THE CORPORATION OF THE CITY OF KAWARTHA LAKES BY-LAW 2006 - 282 A BY-LAW TO SET FEES FOR PARKS, FACILITIES AND SERVICES OFFERED BY THE PARKS, RECREATION AND CULTURE DIVISION OF THE COMMUNITY SERVICES DEPARTMENT IN THE CITY OF KAWARTHA LAKES Recitals 1. 2. 3. Section 391 of the Municipal Act authorizes municipalities to charge fees for its services or activities provided or done by or on behalf of it. Council considers it expedient to establish fees for the services provided by the Parks, Recreation and Culture Division of the Community Services Department City of Kawartha Lakes. A Public Meeting in accordance with O. Regulation 244/02 was held on September 26, 2006. Accordingly, the Council of The Corporation of the City of Kawartha Lakes enacts this By-law 2006-282. Section 1.00: Definitions and Interpretation 1.01 Definitions: In this by-law: (a) (b) (c) (d) (e) (f) 1.02 “City”, “City of Kawartha Lakes” or “Kawartha Lakes” means The Corporation of the City of Kawartha Lakes. “City Clerk" means the person appointed by Council to carry out the duties of the clerk described in section 228 of the Municipal Act, 2001. “Council” or “City Council” means the municipal council for the City. “Director” means the Director of Community Services. “Division” means the Parks, Recreation and Culture Division of the Community Services Department of the City of Kawartha Lakes. “Prescribed Fee” means the fee set out in Schedule “A” to this Bylaw. Interpretation Rules: (a) The Schedules attached to this by-law form part of the by-law, and are enforceable as such. (b) The words “include” and “including” are not to be read as limiting the meaning of a word or term to the phrases or descriptions that follow. 1.03 Statutes: References to laws in this by-law are meant to refer to the statutes, as amended from time to time, that are applicable within the Province of Ontario. 1.04 Severability: If a court or tribunal of competent jurisdiction declares any portion of this by-law to be illegal or unenforceable, that portion of this by-law shall be considered to be severed from the balance of the by-law, which shall continue to operate in full force and effect. Section 2.00: Charges for Services and Facilities at City Parks, Sports Fields, Boat Docking and Boat Launches 2.01 Requirement to Pay: All persons availing themselves of services or facilities of the Division, are subject to the payment of the Prescribed Fees set out in Schedule “A” to this By-law. 2.02 Invoice: For the most part, Prescribed Fees are due and payable prior to, or at the time of, delivery of the service or utilization of the facility. However, in the event that the fee is to be collected at a later date, the Division shall cause an invoice for the Prescribed Fees applicable. 2.03 Payment Methods: The fee for services is payable to the City, by cash, money order, cheque, debit card or credit card, prior to, or at the time of, delivery of the service or utilization of the facility. In all cases, payment is due no later than thirty days from the date of delivery of the invoice for the service referenced in Section 2.02. 2.04 Debt to the City: The amount of the invoice, together with any costs incurred by the City to collect the amount owed, together constitute a debt of the customer to the City. The City may collect the debt through any method allowable at law. Section 3.00: Enforcement and Penalties 3.01 Enforcement: This by-law may be enforced by every municipal law enforcement officer and police officer. 3.02 Offence and Penalty: It is an offence for a person to contravene any provision of this by-law, and every person who contravenes this by-law is guilty of an offence and, on conviction, is liable to a fine in accordance with the provisions of the Provincial Offences Act and to any other applicable penalty. Section 4.00: Administration and Effective Date 4.01 Administration of the By-law: The Director of Community Services is responsible for the administration of this by-law. 4.02 Effective Date: This By-law shall come into force on the date it is finally passed.
