Further improvement of the European integration structures, including in key line ministries, strengthening verification of the compatibility of government policies and draft legislation with the acquis and EU integration requirements, improving legislation quality, and enhancing cooperation among line institutions are key priorities. The project will assess and enhance the concrete and systemic integration of the transposed acquis in the national legislative framework. To that regard, line institutions at Government central level and the Parliament will be involved through specific assistance. When a plan or a strategy for harmonisation is developed, the project will contribute implementing it. The sustainability of results, including ensuring the necessary capacities for implementation and follow-up, will be specifically in focus. The PLAC project should achieve three results: RESULT 1 Strengthened structures related to harmonization and approximation of national legislation with EU legislation, including mechanisms for consultation of relevant external stakeholders RESULT 2 Compatibility of national legislation with EU legislation improved through preparation of relevant draft laws RESULT 3 Enhanced capacities of the relevant institutions (in particular SEIO, the Secretariat for Legislation, the General Secretariat and line ministries) for harmonization of Serbian legislation with the EU acquis and implementation of national legislation. By adopting such legislation, the Republic of Serbia has transposed the most relevant provisions of the Directive 2009/119/EC on emergency oil stocks. However, in order to complete the transposition of the Directive 2009/119/EC, several regulations and by-laws should be adopted by the Government of the Republic of Serbia and the Ministry of Mining and Energy. By July 2014, most of secondary legislation relevant for establishment of emergency oil stocks has been drafted and such legislation should be adopted in September/October 2014. Furthermore, Emergency Response Plan to be adopted by the Government of the Republic of Serbia as prescribed under Article 31 of the Commodity Reserves Law is to lay out the procedures and actions to be undertaken by the main stakeholders in Serbia during an oil supply crisis. It is meant to serve as a point of reference regarding the main principles and strategies related to emergency oil response, and to establish a common understanding of the roles and responsibilities of each stakeholder. Due to the Plan’s relevance and complexity, the Outline of the Emergency Response Plan shall be drafted. The purpose of this Outline draft is to serve as the basis for developing a full draft of the Emergency Response Plan. This document should be structured as the proposed layout for the Plan, describing the main topic areas to be covered and including key issues which are to be further developed under each area. The Outline draft shall be jointly prepared by two Experts, one with detailed experience in operational functioning of an emergency oil stockholding system and the other with the detailed experience in operational functioning of emergency oil response policies and procedures of European Commission or International Energy Agency (IEA). At present, there is no on-going and/or planned assistance in the area covered by this ToR. The Outline should be structured as the proposed layout for the Emergency Response Plan, describing the main topic areas to be covered and including key issues which are to be further developed under each area. Key areas will include: - key actors in oil crisis response and their responsibilities, - internal procedures for determining the need to activate emergency measures, - actions to be taken in oil crisis in cooperation with the domestic oil industry, - procedures for drawing down emergency oil stocks, - procedures to be followed in internationally coordinated emergency response actions in case of oil crisis and process of gathering and disseminating emergency oil data collection [to be drafted by Expert 2]. Expert 2 Activities: Close co-operation with other project expert and with the representatives from the relevant state authorities of Republic of Serbia; Present operational functioning and key issues of internationally coordinated emergency oil response actions in meetings with the representatives from the Ministry of Mining and Energy; Directorate for Commodity Reserves; Statistical Office; Serbian oil industry and other relevant stakeholders as needed; Present and promote familiarization among representatives of the relevant state authorities on emergency oil data gathering procedures and reporting requirements under an internationally coordinated emergency oil response action; Draft procedures to be followed in internationally coordinated emergency response actions and in fulfilling relevant reporting obligations under Directive 2009/119/EC as necessary for drafting of Outline of the Emergency Response Plan prescribed under Article 31 of the Commodity Reserves Law (Official Gazette of the Republic of Serbia, No. 104/13) [Outline to be drafted by Expert 1]. Related outputs – Expert 1: Outline of the Emergency Response Plan prescribed by the Article 31 of the Commodity Reserves Law (Official Gazette of the Republic of Serbia, No. 104/13) drafted.
