The collecting authority have been unable to recover the above outstanding CIL charge
from the party(ies) who had assumed liability to pay the levy. As per regulation 36 of the
Community Infrastructure Levy Regulations 2010 (as amended), and following all
reasonable effort, we have determined that liability is now transferred to the owners of the
land on which the CIL development stands.
You have been copied in to previous correspondence with the party(ies) who assumed
liability to pay this levy. This correspondence included notification of interest and
surcharges.
After 7 days from the date of this notice we will apportion the liability to pay the outstanding
CIL amount between all known landowners, under regulation 34 of the Community
Infrastructure Levy Regulations 2010 (as amended). We may ask you to provide us with
information to assist the apportionment process, through an information notice served
under regulation 35 of the Community Infrastructure Levy Regulations 2010 (as amended).
The surcharge for undertaking apportionment is £500 per material interest in the land. You
may avoid these additional charges by settling all outstanding amounts, including
surcharges, within the next 7 days.
There is no appeal against this decision to default liability following non-payment.
Landowners wishing to seek a review of this action must address their applications to the
Courts.
