Lane, Westfield) Tree Preservation Order 2006
RESOLVED: That the District of Rother (Woodlands Caravan Park,
Westfield Lane, Westfield) Tree Preservation Order 2006 be
CONFIRMED subject to MODIFICATION changing the boundary in the
area referred to a W1b so that the Order now forms a 10 metre strip
along the southern boundary of the site, connecting a small woodland
area which is retained in the south east corner and the rest of the
protected wood to the west, in respect of several trees of whatever
species comprising mainly of broadleaved species (W1).
(ii) RR/2007/126/T – 113 Winchelsea Road, Rye – Crown Reduction by
25%. 40% reduction of one limb and crown lift by 7m of one holm
oak.
Members were concerned at the extent of the proposed works to this
tree which formed an important element of the gateway into Rye. It
was agreed that a site inspection be carried out prior to approving any
works and a more detailed report be submitted to the next meeting.
RESOLVED: That the decision be deferred pending a site inspection
and further detailed report.
PL97.
APPLICATIONS
Outline planning permissions are granted subject to approval by the Council
of reserved matters before any development is commenced, which are
layout, scale, appearance, access and landscaping. Unless otherwise
stated, every planning permission or outline planning permission is granted
subject to the development beginning within 3 years from the date of the
permission. In regard to outline permissions, reserved matters application

for approval must be made within three years from the date of the grant of
outline permission; and the development to which the permission relates
must begin no later than whichever is the later of the following dates: the
expiration of three years from the date of the grant of outline permission or,
the expiration of two years form the final approval of the reserved matters,
or in the case of approval on different dates, the final approval of the last
such matters to be approved.
In certain circumstances the Planning Committee will indicate that it is only
prepared to grant or refuse planning permission if, or unless, certain
amendments to a proposal are undertaken or subject to completion of
outstanding consultations. In these circumstances the Head of Planning
can be given delegated authority to issue the decision of the Planning
Committee once the requirements of the Committee have been
satisfactorily complied with. A delegated decision does not mean that
planning permission or refusal will automatically be issued. If there are
consultation objections, difficulties, or negotiations are not satisfactorily
concluded, then the application will have to be reported back to the
Planning Committee or reported via the internal-only electronic notified ‘D’
system by means of providing further information for elected Members.
This delegation also allows the Head of Planning to negotiate and amend
applications, conditions, reasons for refusal and notes commensurate with
the instructions of the Committee. Any applications which are considered
prior to the expiry of the consultation reply period are automatically
delegated for a decision.
RESOLVED: That the planning applications be determined as shown in
Appendix A attached hereto.
MATTERS FOR INFORMATION

Members noted the report of the Director of Services detailing the appeals
which had been allowed, dismissed or lodged since the last meeting,
together with information on forthcoming inquiries and hearings.
RESOLVED: That the report be noted.

DECISION: GRANT (FULL PLANNING) DELEGATED (SUBJECT TO

1.
No floodlightling or other external means of illumination of the riding arena
shall be provided, installed or operated at the site, except in accordance with
a detailed scheme which shall have first been submitted to and approved in
writing by the local planning authority.
Reason: To safeguard the visual amenities of the locality in accordance with
Policies GD1(iv) & (v) and CF5 of the Rother District Local Plan and Policies
S1(f) & (j) and EN2 of the East Sussex and Brighton & Hove Structure Plan
1991-2011.
2.
The riding arena for the exercising/training of horses hereby permitted shall
be used for private equestrian/recreational purposes only and not for any
commercial riding, livery use or other business use.
Reason: To preserve the visual and/or residential amenities of the locality in
accordance with Policies GD1(ii), (iv) & (v) and CF5 of the Rother District
Local Plan and Policies S1(f) & (j) and EN2 of the East Sussex and Brighton &
Hove Structure Plan 1991-2011.
3.
Manure must be stored at least 10 metres away from any watercourse and
sited in accordance with the ‘Code of Good Agricultural Practice for the
Protection of Waters’.
Reason: To prevent pollution of the water environment from any run-off in
accordance with Policies GD1(v) & (x) of the Rother District Local Plan and
Policies S1(g) and EN11 of the East Sussex and Brighton & Hove Structure
Plan 1991-2011.
4.
Prior to the commencement of the development hereby approved, full details
of the method/ measures of protection of the public sewer are to be submitted
to and approved in writing by the Local Planning Authority, in consultation with
Southern Water. The development shall be carried out in accordance with the
approved details and maintained in that condition thereafter.
Reason: To prevent damage to public utility infrastructure (mains sewer) and
pollution of the water environment in accordance with Policies GD1(v) & (x) of
the Rother District Local Plan and Policies S1(g) and EN11 of the East
Sussex and Brighton & Hove Structure Plan 1991-2011.
Notes:
1.
Under Section 85 of the Water Resources Act 1991 the Environment Agency
would take action against any contaminated water (effluent) discharge into a
controlled watercourse.
2.
The introduction of a culvert into a stream requires the separate prior consent
of the Environment Agency (EA) under Section 23 of the Land Drainage Act
1991 in addition to planning permission.

No new building, new trees or large bushes or other new permanent
obstructions should be located within 3 metres either side of the centreline of
the public sewer.
All existing infrastructure should be protected during the course of
construction works. Liaison with Southern Water is advised.
REASONS FOR GRANTING PERMISSION: The proposed riding arena is of an
appropriate design and position and will not adversely affect the character of the
area or the amenities of adjoining properties and therefore complies with Policies S1
and EN2 of the East Sussex and Brighton & Hove Structure Plan 1991-2011 and
Policies GD1 and CF5 the Rother District Local Plan.

DECISION: GRANT (FULL PLANNING) DELEGATED (REGARDING SECTION
ADJACENT TO MARLEY LANE/PETLEY WOOD RE TREES)
1.
Standard approval/time implementation.
2.
Detailed aspects of the assessment and mitigation strategies for archaeology
shall be submitted for the consideration and approval of the Local Planning
Authority prior to development commencing. The development shall only be
carried out in accordance with the approved details.
Reason: To ensure that features of archaeological interest are properly
examined and recorded, in accordance with Policy GD1(viii) of the Rother
District Local Plan and Policies S1(j) and EN22 of the East Sussex and
Brighton & Hove Structure Plan 1991-2011.
3.
Detailed aspects of the mitigation strategies for landscaping shall be
submitted for the consideration and approval of the Local Planning Authority
prior to development commencing. The development shall only be carried out
in accordance with the approved details. If within a period of five years from
the date of the planting of any tree/hedgeline that tree or hedge plants, or any
replacement, is removed, uprooted or destroyed or dies, [or becomes, in the
opinion of the local planning authority, seriously damaged or defective,]
another tree/hedge plant of the same species and size as that originally
planted shall be planted at the same place, unless the local planning authority
gives its written consent to any variation.
Reason: To enable planting to re-establish and thereby ensure that the
proposed development does not prejudice the appearance of the landscape
quality of the High Weald AONB in accordance with the requirements of
Policy GD1(iv, v) of the Rother District Local Plan and Policy S1(j) and EN2 of
the East Sussex and Brighton & Hove Structure Plan 1991-2011.

Details of the measures to minimise and manage waste generated by the
scheme shall be submitted for the consideration and approval of the Local
Planning Authority prior to the commencement of works on the excavation of

the pipeline. The development shall only be carried out in accordance with the
approved details.
Reason: In the interests of seeking a sustainable development which
minimises waste, in accordance with the Supplementary Planning Guidance
on ‘Construction and Demolition Waste’, of the East Sussex and Brighton &
Hove Structure Plan 1991-2011.
5.
No development approved by this permission shall be commenced until a
detailed method statement for temporary and permanent water crossings, with
detailed pollution prevention measures and any mitigation required, has been
submitted to and approved in writing by the Local Planning Authority in
association with the Environment Agency (EA). Thereafter the approved
scheme shall be carried out in accordance with the approved method
statement. The statement shall include details on the following:
a)
Additional river corridor and crossing point surveys;
b)
Use of no dig techniques at crossing points unless otherwise agreed in
writing;
c)
Location and method for wash-outs on the pipeline;
d)
Timescales for the works, which should be outside the trout spawning
season;
e)
Containment of any sediment run off and/or excavated river bed
material;
f)
Minimisation of sediment disturbance;
g)
Containment of increased silt/suspended solids as a result of
backfilling;
h)
Oil, plant and chemical storage;
i)
Containment of increased silt/suspended solids as a result of sheet
piling or dewatering activities;
j)
Method of construction and operation for the project in order to prevent
pollution of underlying groundwater.
Reason: To prevent pollution of the water environment and impacts upon
protected species in accordance with Policy GD1(x) of the Rother District
Local Plan and Policy S1(g) of the East Sussex and Brighton & Hove
Structure Plan 1991-2011 and Government guidance and requirements
contained within the Wildlife and Countryside Act and PPS9.
6.
Drainage details. CN8C.
Reason: To ensure the satisfactory drainage of the site and to prevent water
pollution in accordance with Policy GD1(x) of the Rother District Local Plan
and Policy S1(g) of the East Sussex and Brighton & Hove Structure Plan 1991
– 2011.
7.
If, during development, contamination not previously identified is found to be
present at the site then no further development (unless otherwise agreed in
writing with the local planning authority), shall be carried out until a method
statement detailing how the unsuspected contamination shall be dealt with
has been submitted to and approved in writing by the local planning authority
and the works shall be completed in accordance with the approved method
statement.
Reason: To prevent pollution of the water environment in accordance with
Policy GD1(x) of the Rother District Local Plan and Policy S1(g) of the East
Sussex and Brighton & Hove Structure Plan 1991-2011.
8. Details of any floodlighting or external illumination shall be submitted to and
approved in writing by the local planning authority before the development
commences. Development shall be carried out in accordance with the
approved details and no other lighting shall be installed.

Reason: To safeguard the visual, rural and residential amenities of the
locality, to reduce any impact upon wildlife and to control overspill and light
pollution in accordance with Policy GD1 (ii), (iv) and (vii) of the Rother District
Local Plan and Policy S1 (f) and (j) of the East Sussex and Brighton & Hove
Structure Plan 1991-2011.
