The Attorney General has revised the New Jersey Police Vehicular Pursuit Policy. The attached
revision does not highlight the changes. In reading the newly revised policy the revisions can be
found in the following sections; Section I, subsection B, Number 3, letter e “Road conditions,”
Section III, subsection E. “To diminish the likelihood …” a four line sentence was added onto
this, Section III, subsection G, this has been rewritten, and Section X, subsection E, this is a
new subsection added in.
This revised policy is effective July 2009.
The latest revision addresses two important concerns: (1) officers are reminded that during the
process of “closing the gap" while .in pursuit, they are subject to the laws governing the right of
way pursuant to N.J.S.A. 39:+91 and 92; and (2) officers are also reminded to factor in the
existence of controlled intersections during a pursuit. The revision also requires police
departments to determine whether collisions involving a police vehicle were preventable.
